Approximately 45.0 -acre site comprised of an existing rip rap levee, maintained grass area, and roadside right-of-way. Land use in the vicinity of the proposed Project consists of
residential, power generation, and open water/recreational uses.

Number 4132 for additional impacts to open waters (Lake Norman) for Duke Energy's Cowans Ford Floating Bulkhead Ramp and Storage Project (SAW-2020-00448/DWR# 20-0340) in
Lincoln County, North Carolina.

Duke Energy and their construction contractor, Crowder Company (Crowder) is requesting approximately 0.05 acres (730 cubic yards) of additional permanent open water fill (rip rap)
and approximately 0.28 acres of temporary de -watering impacts along the sides of the boat ramp to facilitate a safer Portadam cofferdam system during construction. The maximum
capacity to retain water in a Portadam system is 10 feet. The additional stone fill around the boat ramp will allow for additional freeboard and would provide additional safety to workers
during construction during wakes from the lake during windy days or days with high boat traffic. The fill will be associated with the additional area associated with the expanded
Portadam area and fill under the boat ramp.

Based on the information provided, the additional impacts are allowed, and permitted. I have adjusted the permanent
impacts to reflect the changes in Cowans Ford Floating Bulkhead Ramp and Storage Project as described. USACE agrees
that the 50 CY of discharge is waived, and that the additional discharge will not result in no more than minimal adverse
environmental effects.

Dear Ms. Stygar,
I am writing on behalf of Duke Energy Carolinas, LLC (Duke Energy) in reference to SAW-2020-00448, Cowans Ford
Floating Bulkhead Ramp and Storage Project, which was verified by Ms. Catherine Janiczak of the US Army Corps of
Engineers (USACE) in March 2020. Duke Energy proposed to install a launch ramp for a floating bulkhead that will be
used for dam inspections for the nearby Cowans Ford Hydroelectric Station. Duke Energy received verification of the
Nationwide Permit 36 on March 16, 2020, authorizing permanent impacts of 0.14 acre (See Attachment 1). A portion of
this work is already completed, the rip rap and crushed stone base has been installed and a portion of the concrete slab
was installed on top.
Duke Energy and their construction contractor, Crowder Construction Company (Crowder), originally proposed to install
the ramp via a causeway. Crowder proposed to pour the concrete slabs onshore and then push/pull them into place.
During the construction process, this method proved not to be feasible. The construction plan was redesigned with a
proposed cofferdam system, provided by Portadam. This method will allow construction to be completed in the dry and
ensure design compliance for the ramp. (See Attachment 2 — Portadam Example for a simplified example of the
installation.) Please note, the de -watering of the work area will not be discharged directly into the lake.
The construction sequence will be as follows:
• Crowder will install rock past the end of the existing ramp (see Attachment 3 — Revised Impact Figure for
additional details).
• The cofferdam framework will be preassembled on land, placed in the water using a forklift or excavator, floated
to the desired location, and rested on the bottom.
• Once in the desired location, heavy-duty netting will be installed on the framework, and then the liner will be
floated out and installed over the netting and framework.
• Once the liner is installed, the work area will be de -watered.
• De -watering will be accomplished with two to three pumps placed inside spill containments onshore (see
Attachment 4 — De -watering Plan for additional details):
o Rip rap will be placed onshore in an upland area for the pump discharge.
o Once the water reaches appropriate levels, 4-inch pumps will be utilized with sediment bags before
discharge onshore. The water from the temporary workspace will be run through sediment bags and then
allowed to infiltrate in the upland area or return via overland flow to the lake.
o Pumps will be used to keep the work area dry.
Once the area is de -watered, the launch ramp construction will be completed, by installing the concrete slabs.
Once construction is finished, water will be pumped back into the de -watered area.
The liner will be removed, the netting will be removed, and finally the framework will be removed and moved
onshore.
The newly proposed permanent impacts will result from the placement of rip rap at the end of the ramp to facilitate the
cofferdam installation. The rip rap will result in approximately 0.02 acre (56 cubic yards) of additional permanent impacts.
Total permanent impacts are 0.16 acre (1,513.4 cubic yards) for original and newly proposed work. The de -watered
workspace area will result in approximately 0.18 acre of temporary impacts.

Dear Mr. Arcella:
You have our approval, in accordance with the General Certification and those
conditions listed below, for the purpose proposed in your application submitted on February 15,
2021, and fee received on February 16, 2021. After reviewing your application, we have
determined that this project is covered by Water Quality General Certification Number 4132
and/or 4145 which can be viewed on our web site at https://deg.nc.gov/about/divisions/water-
resources/water-resources-permits/wastewater-branch/401-wetlands-buffer-permits/401-401-
isolated-wetlands-waters-program The General Certification allows you to use Nationwide
Permit Number 36 and/or Regional General Permit 30 once it is issued to you by the U.S. Army
Corps of Engineers (COE). Please note that you should get any other federal, state or local
permits before proceeding with your project, including those required by (but not limited to)
Sediment and Erosion Control, Non -Discharge, and Water Supply Watershed regulations.
The above noted Certification will expire when the associated 404 permit expires unless
otherwise specified in the General Certification. It is advised that all conditions of the
Certification are reviewed prior to initiation of the project. In addition to the requirements of the
Certification, you must also comply with the following conditions:
This approval is only valid for the purpose and design that you described in your
application. If you change your project, you must notify us in writing, and you may be
required to send us a new application for a new Certification. If total wetland fills for this
project (now or in the future) exceed one acre, or of total impacts to streams (now or in
the future) exceed 300 linear feet, compensatory mitigation may be required. If the
property is sold, the new owner must be given a copy of the Certification and approval

Act (CWA) Section 404 Nationwide Permit 36 (Boat Ramps)/Section 401 Water Quality General Certification Number
4132 for additional impacts to open waters (Lake Norman) for Duke Energy's Cowans Ford Floating Bulkhead Ramp and
Storage Project (SAW-2020-00448/DWR# 20-0340) in Lincoln County, North Carolina.
Krysta — Your voicemail indicated that you are on maternity leave until mid -July so I copied Bryan Roden -Reynolds on this
request.
Alan — I will also submit a new application electronically and pay the application fee to process this request.
Original Section 404/401 Approval (March 2020) — An electronic Pre -Construction Notification (PCN) was submitted to
authorize approximately 0.14 acre of permanent fill (1,558 cubic yards) to install a boat launch (i.e., ramp) for a floating
bulkhead that would be used for dam inspections for the nearby Cowans Ford Hydroelectric Facility. Duke Energy
received authorization for construction under a CWA Section 404 U.S. Army Corps of Engineers (USACE) Nationwide
Permit 36 (Boat Ramps) on 3/16/2020 (SAW-2020-00448). Approval of the project under 401 Water Quality General
Certification Number 4132 and/or 4145 was received from the N.C. Division of Water Resources (NCDWR), dated
3/18/2020 (see Attachment 1 — Section 404/401 2020 Approvals).
Section 404/401 Modification #1 — (February 2021) — The original boat launch design included installation via a
causeway by pouring the concrete slabs onshore and then pushing/pulling them into place. During the construction
process, this method proved to be not feasible. The construction plan was redesigned to utilize a cofferdam system,
provided by Portadam, which allowed construction of the ramp to be completed in the dry. A modification was submitted to
the USACE and NCDWR for an additional 0.02 acres (56 cubic yards) of permanent open water impacts at the end of the
previously permitted boat ramp to facilitate installation of the Portadam cofferdam system. The temporary de -watering
workspace associated with the cofferdam will result in approximately 0.18 acre of temporary open water impacts. Email
authorization was received from the USACE on 2/17/2021 and an NCDWR approval letter for modifications under 401
Water Quality General Certification Number 4132 and/or 4145 was also received, dated 3/2/2021 (see Attachment 2 —
Modification #1 Approvals).
Section 404/401 Modification #2 (July 2021) - Duke Energy and their construction contractor, Crowder Company
(Crowder) is requesting approximately 0.05 acres (730 cubic yards) of additional permanent open water fill (rip rap) and
approximately 0.28 acres of temporary de -watering impacts along the sides of the boat ramp to facilitate a safer Portadam
cofferdam system during construction. The maximum capacity to retain water in a Portadam system is 10 feet. The
additional stone fill around the boat ramp will allow for additional freeboard and would provide additional safety to workers
during construction during wakes from the lake during windy days or days with high boat traffic. The fill will be associated
with the additional area associated with the expanded Portadam area and fill under the boat ramp (see Attachment 3 —
Cowans Ford Impact Area).

Crowder provided Duke Energy with the construction sequence below:
• Crowder will place a turbidity curtain around the perimeter of the work area.
• Crowder will install a rip rap causeway below the normal pool elevation in line with the proposed boat ramp. The
causeway will serve as a stone base for the Portadam in order to facilitate the assembly of the cofferdam. The rip
rap causeway will be removed once the area is dewatered.
• Crowder will install rock past the end of the existing ramp.
• The cofferdam framework will be preassembled on land, placed in the water using a forklift or excavator, floated
to the desired location, and rested on the bottom.
• Once the framework is established in the desired location, heavy-duty netting will be installed on the framework,
and then the liner will be floated out and installed over the netting and framework.
• The work area will be de -watered once the liner is installed.
• De -watering will be accomplished with two to three pumps placed inside spill containments onshore:
o Rip rap will be placed onshore in an upland area for the pump discharge.
o Once the water reaches appropriate levels, 4-inch pumps will be utilized with sediment bags before
discharge onshore. The water from the temporary workspace will be run through sediment bags and then
allowed to infiltrate in the upland area or return via overland flow to the lake.
o Pumps will be used to keep the work area dry.
• Once the area is de -watered, the launch ramp construction will be facilitated by installing the concrete slabs.
• Water will be pumped back into the temporary de -watered area once the construction is completed.
• The Portadam will be dissembled and removed.
