The project will involve the construction of a complete lumber processing facility (production sawmill) with railway, log truck, and vehicular access ingress and egress, and associated site grading. The type of equipment that will be used during grading and construction activities include: backhoe, graders, pans. mixers, cranes, etc. The project area consists primarily of existing agricultural farmland and is bordered on the west by Marsh Swamp and the CSX Railway, bordered on the north by Dog Pond Branch, bordered on the east by U.S Hwy 301 and bordered on the south by an unnamed tributary of Marsh Swamp. The project location is shown on the Enfield N.C. USGS Topographic Map (Figure 1), the Halifax County Soil Survey Map (Figure 2), and a color aerial photograph (Figure 3) included in Appendix H. The overall and individual impact maps are included in Appendix III. S &ME performed the original wetland delineation and stream assessments in September and October of 2012, and conducted subsequent on -site regulatory review meetings with the USACE (Thomas Brown) on September 9, 2012 and the NCDWQ (Martin Richmond) on October 11, 2012. A letter from NCDWQ confirming the stream determination dated December 5, 2012 (from Martin Richmond) was issued and is included in Appendix IV. Routine Wetland Determination Forms are included in Appendix V. PROPOSED PROJECT IMPACTS The project will involve the filling of one jurisdictional wetland area (0.062 acres), one intermittent stream channel area (79 linear feet, 158 square feet), one open water area (0.159 acres) and riparian stream buffer (10,404 square feet). Proposed impacts are shown on the Impact Maps (Sheets 2 -4) included in Appendix III. PROTECTED SPECIES AND CULTURAL RESOURCES Protected Species S &ME's review of potential protected species habitat entailed a literature review of existing records obtained from federal and state sources to identify documented records of protected species. The USFWS current list of federally protected species was consulted for a listing of protected species documented within Halifax County, North Carolina. This review identified five protected animal species. Listed species and their federal status are identified in Table 1. This review did not identify EO's pertaining to federally protected species within a two -mile radius of the project area. Cultural Resources S &ME's review of historic properties on the North Carolina State Historic Preservation Office Geographic Information Systems (GIS) Virtual Workroom (http: / /gis.ncdcr.gov/hpoweb/) did not reveal any historic properties in the project area. Avoidance and Minimization Prior to site planning, wetlands, streams, and open waters were identified and confirmed by both the USACE and NCDWQ. Based on this information the design of the project site was oriented to keep the majority of site grading outside of jurisdictional and buffered areas. In areas where fill slopes intrude into existing jurisdictional and/or buffered areas, slopes with 2:1 ratios were utilized to achieve desired grades with minimal impact. The cut and fill balance of project site kept grading near buffered areas to a minimum. Site grading associated with this project has been phased in order to further avoid impacts. Phase 1 of the project will begin at the higher elevations of the project site while grading and erosion control progresses closer to the jurisdictional wetlands and buffered streams in Phase 2 of the project. Phase 1 of the project approved a disturbance of 35 acres to begin critical foundational and mechanical portions of the project. Phase 2 includes the majority of the site grading and all grading along the borders of the site. Appropriate sediment and erosion control practices outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" and approved by NCDENR Division of Land Quality will be in compliance with specifications governing the Nationwide Permit No. 39 S &ME Project No. 1054 -12 -325 Klausner Lumber Two Project, Enfileld, Halifax County, NC May 29, 2013 proper design, installation, operation and maintenance of such Best Management Practices (BMP's) to comply with the appropriate turbidity water quality standard. After construction, disturbed areas will be seeded and restored. MITIGATION The proposed permanent impacts to Tar - Pamlico Riparian Buffer include 5,508 square feet of Zone 1 impacts and 4,896 square feet of Zone 2 impacts. Using the required mitigation of a 3:1 for Zone 1 impacts and 1.5:1 for Zone 2 impacts, the total amount of buffer mitigation required for this project is 23,868 square feet. There is no private mitigation bank available and therefore payment into the NCEEP has been applied for and a copy of the acceptance letter has been attached as Appendix VI.
