Mr. Tim O'Connell, Lead Project Manager with Rhetson Companies, Inc. was also present during the inspection and his time and assistance is greatly appreciated. The purpose of the inspection was to ensure compliance with State Stormwater Management Permit SW6120306 that was issued on April 12, 2012. A copy of the Compliance Inspection Report is enclosed for your review. As a result of the inspection and subsequent file review, it has been determined that the facility is not in compliance with the conditions of the subject permit and approved plans. The required actions that are necessary to bring this site into compliance are noted under the Inspection Summary and Comments sections of the report. You are asked to provide this office a written/typed response within 30 calendar days from receipt of this letter. Your response should specify actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information may constitute the issuance of a Notice of Violation, which is subject to the assessment of a civil penalty of up to $25,000 per day, per violation. However, it was apparent that the infiltration basin has not been properly maintained. Vegetative growth and standing water was obsen throughout the main treatment area, which should be 12" of clean sand. Large trees and shrubs are growing within a significant portion of the infiltration basin and around the rip rap dissipator receiving bypass flows from the storm drain splitter box. Due to the standing water and abundance of vegetative growth throughout the infiltration basin, other aspe of the permitted system such as the forebay and grass filter strip could not be thoroughly evaluated. An area of erosior at the southern end of the infiltration basin was also observed. Records of inspection and maintenance activities could not be provided for review upon request. Appropriate maintenance must be conducted on all parts of the permitted stormwater management system in order to meet approved design criteria. Upon completion of necessary maintenance, a follow-up inspection will be conducted.
