Dear Ms. Piechoski:
The Division of Water Resources (DWR) received a proposed Corrective Action Plan (CAP) for
the Former Cape Industries Waste Injection Facility (Hercules) on October 23, 2020. Staff
reviewed the CAP and requested additional information on February 2, 2021. A CAP (Revised)
was received May 21, 2021. After final review, the CAP (Revised) is approved. However, in
regards to 1St checked item in Section 10 Summary, the request to discontinue monitoring of
COPCs if they meet IMACs/ NCAC 2L standards for two consecutive events will be evaluated by
staff at that time before granting the request to discontinuing sampling. Concentration levels,
trends, and any statistical analysis will be used for the evaluation.
