Prior to submitting this completed application form, applicants must meet with the appropriate
regional office staff to discuss whether or not an SOC is appropriate for this situation. Please

III. ADDITIONAL FLOW OR FLOW REALLOCATION:
In accordance with NCGS 143-215.67(b), only facilities owned by a unit of government may
request additional flow.
Additional flow may be allowed under an SOC only in specific circumstances. These
circumstances may include eliminating discharges that are not compliant with an NPDES or
Non-discharge permit. These circumstances do not include failure to perform proper
maintenance of treatment systems, collection systems or disposal systems. When requesting
additional flow, the facility must include its justification and supporting documentation.

If the requested additional flow is non-domestic, the facility must be able to demonstrate the
ability to effectively treat the waste and dispose of residuals. The applicant must provide a
detailed analysis of the constituents in the proposed non-domestic wastewater.

Please attach a detailed description or project listing of the proposed allocation for additional
flow, with an explanation of how flow quantities were estimated. Further, any additional flow
requested must be justified by a complete analysis,by the permittee, that additional flow will not
adversely impact wastewater collection/treatment facilities or surface waters.
IV. NECESSITY NARRATIVE:
Please attach a narrative providing a detailed explanation of the circumstances regarding the
necessity of the proposed SOC. Include the following issues:
• Existing and/or unavoidable future violations(s)of permit conditions or limits(s),
• The existing treatment process and any process modifications that have been made to
date to ensure optimum performance of existing facilities,
• Collection system rehabilitation work completed or scheduled(including dates),
• Coordination with industrial users regarding their discharges or pretreatment facilities.
Identify any non-compliant significant industrial users and measure(s) proposed or
already taken to bring the pretreatment facilities back into compliance. If any industrial
facilities are currently under consent agreements, please attach these agreements,
• Date and outcome of last Industrial Waste Survey,
• Whether or not the facility is acting as a regional facility receiving wastewater from other
municipalities having independent pretreatment programs.
V. CERTIFICATION:
The applicant must submit a report prepared by an independent professional with expertise in
wastewater treatment. This report must address the following:
• An evaluation of existing treatment units, operational procedures and recommendations
as to how the efficiencies of these facilities can be maximized. The person in charge of
such evaluation must sign this document.
• A certification that these facilities could not be operated in a manner that would achieve
compliance with fmal permit limits. The person making such determination must sign
this certification.
• The effluent limits that the facility could be expected to meet if operated at their
maximum efficiency during the term of the requested SOC (be sure to consider interim
construction phases).
• Any other actions taken to correct problems prior to requesting the SOC.

VI. PREDICTED COMPLIANCE SCHEDULE:
The applicant must submit a detailed listing of activities along with time frames that are
necessary to bring the facility into compliance. This schedule should include milestone dates for
beginning construction,ending construction,and achieving final compliance at a minimum. In
determining the milestone dates,the following should be considered:
• Time for submitting plans,specifications,and appropriate engineering reports to DWR
for review and approval.
• Occurrence of major construction activities that are likely to affect facility performance
(units out of service,diversion of flows,etc.)to include a plan of action to minimize
impacts to surface waters.
• Infiltration/Inflow work, if necessary.
• Industrial users achieving compliance with their pretreatment permits if applicable.
• Toxicity Reduction Evaluations(TRE),if necessary.
VII. FUNDING SOURCES IDENTIFICATION:
The applicant must list the sources of funds utilized to complete the work needed to bring the
facility into compliance. Possible funding sources include but are not limited to loan
commitments,bonds,letters of credit,block grants and cash reserves. The applicant must show
that the funds are available,or can be secured in time to meet the schedule outlined as part of this
application.
If funding is not available at the beginning of the SOC process, the permittee must submit a copy
of all funding applications to ensure that all efforts are being made to secure such funds.
Note: A copy of the application should be sufficient to demonstrate timeliness unless regional
office has reason to request all information associated with securing funding.
THE DMSION OF WATER RESOURCES WILL NOT ACCEPT THIS APPLICATION
PACKAGE UNLESS ALL OF THE APPLICABLE ITEMS ARE INCLUDED WITH THE
SUBMITTAL.
Required Items:
a. One original and two copies of the completed and appropriately executed application
form, along with all required attachments.
• If the SOC is for a City / Town, the person signing the SOC must be a ranking
elected official or other duly authorized employee.
• If the SOC is for a Corporation/ Company/ Industry/ Other, the person signing
the SOC must be a principal executive officer of at least the level of vice-
president,or his duly authorized representative.
• If the SOC is for a School District, the person signing the SOC must be the
Superintendent of Schools or other duly authorized employee.

Carolina Administrative Code [T15A NCAC 2H .1206(a)(3)].
b. The non-refundable Special Order by Consent (SOC) processing fee of$400.00. A
check must be made payable to The Department of Environment and Natural

APPLICATION FOR A SPECIAL ORDER BY CONSENT
IV. NECESSITY NARRATIVE:
System Overview
The City of Brevard owns and operates a wastewater collection and treatment system that consists
of:
• 55 miles of gravity sewer lines
• 6 miles of forcemains
• 17 sewer lift stations
• 2.5 MGD wastewater treatment facility (WWTP) that discharges into the French Broad
River
• 3,684 residential and commercial customers
• 13 total sewer basins(including 2 future basins)
The collection system includes of three primary sewer lift stations that moves wastewater from the
collection system to the WWTP: Gallimore Road Pump Station; Neely Road Pump Station; and
Wilson Road Pump Station.
Current Situation
The City's wastewater collection system has experienced 176 sanitary sewer overflow (SSO)
events from December 2007 through April 2019. To address these issues, in 2013, the City of
Brevard hired CDM-Smith to perform a study of the entire sewer system to identify the sources of
rain-dependent inflow and infiltration (RDI&I) causing said SSO events. The resulting study
identified 3 sewer basins as priority#1 in the City's effort to combat inflow and infiltration(I&I).
These basins are Singing Branch,Jumping Branch,and Brushy Creek,all 3 of these sub-basins are
tributary to the Gallimore Road Lift Station. In validating this assessment, it is documented that
51% of the systems SSO events occurred at the Gallimore Road Pump Station and its tributary
sub-basins from December 2007 thru December 2018.
To combat the above referenced I/I, the City entered into a Settlement Agreement with NCDEQ
in 2012 to execute five (5) sewer improvements projects worth approximately $16,000,000 by
2017.The improvements consisted of:
• Kings Creek Basin Phase II-replacement/rehabilitation of 8,100 linear feet of aged gravity
sewer
• Kings Creek Basin Phase III - replacement/rehabilitation of 10,600 linear feet of aged
gravity sewer
• Neely Road Pump Stations Improvements - increase the capacity of the pump station to
reduce likelihood of SSO events
• Neely Road Forcemain Improvements — replace the old 12" forcemain with a 20"
forcemain from Neely Road Pump Station to the WWTP

• 3.2 million-gallon Equalization Basin at the WWTP
The City also adopted an annual sewer improvements program for the
assessment/repair/replacement of aged sewer infrastructure,establishing an annual budget for said
program of$100,000. The City also established a pump and haul program in an effort to limit the
amount of flow actually discharged during an SSO event(291,900 gallons were pumped in 2020).
Existing and/or Unavoidable Future Violations of Permit Conditions or Limits
Despite these improvements and new infrastructure repair program, SSO's have persisted due to
excessive inflow and infiltration (UI) during rain events, particularly in the areas tributary to the
Gallimore Road Pump Station.Much of this part of the system is made up of old clay gravity sewer
mains and brick manholes, especially the trunk lines which located along creeks and in low-lined
areas. Because of the violations associated with these SSO events, City has paid $103,174.33 in
penalties since October 2010, including$90,127.33 since September 2017.
Proposed Project
In response to the continuing SSO events, the City solicited the service of Summit Engineering
Group of NC, Inc. to define and execute another replacement/rehabilitation project focused on
removing I/I from the aged gravity sewer pipes and manholes within the sewer basins tributary to
the Gallimore Road Pump Station. These mains typically consist of 40+ year old clay pipes and
brick manholes. The previously referenced CDM-Smith report and field inspections consisting of
smoke testing and CCTV were used to define the scope of the proposed project. The following
table provides a summary of the construction activities.

The City was awarded funding by the Clean-Water State Revolving Fund(more on this below)in
2019 and is scheduled for completion in the Summer of 2022.
V. CERTIFICATION:
This application consists of a SOC for the City Collection System. A report prepared by an
independent professional with expertise in wastewater treatment is not applicable.

RESOLUTION NO. 2021-20
RESOLUTION FOR A SPECIAL ORDER BY CONSENT (SOC)
WHEREAS, the City of Brevard has a permit to discharge treated wastewater to
French Broad River, classified B waters of this State in the French Broad River Basin; and
WHEREAS, this discharge is allowed under NPDES Permit Number NC0060534
effective May 1, 2017, and scheduled to expire on September 30, 2021 and
WHEREAS, the City of Brevard intends to complete the collection system
rehabilitation project called "Gallimore Road Sewer Basin Rehabilitation" which consist of
the rehabilitation and/or replacement of approximately 10,500 linear feet of 8" and 12"
gravity sewer mains and 50 manholes in an effort to reduce inflow/infiltration into the
collection system; and
WHEREAS, the City of Brevard agrees to maintain and operate the wastewater
treatment system at its maximum level of efficiency during the interim period of the Special
Order by Consent and thereafter; and
WHEREAS, the City of Brevard has secured funding for necessary collection system
plant improvements through CWSRF and other cash reserves; and
WHEREAS, the City of Brevard hereby authorizes Jim Fatland, City Manager, to have
the authority to sign and execute the Special Order by Consent on behalf of the City of
Brevard; and
NOW THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF
BREVARD, NORTH CAROLINA THAT the City of Brevard hereby requests a Special Order
by Consent from the Environmental Management Commission, and further authorizes Jim
Fatland, City Manager, to sign and execute this document on behalf of the City of Brevard.
This Resolution shall become effective upon its adoption and approval.
