Dear Mr. Butt:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on March 9, 2021. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
1. Please submit a completed, signed, and sealed Supplement EZ form for the wet pond.
The form can be found on the Stormwater Design Manual Web Page.
2. Please upload a signed and notarized copy of the O&M Agreement. Please also note that
there is a new O&M EZ form available on the Stormwater Design Manual Web Page.
3. The calculations show that the calculated water quality volume was based on the new
impervious area only. While the rules only require that this area be treated, if the drainage
area to the SCM exceeds the minimum area, then the SCM has to be designed to treat the
actual contributory drainage area. Therefore, the wet pond must be designed using the
runoff volume from the entire drainage area as the water quality volume [I 5A NCAC
02H .1050(1)].
4. When calculating the average depth of the wet pond, the permanent pool volume of the
entire wet pond, including the forebay, was used. The average depth must be calculated
using only the volume of the main pool (Wet Pond MDC 2).
5. The calculation for the drawdown time used a water quality volume that was different
than the calculated water quality volume. The MDC require that the drawdown time of
the water quality volume be between 2 and 5 days (Wet Pond MDC 7).

6. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents. Pdfs must be uploaded using the form at:
https:Hedoes.deq.nc.gov/Forms/SW ProjectSubmittal
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to May 8, 2021, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal
of all required items, including the application fee. Please reference the State assigned project
number SW5210301 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
