The Division has determined that your application is incomplete and cannot be processed. The application is on-hold until all of the following information is received: Please provide more details regarding avoidance and minimization of wetland impacts for this project. [15A NCAC 02H .0506(b)(1)] 1. please explain why Lot 31 cannot be moved, reconfigured, or eliminated to avoid or lessen impacts to Wetland 2 (W2). Please revise the plans to avoid the impacts or provide a detailed explanation of why this plan for the activity cannot be practically accomplished, reduced or reconfigured to avoid impacts to the W2. The applicant and project engineers worked to reconfigure the lot layout and were able to relocate lot 31 to reduce wetland impacts. Total permanent wetland impacts decreased from 0.352 acres to 0.237 acres (0.115 reduction). Please see attached Update Pre-Construction Notification Application and Impact Exhibits. You have indicated Wetland 3 (W3) is not jurisdictional. It is unclear on the plans if impacts from lots will occur during construction. If impacts are to occur, please provide more information regarding the wetland type for W3. [15A NCAC 02H .0502 (c)] Wetland W3 was determined to be non-jurisdictional by Lyle Phillips on 7/30/2020, please see attached email dated Feb. 12, 2021 and Wetland Sketch Map with title block date of 8/11/2020. Per the project plans, this W3 area is to be avoided. Please confirm if Impact A1 (stormwater drainage) is considered a permeant conversion impact to Wetland 2. [15A NCAC 02H .0502 (c)] Impact A1 (stormwater drainage) has been eliminated. Please see attached Update Pre- Construction Notification Application and Impact Exhibits. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information in response to this email OR by submitting all of the above requested information through this link: https://edocs.deq.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on the link is referenced above). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Section 401 of the Clean Water Act for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
