DANIEL SMITH Director NORTH CAROLINA Environmental Quality July 8, 2021 Ted Griffith Eco Terra Partners, LLC 1117 Peachtree Walk, NE Suite 176 Atlanta, GA 30309 (via electronic mail: mitigation@ecoterra.com) DWR ID# 2019-1261 v2 Pitt County Re: Kittrell Hill Buffer Mitigation & Nutrient Offset Mitigation Banking Instrument (MBI) Kittrell Hill Bank Parcel Credit Release — Task 4 Dear Mr. Griffith: On February 1, 2021, the Division of Water Resources (DWR) received a Year 1 Monitoring Report from Eco Terra Partners, LLC (Eco Terra) for the Kittrell Hill site. Overall, site conditions appear to look good and vegetation data results show stem densities higher than the required 260 stems/acre throughout the site. Additionally, no concerns with invasive species or major encroachment within the easement boundary were noted. EcoTerra will submit information pertaining to the supplemental planting efforts that have occurred on the site with the submittal of the Year 2 Monitoring Report. On July 6, 2021, DWR received a continuation certificate and bond rider for performance bond (#54- 229659) in the amount of $80,000 issued to Eco Terra from United Fire & Casualty Company to cover monitoring and maintenance at the subject site. The term of this bond has been extended thru August 27, 2022. Future credit releases will be dependent on both the renewal of this performance bond and the annual monitoring reports. In accordance with the MBI, signed on March 26, 2020, the following Project Milestones have been met and the corresponding credits shall be released: Task/Milestones Credit 4) Monitoring Report #1 Approved by the DWR & financial assurance renewed 10% By copy of this correspondence, DWR confirms that you have satisfied the above requirements for the above -referenced tract and 10% of your Nitrogen nutrient offset credits (0.10 x 21,147.061 lb-N = 2,114.706 lb-N) and 10% of your Neuse buffer Restoration credits (0.10 x 363,817 ft2 = 36,381.70 ft2) are now available for sale. Additionally, the riparian buffer credits must be used for impacts in the Neuse River Basin in accordance with guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015.
