Subject: Notice of Violation: NOV-2021-LV-0459
Dear Mr. Boss,
I have reviewed the permit violations referenced in NOV-2020-LV-0459 for the
Permit # NC0026573 March 2021 DMR. After reviewing and discussing this with staff, it
was determined that these violations were the result of heavy rainfall.
The facility recorded 2.03 inches of rainfall that fell over a two-hour period on
3/18/21 causing minor flooding in area. Plant staff filled all peak flow storage basins
during this time due to the excessive flow that arrived very quickly to combat the
hydraulic overloading. TSS and BOD results were elevated for that day but compliant for
the week. The staff were in the process of draining peak flow storage basins following the
event but on 3/25/21, additional heavy rain fell totaling 3.04 inches at the plant. This
produced a 15.22 MGD total flow (peaking at 28 MGD for 8 hours) for the day. This
caused peak flow storage to fill quickly and hydraulic overloading to occur. This resulted
in TSS and BOD violations for the week and TSS violation for the month. Linda Wiggs
for NCDEQ was contacted via email on 3/26/21 to report TSS violation and expected
BOD violation.
