On February 15, 2021, an approval was issued for work conducted in the buffer. Two hundred
(200) square feet of impact in Zone 1 and three hundred thirty (330) square feet in Zone 2 was
approved (see the attached site plan). No other impacts were approved. It has come to our
attention that artificial grass has been placed in the buffer (see photo). This is considered
impervious material and is not allowed per the Catawba Riparian Buffer Rule Buffer (15A
NCAC 02B .0614).
Required Corrective Actions:
1) The artificial turf must be removed from the buffer. Impervious material is not
allowed in the buffer without written approval or allowed per the Catawba Buffer
Rule.
2) Natural material/ground cover shall be installed within the buffer; shredded oak
mulch and/or /pine straw at a minimum of 6 inches in depth. Shrubs may be
planted or other vegetative cover may be installed to enhance buffer function,
excluding a maintained lawn.
3) All actions should be completed by July 30, 2021. Photos may be provided upon
completion via email.
If you have an explanation or any information/documentation related to the noted issue that you
wish to present, please respond within fifteen (15) days of receipt of this Notice. Your response
should address the items identified in this Notice.
