Pretreatment Program (Y/N) No County: Mecklenburg Region Mooresville Page 1 of 6 Briefly describe the proposed permitting action and facility background: This facility is an industrial (flow <1 MGD) collecting stormwater from a Surface -Water Pollution Prevention System in proximity to above -ground storage tanks (ASTs). Facilities include surface bulk - storage of petroleum hydrocarbon fuels in excess of one million gallons, and fuel -truck loading racks. The stormwater component for this facility is covered under Individual NPDES permit NC0005185 as Outfall 006. Significant changes to the facility include the removal of a groundwater remediation system (Outfall 007) to certificate of coverage (COC) NCG510555 under General Permit NCG510000. No discharge has occurred to date from Outfall 007 has been containerized and hauled offsite. The permittee is seeking coverage under the general permit mainly because they wish for their contractor for groundwater remediation to manage the complete operation and self -monitoring for the system on their behalf. 2. Compliance Summary Summarize the compliance record with permit effluent limits (past 5 years): BIMS indicated missing information for Outfall 007. According to the renewal application, no discharge has occurred for Outfall 007, which will be transferred to coverage under general permit NCG510000. [See Attachment C NC0005185 Monitoring Report Violations_lp & Attachment D NC0005185 Other Violations_lp] Summarize the compliance record with aquatic toxicity test limits and any second species test results (past 5 years): No toxicity monitoring was conducted for Outfall 007. Summarize the results from the most recent compliance inspection: The facility had some issues with operator visitation as noted in the most recent compliance inspection. [See Attachment E NC0005185_Compliance Evaluation Inspection_20201117] 6. Water Quality -Based Effluent Limitations (WQBELs) Dilution and Mixing Zones In accordance with 15A NCAC 2B.0206, the following streamflows are used for dilution considerations for development of WQBELs: 1Q10 streamflow (acute Aquatic Life); 7Q10 streamflow (chronic Aquatic Life; non -carcinogen HH); 30Q2 streamflow (aesthetics); annual average flow (carcinogen, HH). If applicable, describe any other dilution factors considered (e.g., based on CORMIX model results): NA. If applicable, describe any mixing zones established in accordance with 1 SA NCAC 2B. 0204(b): NA. Oxygen -Consuming Waste Limitations Limitations for oxygen -consuming waste (e.g., BOD) are generally based on water quality modeling to ensure protection of the instream dissolved oxygen (DO) water quality standard. Secondary TBEL limits (e.g., BOD= 30 mg/1 for Municipals) may be appropriate if deemed more stringent based on dilution and model results. If permit limits are more stringent than TBELs, describe how limits were developed: NA. Page 3 of 6 Ammonia and Total Residual Chlorine Limitations Limitations for ammonia are based on protection of aquatic life utilizing an ammonia chronic criterion of 1.0 mg/1 (summer) and 1.8 mg/1 (winter). Acute ammonia limits are derived from chronic criteria, utilizing a multiplication factor of 3 for Municipals and a multiplication factor of 5 for Non -Municipals. Limitations for Total Residual Chlorine (TRC) are based on the NC water quality standard for protection of aquatic life (17 ug/1) and capped at 28 ug/1 (acute impacts). Due to analytical issues, all TRC values reported below 50 ug/1 are considered compliant with their permit limit. Describe any proposed changes to ammonia and/or TRC limits for this permit renewal: NA. Reasonable Potential Analysis (RPA) for Toxicants Not applicable, conduct RPA analysis and complete information below. The need for toxicant limits is based upon a demonstration of reasonable potential to exceed water quality standards, a statistical evaluation that is conducted during every permit renewal utilizing the most recent effluent data for each outfall. The RPA is conducted in accordance with 40 CFR 122.44 (d) (i). The NC RPA procedure utilizes the following: 1) 95% Confidence Level/95% Probability; 2) assumption of zero background; 3) use of Y2 detection limit for "less than" values; and 4) streamflows used for dilution consideration based on 15A NCAC 2B.0206. Effective April 6, 2016, NC began implementation of dissolved metals criteria in the RPA process in accordance with guidance titled NPDES Implementation of Instream Dissolved Metals Standards, dated June 10, 2016. Toxicity Testing Limitations Permit limits and monitoring requirements for Whole Effluent Toxicity (WET) have been established in accordance with Division guidance (per WET Memo, 8/2/1999). Per WET guidance, all NPDES permits issued to Major facilities or any facility discharging "complex" wastewater (contains anything other than domestic waste) will contain appropriate WET limits and monitoring requirements, with several exceptions. The State has received prior EPA approval to use an Alternative WET Test Procedure in NPDES permits, using single concentration screening tests, with multiple dilution follow-up upon a test failure. Describe proposed toxicity test requirement: Toxicity Monitoring is not required under General Permit NCG510000. Mercury Statewide TMDL Evaluation There is a statewide TMDL for mercury approved by EPA in 2012. The TMDL target was to comply with EPA's mercury fish tissue criteria (0.3 mg/kg) for human health protection. The TMDL established a wasteload allocation for point sources of 37 kg/year (81 lb/year), and is applicable to municipals and industrial facilities with known mercury discharges. Given the small contribution of mercury from point sources (-2% of total load), the TMDL emphasizes mercury minimization plans (M1VIPs) for point source control. Municipal facilities > 2 MGD and discharging quantifiable levels of mercury (>1 ng/1) will receive an MMP requirement. Industrials are evaluated on a case -by -case basis, depending if mercury is a pollutant of concern. Effluent limits may also be added if annual average effluent concentrations exceed the WQBEL value (based on the NC WQS of 12 ng/1) and/or if any individual value exceeds a TBEL value of 47 ng/1 Page 4 of 6 Describe proposed permit actions based on mercury evaluation: NA. Other TMDL/Nutrient Management Strategy Considerations If applicable, describe any other TMDLs/Nutrient Management Strategies and their implementation within this permit: Lake Wylie has TMDLs for Total Phosphorus and Total Nitrogen. Nutrients are not a concern for groundwater remediation under General Permit NCG510000. Other WQBEL Considerations If applicable, describe any other parameters of concern evaluated for WQBELs: See General Permit NCG510000 permit and files. If applicable, describe any special actions (HQW or ORW) this receiving stream and classification shall comply with in order to protect the designated waterbody: Waters classified as HQW/ORW are excluded from coverage under General Permit NCG510000. If applicable, describe any compliance schedules proposed for this permit renewal in accordance with 15A NCAC 2H.0107(c) (2) (B), 40CFR 122.47, and EPA May 2007 Memo: NA. Technology -Based Effluent Limitations (TBELs) General Permit NCG510000 has a TBEL of 30 mg/1 for TSS. See permit file for NCG510000 for information. 8. Antidegradation Review (New/Expanding Discharge): The objective of an antidegradation review is to ensure that a new or increased pollutant loading will not degrade water quality. Permitting actions for new or expanding discharges require an antidegradation review in accordance with 15A NCAC 2B.0201. Each applicant for a new/expanding NPDES permit must document an effort to consider non -discharge alternatives per 15A NCAC 2H.0105( c)(2). In all cases, existing instream water uses and the level of water quality necessary to protect the existing use is maintained and protected. If applicable, describe the results of the antidegradation review, including the Engineering Alternatives Analysis (EAA) and any water quality modeling results: NA. 9. Antibacksliding Review: Sections 402(o)(2) and 303(d)(4) of the CWA and federal regulations at 40 CFR 122.44(1) prohibit backsliding of effluent limitations in NPDES permits. These provisions require effluent limitations in a reissued permit to be as stringent as those in the previous permit, with some exceptions where limitations may be relaxed (e.g., based on new information, increases in production may warrant less stringent TBEL limits, or WQBELs may be less stringent based on updated RPA or dilution). Are any effluent limitations less stringent than previous permit (YES/NO): No. If YES, confirm that antibacksliding provisions are not violated: NA. 10. Monitoring Requirements Page 5 of 6 Monitoring frequencies for NPDES permitting are established in accordance with the following regulations and guidance: 1) State Regulation for Surface Water Monitoring, 15A NCAC 2B.0500; 2) NPDES Guidance, Monitoring Frequency for Toxic Substances (7/15/2010 Memo); 3) NPDES Guidance, Reduced Monitoring Frequencies for Facilities with Superior Compliance (10/22/2012 Memo); 4) Best Professional Judgement (BPJ). Per US EPA (Interim Guidance, 1996), monitoring requirements are not considered effluent limitations under Section 402(o) of the Clean Water Act, and therefore anti - backsliding prohibitions would not be triggered by reductions in monitoring frequencies. For instream monitoring, refer to Section 4. 11. Electronic Reporting Requirements The US EPA NPDES Electronic Reporting Rule was finalized on December 21, 2015. Effective December 21, 2016, NPDES regulated facilities are required to submit Discharge Monitoring Reports (DMRs) electronically. Effective December 21, 2020, NPDES regulated facilities will be required to submit additional NPDES reports electronically. This permit contains the requirements for electronic reporting, consistent with Federal requirements. Currently, electronic reporting is not required for NCG510000. 12. (Magellan) in order to request permission to discharge treated groundwater from the groundwater remediation system at Magellan's Charlotte II Terminal (Terminal) to the NPDES outfall (Outfall 007) under a General Permit (Permit #NCG51000). Discharges through Outfall 007 were previously covered under NPDES permit #NC0005185 held by the Terminal, which covered discharges from both Outfall 006 (Terminal discharges) and Outfall 007 (remediation system discharges). Magellan is now seeking coverage for discharges from the remediation system through Outfall 007 under a separate NPDES permit from the Terminal discharge (Outfall 006). To date, no treated groundwater from the groundwater remediation system has been discharged through Outfall 007 and all treated groundwater has been containerized and transported off -site for disposal. The Terminal is located at 7924 Mount Holly Road and the groundwater remediation system equipment building is located on the adjoining property at 8026 Mount Holly Road in Charlotte, Mecklenberg County, North Carolina. The proposed remediation system discharge will discharge to the existing Outfall 007 location via a dedicated pipe. A facility location map is attached as Figure 1. A map showing details of Outfall 007 and the receiving water body is attached as Figure 2. Remediation System Description: Magellan is currently operating an air sparge/soil vapor extraction (AS/SVE) system to remediate shallow soil and groundwater from historic petroleum releases at the Terminal. The remediation effort is regulated by the North Carolina Department of Environment and Natural Resources (NCDENR). The SVE system uses blowers to extract soil vapor and some liquids from below the ground surface. The liquids (consisting of groundwater and soil vapor moisture condensate) will have dissolved petroleum compounds typically present in gasoline and diesel. The current system consists of a high vacuum blower to remove vapor and liquid from extraction wells, a knockout drum to separate liquids from vapor, and a groundwater treatment system to treat recovered groundwater with an oil/water separator and two carbon vessels. Because of this variability, an estimated average design -flow rate would be approximately 0.2 gallons per minute (gpm), which includes instantaneous batch discharges of approximately 20 gpm, and an estimated annual discharge of 109,500 gallons per year. Technologically Feasible Alternatives Analysis: The following alternatives have been evaluated: • Connection to an existing wastewater treatment plant — A request to connect to the Charlotte -Mecklenburg publicly owned treatment works (POTW) was submitted on February 11, 2014. The Charlotte -Mecklenburg POTW is not currently accepting connections and the request was denied; therefore this alternative is infeasible and as a result, a Present Value Cost Analysis was not completed. Correspondence with the Charlotte -Mecklenburg POTW stating that they are not accepting connections from groundwater treatment systems is included as Attachment A. • Land application/spray irrigation — The hydraulic loading rate and the total area of land needed for land application were calculated. Based on the calculations approximately 950 square feet of land is needed for irrigation. The properties surrounding the Terminal are all developed as either industrial or residential properties. The amount of undeveloped land needed for irrigation is not available; therefore, land application is 2 infeasible and as a result, a Present Value Cost Analysis was not completed. Land application calculations are provided in Attachment B. • Infiltration galleries — infiltration galleries were previously discussed in 2014/2015 as a potential alternative with the NCDENR and would be an acceptable alternative. A Present Value Cost Analysis is included in the next section. • In -situ groundwater remediation wells — The current remediation system utilizes air sparge (AS) technology as an in -situ groundwater remediation technology. Soil vapor extraction (SVE) and catalytic oxidation systems are used in conjunction with the AS system to capture and treat fugitive volatile organic carbon (VOC) emissions generated by the AS system. Occasionally moisture condensate and groundwater build-up or infiltrate the SVE system — and it is for this water that the NPDES general permit coverage is being requested. Other forms of in -situ treatments, such as in -situ chemical oxidation (ISCO) and thermal treatments are not recommended due to potential risks to buried infrastructure such as pipelines. • Closed -loop groundwater remediation wells — closed -loop (or injection) wells are an acceptable alternative. A Present Value Cost Analysis is included in the next section. Economic Feasibility of Alternatives: An economic feasibility evaluation of technologically feasible alternatives was conducted and included discharge to a NPDES outfall, infiltration galleries and injection wells. If approved, Magellan would provide and install (via an approved contractor) a 4 to 6-inch HDPE underground discharge pipe from the water treatment system to the sanitary sewer location. The water treatment system would be set in a secured location adjacent to the Magellan Terminal. Access to the system will be limited to Magellan personnel and Magellan -approved contractors. However the information mentioned below in your email along with analytical data prior to treatment would be sufficient for your request letter. We're very interested in the concentration levels of all contaminants in the untreated groundwater. Also we will usually include the list of pollutants of concern found in our Sewer Use Ordinance(SUO) Section 23- 79. The SUO may be found at the following link http://library.municode.com/index.aspx?clientld=19970. The main concern I have is the distance from the sewer line and the need to tap into it. I checked with our Customer Service Division and the sewer line is there but at least the 700 feet maybe more. A map showing the exact location of the remediation site to the roads and sewer line would be very helpful also. Have you investigated the possibility of a NPDES permit through NCDENR? I understand that a letter would need to be sent to you requesting discharge to the sanitary sewer and that approval is not guaranteed, depending on site location and other factors. Here is some preliminary information. The groundwater remediation system is located at the Magellan Charlotte Terminal at 8206 Mount Holly Road in Charlotte. The discharge rate would be approximately 5 gpm or batches at 20 gpm up to a maximum of 1 million gallons per year. A preliminary sewer system check showed the sewer system in the area ends at Hugh Caldwell Road which is approximately 700 feet west of the remediation system. All the above information would be included in the letter including site location, remediation system information, flow rates, and treated groundwater analytical results.
