Instream Data Summary Instream monitoring may be required in certain situations, for example: 1) to verify model predictions when model results for instream DO are within 1 mg/l of instream standard at full permitted flow; 2) to verify model predictions for outfall diffuser; 3) to provide data for future TMDL; 4) based on other instream concerns. This report is being issued as a Notice of Violation (NOV) due to the following: • A new ORC was not designated within 120 days following the departure/ invalidation of the previously designated ORC; • No weekly visitations were performed by the only designated operator ( Backup ORC) during five weeks: • The Backup ORC visitations exceeded 40% of the required visitations over a calendar year (2020). The permitttee response was received January 21, 2021. See D_NC0046531_NOV-2020-PC- 0544_20210121_response_8p 6. Water Quality-Based Effluent Limitations (WQBELs) Dilution and Mixing Zones In accordance with 15A NCAC 2B.0206, the following streamflows are used for dilution considerations for development of WQBELs: 1Q10 streamflow (acute Aquatic Life); 7Q10 streamflow (chronic Aquatic Life; non-carcinogen HH); 30Q2 streamflow (aesthetics); annual average flow (carcinogen, HH). If applicable, describe any other dilution factors considered (e.g., based on CORMIX model results): NA. If applicable, describe any mixing zones established in accordance with 15A NCAC 2B.0204(b): NA. Page 4 of 9 Oxygen-Consuming Waste Limitations Limitations for oxygen-consuming waste (e.g., BOD) are generally based on water quality modeling to ensure protection of the instream dissolved oxygen (DO) water quality standard. Secondary TBEL limits (e.g., BOD= 30 mg/l for Municipals) may be appropriate if deemed more stringent based on dilution and model results. If permit limits are more stringent than TBELs, describe how limits were developed: NA. Ammonia and Total Residual Chlorine Limitations Limitations for ammonia are based on protection of aquatic life utilizing an ammonia chronic criterion of 1.0 mg/l (summer) and 1.8 mg/l (winter). Acute ammonia limits are derived from chronic criteria, utilizing a multiplication factor of 3 for Municipals and a multiplication factor of 5 for Non-Municipals. Limitations for Total Residual Chlorine (TRC) are based on the NC water quality standard for protection of aquatic life (17 ug/l) and capped at 28 ug/l (acute impacts). Due to analytical issues, all TRC values reported below 50 ug/l are considered compliant with their permit limit. Describe any proposed changes to ammonia and/or TRC limits for this permit renewal: NA. Reasonable Potential Analysis (RPA) for Toxicants If applicable, conduct RPA analysis and complete information below. The need for toxicant limits is based upon a demonstration of reasonable potential to exceed water quality standards, a statistical evaluation that is conducted during every permit renewal utilizing the most recent effluent data for each outfall. The RPA is conducted in accordance with 40 CFR 122.44 (d) (i). The NC RPA procedure utilizes the following: 1) 95% Confidence Level/95% Probability; 2) assumption of zero background; 3) use of ½ detection limit for “less than” values; and 4) streamflows used for dilution consideration based on 15A NCAC 2B.0206. Effective April 6, 2016, NC began implementation of dissolved metals criteria in the RPA process in accordance with guidance titled NPDES Implementation of Instream Dissolved Metals Standards, dated June 10, 2016. A reasonable potential analysis was conducted on effluent toxicant data collected between Jul2016 and Aug2020 for Outfall 001. Pollutants of concern included toxicants with positive detections and associated water quality standards/criteria. Based on this analysis, the following permitting actions are proposed for this permit: • There was no detection for the following parameters for Outfall 001: Toluene, Benzene, Ethylbenzene, Xylenes Mixture, Methyl Tert-Butyl Ether (MTBE), Phenolic Compounds, and Naphthalene. No changes to monitoring for these parameters are recommended because they are parameters of concern for bulk-storage of petroleum products. If applicable, attach a spreadsheet of the RPA results [See Attachment E_NC0046531 OUTFALL 001 RPA 2020_6p] as well as a copy of the Dissolved Metals Implementation Fact Sheet for freshwater/saltwater [Not Applicable] to this Fact Sheet. Include a printout of the RPA Dissolved to Total Metal Calculator sheet if this is a Municipality with a Pretreatment Program. Toxicity Testing Limitations Permit limits and monitoring requirements for Whole Effluent Toxicity (WET) have been established in accordance with Division guidance (per WET Memo, 8/2/1999). Per WET guidance, all NPDES permits Page 5 of 9 issued to Major facilities or any facility discharging “complex” wastewater (contains anything other than domestic waste) will contain appropriate WET limits and monitoring requirements, with several exceptions. The State has received prior EPA approval to use an Alternative WET Test Procedure in NPDES permits, using single concentration screening tests, with multiple dilution follow-up upon a test failure. Describe proposed toxicity test requirement: No changes for renewal. Acute Toxicity [TAE6C] Fathead Minnow (Pimephales promelas), 24-hr definitive, LC-50 >100%, Annual [see A. (3.)]. Mercury Statewide TMDL Evaluation There is a statewide TMDL for mercury approved by EPA in 2012. The TMDL target was to comply with EPA’s mercury fish tissue criteria (0.3 mg/kg) for human health protection. The TMDL established a wasteload allocation for point sources of 37 kg/year (81 lb/year), and is applicable to municipals and industrial facilities with known mercury discharges. Given the small contribution of mercury from point sources (~2% of total load), the TMDL emphasizes mercury minimization plans (MMPs) for point source control. Municipal facilities > 2 MGD and discharging quantifiable levels of mercury (>1 ng/l) will receive an MMP requirement. Industrials are evaluated on a case-by-case basis, depending if mercury is a pollutant of concern. Effluent limits may also be added if annual average effluent concentrations exceed the WQBEL value (based on the NC WQS of 12 ng/l) and/or if any individual value exceeds a TBEL value of 47 ng/l Describe proposed permit actions based on mercury evaluation: NA. Other TMDL/Nutrient Management Strategy Considerations If applicable, describe any other TMDLs/Nutrient Management Strategies and their implementation within this permit: Lake Wylie has TMDLs for Total Phosphorus and Total Nitrogen. Nutrients are not a concern for Bulk-Storage Oil Terminals. Other WQBEL Considerations If applicable, describe any other parameters of concern evaluated for WQBELs: NA. Antidegradation Review (New/Expanding Discharge): The objective of an antidegradation review is to ensure that a new or increased pollutant loading will not degrade water quality. Permitting actions for new or expanding discharges require an antidegradation review in accordance with 15A NCAC 2B.0201. Each applicant for a new/expanding NPDES permit must document an effort to consider non-discharge alternatives per 15A NCAC 2H.0105( c)(2). In all cases, existing instream water uses and the level of water quality necessary to protect the existing use is maintained and protected. If applicable, describe the results of the antidegradation review, including the Engineering Alternatives Analysis (EAA) and any water quality modeling results: NA. 9. Antibacksliding Review: Sections 402(o)(2) and 303(d)(4) of the CWA and federal regulations at 40 CFR 122.44(l) prohibit backsliding of effluent limitations in NPDES permits. These provisions require effluent limitations in a reissued permit to be as stringent as those in the previous permit, with some exceptions where limitations may be relaxed (e.g., based on new information, increases in production may warrant less stringent TBEL limits, or WQBELs may be less stringent based on updated RPA or dilution). Are any effluent limitations less stringent than previous permit (YES/NO): Yes. If YES, confirm that antibacksliding provisions are not violated: Antibacksliding provisions were not violated. Limits for the following parameters will be removed for this renewal, since they did not demonstrate reasonable potential to exceed applicable water quality standards/criteria and DMR data indicated no detection: Total Recoverable Phenolics, Benzene, and Toluene. Please see RPA in Section 6 of this fact sheet for discussion of relaxation of limits. 10. Monitoring Requirements Monitoring frequencies for NPDES permitting are established in accordance with the following regulations and guidance: 1) State Regulation for Surface Water Monitoring, 15A NCAC 2B.0500; 2) NPDES Guidance, Monitoring Frequency for Toxic Substances (7/15/2010 Memo); 3) NPDES Guidance, Reduced Monitoring Frequencies for Facilities with Superior Compliance (10/22/2012 Memo); 4) Best Professional Judgement (BPJ). Per US EPA (Interim Guidance, 1996), monitoring requirements are not considered effluent limitations under Section 402(o) of the Clean Water Act, and therefore anti- backsliding prohibitions would not be triggered by reductions in monitoring frequencies. For instream monitoring, refer to Section 4. Page 7 of 9 11. Electronic Reporting Requirements The US EPA NPDES Electronic Reporting Rule was finalized on December 21, 2015. Effective December 21, 2016, NPDES regulated facilities are required to submit Discharge Monitoring Reports (DMRs) electronically. Effective December 21, 2020, NPDES regulated facilities will be required to submit additional NPDES reports electronically. This permit contains the requirements for electronic reporting, consistent with Federal requirements. 12. Summary of Proposed Permitting Actions: A. Table. The draft permit includes the following significant changes from the existing permit: 1. The facility classification Grade I Physical Chemical Water Pollution Control System (WPCS) was added to the effluent page. 2. Limits for the following parameters will be removed for this renewal, since they did not demonstrate reasonable potential to exceed applicable water quality standards/criteria and DMR data indicated no detection: Total Recoverable Phenolics, Benzene, and Toluene. 3. Since Gum Branch is not currently listed on the 2018 303(d) List as impaired for Turbidity, the limit and footnote for this parameter has been removed. 4. A footnote for Oil & Grease was added describing sampling and EPA method 1664 (SGT-HEM). 5. Concurrent sampling for BTEX and Acute Toxicity is no longer required by the Division. The footnote referring to this requirement was removed. 6. The application indicated storage of Ethanol. Therefore, quarterly monitoring for the this parameter has been added. Page 9 of 9 7. Flow may be monitored using any one of four m ethods : a) measure flow continuously (via flow meter, totalizer preferred); b) calculate flow (see Rational Equation) based on total rainfall per unit area draining to the outfall [see A. (3.)]; c) estimate flow at 20-minute intervals during the entire discharge event; or d) report flow based on discharge pump logs . 3. This sample to be collected concurrently with annual Acute Toxicity. 4. Turbidity -Effluent shall not cause receiving stream turbidity to exceed 50 NTU. If receiving-stream background exceeds 50 NTU, the effluent shall not increase background levels . Non-compliance with this Standard may require additional stream monitoring and a Turbidity Corrective Action Plan (TCAP). 5. Naphthalene -Provided that the Permittee can demonstrate to the Division that its facility does not now, nor has ever, stored diesel fuel or other heavy fuels onsite, it may petition to remove this requirement from the permit. EPA Method 625-Once the facility has collected data for 12 consecutive sample events in which there have been no detections above the method detection limit, the Permittee may request DWR to modify this permit. 7. Acute Toxicity [TAE6C] Fathead Minnow (Pimephales promelas), 24-hr definitive , LC-50 > 100%, Annual [see A. (2.)]. Conditions: • The P ermittee shall discharge no floating solids or foam visible in other than trace amounts. • The P ermittee shall discharge no tank solids , tank bottom water, or the rag lay er. • Following hydrostatic testing, the Permittee shall discharge no tank ( or pipe) contents unless benzene concentration test less than 1.19 µg/L and toluene concentration test less than 11 µg/L. ACUTE TOXICITY MONITORING (ANNUAL) [15A NCAC 02B .0500 et seq.] The permittee shall conduct acute toxicity tests on an annual basis using protocols defined as definitive in EPA Document EPA-821-R-02-012 entitled "Methods for Measuring the Acute Toxicity of Effluents and Receiving Waters to Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24 hour static test. Effluent samples for self-monitoring purposes must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all waste treatment processes. The parameter code for Pimephales promelas is TAE6C. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Additionally, DWR Form AT-1 (original) is to be sent to the following address: Attention: North Carolina Division of Water Resources Water Sciences Section/Aquatic Toxicology Branch 1623 Mail Service Center Raleigh, North Carolina 27699-1623 Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30 days after the end of the reporting period for which the report is made . Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests , as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re- opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A = area of tributary watershed ( acres or km2) The rational equation is used to calculate the runoff from a region, given: • the runoff coefficient (accounts for infiltration losses in the region), • the rainfall intensity to the region, • the time for runoff to travel from the region's upper reaches to its outlet, and • the region's drainage area. A. (4.) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS [G.S. 143-215.l(b)] Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program reports. The final NPDES Electronic Reporting Rule was adopted and became effective on December 21, 2015. NOTE: This special condition supplements or supersedes the following sections within Part II of this permit (Standard Conditions for NPDES Permits): • Section B. (11.) (a)] The permittee shall report discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report ( eDMR) internet application. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA 's Cross-Media Electronic Reporting Regulation (CROMERR), permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NC DENR I Division of Water Resources / Water Quality Permitting Section ATTENTION: Central Files 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the mailing address above . See "How to Request a Waiver from Electronic Reporting" section below. Regardless of the submission method, the first DMR is due on the last day of the month following the issuance of the permit or in the case of a new facility, on the last day of the month following the commencement of discharge. Starting on December 21, 2020, the permittee must electronically report the following compliance monitoring data and reports , when applicable : • Sewer Overflow/Bypass Event Reports ; • Pretreatment Program Annual Reports; and • Clean Water Act (CWA) Section 316(b) Annual Reports. The permittee may seek an electronic reporting waiver from the Division (see "How to Request a Waiver from Electronic Reporting" section below). 2. Electronic Submissions In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient at the time of each electronic submission. The permittee should use the EPA' s website resources to identify the initial recipient for the electronic submission. Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity for receiving electronic NPDES data [see 40 CFR 127.2(b)]. EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each type of electronic submission and for each state. Instructions on how to access and use the appropriate electronic reporting tool will be available as well. The duration of a temporary waiver sh all not exceed 5 years and shall thereupon expire. At s uc h time , monitoring data and reports shall be submitted electronically to the Division unless the permittee re-appl ies for and is granted a new temporary electronic i-eporting waiver by the Di v ision. Approved electronic reporting waivers are not transferrable. Only pennittees with an approved reportin g waiver request may submit monitoring data and reports on paper to the Division for the period that the approved reporting waiver request is effectjve. Prior to October 1, 2020, Lincoln was the sole owner and operator of the Charlotte Terminal; not until after October 1, 2020 did CTOC own and operate the Charlotte Terminal. As indicated in the supplemental materials that the NC-DEQ provided with the NOV, the underlying basis for the alleged violations in the NOV stem from events and circumstances occurring in late 2019 and early 2020 (prior to October 1, 2020) while the Charlotte Terminal was owned and operated by Lincoln. We believe this information may provide additional insight for the NC- DEQ and provide context for CTOC's below -described responses to the alleged violations. Notice of Violation Response Tracking No. NOV-2020-PC-0544 Page 2 CTOC's Responses to the NOV NOV Allegation No. 1: A new Operator in Responsible Charge ("ORC") was not designated within 120 days following the departure/invalidation of the previous ORC. CTOC Response: Based on information obtained by CTOC and provided by Lincoln, the previous ORC terminated his employment with Lincoln on December 31, 2019. The backup ORC at the time, who was a contracted and licensed Physical/Chemical ("PC") wastewater operator, took over the ORC duties. Another Lincoln employee pursued obtaining the PC wastewater license so that he could be listed as a backup operator per the permit requirements. The Lincoln employee was unable to get a passing grade on the exam on the first attempt. As previously explained, CTOC has recently purchased the Charlotte Terminal from Lincoln, thereby employing several of the operators and personnel who worked at the Charlotte Terminal during Lincoln's ownership and operation of the facility; this includes CTOC now employing the individual who earlier attempted to obtain the PC licensing. The employee plans to re -take the exam at the earliest opportunity. Enclosed with this response letter, an updated/current ORC designation form designating an ORC and Backup ORC is attached. A copy of the ORC form will also be submitted to the Water Pollution Control System Operators Certification Commission. NOV Allegation No. 2: No weekly visitations were performed by the only designated operator during five weeks. CTOC Response: Based on information obtained by CTOC and provided by Lincoln, the contracted Backup ORC (acting ORC) was not available those weeks. The system was inspected and documented by a co-worker of the Backup ORC. The co-worker was a certified wastewater operator. However, the co-worker did not have the proper PC license required for that specific system and was not listed as a backup ORC for this permit. NOV Allegation No. 3: The Backup ORC visitations exceeded 40% of the required visitations over a calendar year (2020). CTOC Response: Based on information obtained by CTOC and provided by Lincoln, the listed backup ORC was the acting lead ORC. The listed lead ORC terminated his employment with Lincoln and left the company in 2019. Since the Backup ORC was never officially designated as the lead ORC, the Backup ORC was the only ORC used in 2020.
