8. PROJECT SUMMARY: The applicant proposes to extend an existing dock/walkway
around the end of a canal and construct a walkway with an elevated viewing platform
through coastal wetlands to access an existing pond.
Project Setting
The applicant's property is located at the end of Bob Perry Road (SR1210) in the Town of Kitty
Hawk, Dare County. The property consists of approximately 141 acres and is primarily Coastal
Wetlands. It appears that the high ground areas on the property were created from dredge fill
that was placed on the site through the years. Aerial photography and archive photography
indicate that the fill was placed on the property prior to the Coastal Area Management Act.
Alvis Beacham owned and operated a barge landing at the site for a number of years with his
sons. His sons owned and operated Outer Banks Contractor from the site. In 1999, Mr.
Beacham sold the property to Earth Resources, a company owned and operated by his son,
Tim Beacham. Tim Beacham has continued to operate the barge landing, but has added a
ships store to the property along with a fueling dock, gravel parking areas, boat ramp, an
elevated walkway through wetlands and a platform /kayak launch area. - ,
The following Division of Coastal Management permits have been issued for development on
the property:
1990: CAMA Major Permit #137 -90 was issued to Alvis Beacham to dredge Loving Canal.
1994: The permit was renewed.
1999: The permit was transferred, and renewed, in the name of Earth Resource, Inc.
2004: The permit was refined to allow minor maintenance dredging.
2000: CAMA Major Permit #62 -00 was issued to Earth Resources, Inc. to construct the
current marina store, fuel tanks and docks.
2004: CAMA Major Permit #32 -04 was issued to Earth Resources, Inc. to construct an
elevated walkway through coastal wetlands to a platform with an observation tower
and a floating dock, a gravel parking area within a highground area, an elevated
walkway with an observation platform through coastal wetlands to an existing pond
(not constructed), and an elevated pedestrian bridge across a canal to a highground
hummock (not constructed).
The property has miles of meandering shoreline along Kitty Hawk Bay and there are three
canals entering the property: 1) Jean Guite (Referenced by the Town as High Bridge Creek), 2)
Loving Canal, and 3) Newfoundland Gut. The entire east side of Loving Canal has been
hardened through bulkheading and riprap and is the location of the barge landing area, the
Dock of the Bay Marina and ±210' of docking. The shoreline around the terminal end of Loving
Canal is natural for ±180' and is vegetated with coastal and non - coastal wetland species. It
then transitions to riprap and bulkheading for ±390' on the west side of the canal across from
the marina store. A boat ramp is located on the north side of this hardened section and a
boardwalk and gravel parking area is located on the landward side of the bulkhead. The
remaining shoreline along the applicant's property is natural with a Coastal Wetland fringe that
varies in widths from 50 feet to several hundreds of feet. Coastal Wetland vegetation includes

salt meadow cord grass (Spartina patens), bulrush (Scirpus spp.), big cord grass (Spartina
cynosuroides), and black needle rush (Juncus roemerianus). Other vegetation found on the
high ground hummocks includes, but is not limited to, common reed (Phragmites australis), live
oak (Quercus virginiana), loblolly pine (Pinus taeda), red cedar (Juniperus virginiana), poison
ivy (Rhus toxicodendron), wax myrtle (Myrica cerifera), and false willow
(Baccharis angustifolia). Adjacent uses in the area are residential and are located within areas
of considerable Coastal and non - coastal wetlands.
Water depths within Loving Canal at the project site range from ±1.5' to 7' below normal water
level (NWL) and the bottom substrate is made up of fine silts. Kitty Hawk Bay is classified as
joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource
Commission. The Division of Environmental Management's water quality classification for Kitty
Hawk Bay is SC and it is closed to shellfish taking. Additional review indicates that there are no
known unique geological formations associated with the applicant's property. There is an
identified archeological site within a mile of the site, referenced as DR17, but not within in the
immediate vicinity of the applicant's property.
Development Proposal
The applicant is proposing to provide public access for fishing and crabbing as well as
providing access from the east side of the canal to the west side through the construction of a
260'x6' dock /walkway at the end of Loving Canal. The proposed dock/walkway will extend from
the existing dock on the eastern side of the canal and follow the shoreline contour to the
existing bulkhead and boardwalk on the western side of the canal. Approximately 94' of this
structure will be waterward of NWL along the bulkhead and the remaining ±166' will be
constructed landward of NWL elevated over coastal wetlands. According to the applicant,
additional slips are not part of this proposal.
The applicant also proposes to construct a 300'x6' elevated walkway through coastal wetlands
to access an existing pond. The walkway will extend from a highground area to the pond
shoreline where a 10'x5' stairway and 6'x6' viewing platform will be constructed over wetlands.
This walkway and viewing platform was previously authorized through CAMA Major Permit #32-
04; however, it was not constructed prior to permit expiration.
Anticipated Impacts
• The project as proposed will result in the shading of ±564 sf of PTA and EW AEC's.
• The project as proposed will result in the shading of ±996 sf of overlapping ES and CW
AEC's.
• The project as proposed will result in the shading of ±1,886 sf of CW AEC.
• Temporary localized disturbance in adjacent coastal wetlands and water will occur during
construction.

The purpose of the following proposed improvements is to allow public access to an
existing canal for fishing and crabbing as well as access to an existing unnamed pond to
allow the public to observe birds and wildlife that habitat the 141 acre parcel and Kitty
Hawk area. The intention of the owner's proposed improvements is to create a balance
with the commercial site, allowing the public to enjoy the wildlife and resources within
the commercial area and public waterways.
Proposed improvements include: (1) Construction of a 6'x 260' dock at the end of an
existing canal adjacent to the "Dock of the Bay ". The dock will be extension of the
existing dock on the east side of the canal and extend 94' adjacent to the existing
bulkhead. The remaining 166' will be constructed over the coastal wetlands around the
end of the canal to the existing boat ramp. (2) Construction of a 6' x 300' elevated
walkway to and existing pond and construction of an elevated 6' x 6' wildlife viewing
platform at the edge of the pond over the coastal wetlands.
Purpose of the proposed improvements: Construction of access walkway around the
end of the existing canal will provide additional locations for crabbing and fishing as well
as provide access to other side of the canal. Construction of elevated walkway will allow
access through coastal wetlands to allow the public to observe wildlife from the viewing
platform.
