On -Site Determination for Applicability to the Neuse River Riparian Area
Protection Rules (15A NCAC 2B.0233)
Dear Mr. Moose:
At your request this Office conducted an on -site determination to review drainage
features located within Area D for applicability to the Neuse River Buffer Rules (15A
NCAC 2B .0233). The features are labeled on the attached maps, highlighted in red and
blue, and initialed by me on May 20, 2013.
The Division of Water Quality (DWQ) has determined that the surface waters
labeled as "AZ -01 through GY -01" (see Enclosed Stream Origin Determination
List) on the attached maps and highlighted in red are not subject to the Neuse Buffer
Rule. The streams highlighted in blue are subject to the Neuse Buffer Rules (AZ -01,
GW -01a, IK -01, IL -01, IL -02, IP -01, ZD -02, ZF -01, ZT -01). Initial stream origin
points were set by staff of Geo -Marine and conformation of these stream origin points,
for applicability to the Neuse River Riparian Buffer Rules, was performed by DWQ staff.
Please be advised that although the subject features highlighted in red are not subject to
the Neuse Buffer Rules these features may be considered waters of the U.S. and/or waters
of the State and activities there within may require Nationwide Permits from the US
Army Corp of Engineers and General Certifications from the State of North Carolina. It

Washington Field Office, (910- 251 -4629) and Roberto Scheller with the Division of
Water Quality, Washington Regional Office (252- 948 - 3940), should be contacted if any
construction within these areas is proposed.
The owner (or future owners) should notify the DWQ (and other relevant agencies) of
this decision in any future correspondences concerning this property. This on -site
determination shall expire five (5) years from the date of this letter. Landowners or
affected parties that dispute a determination made by the DWQ or Delegated Local
Authority that a surface water exists and that it is subject to the buffer rule may request a
determination by the Director. A request for a determination by the Director shall be
referred to the Director in writing c/o Karen Higgins, 1650 Mail Service Center Raleigh,
NC 27699 -1650. Individuals that dispute a determination by the DWQ or Delegated
Local Authority that "exempts" a surface water from the buffer rule may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter.
Applicants are hereby notified that the 60 -day statutory appeal time does not start until
the affected party (including downstream and adjacent landowners) is notified of this
decision. DWQ recommends that the applicant conduct this notification in order to be
certain that third party appeals are made in a timely manner. To ask for a hearing, send a
written petition, which conforms to Chapter 150B of the North Carolina General Statutes
to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C.
27699 -6714. This determination is final and binding unless you ask for a hearing within
60 days.
This letter only addresses the applicability to the buffer rules and does not approve any
activity within the buffers. Nor does this letter approve any activity within Waters of the
United States or Waters of the State. If you have any additional questions or require
additional information please call Roberto Scheller in the Washington Regional Office at
252- 948 -3940.

Project Description
GMI was contracted by Naval Facilities Engineering Command (NAVFAC) Washington, to
conduct a wetland delineation and stream origin identification at Marine Corps Air Station
(MCAS) Cherry Point in project areas identified by MCAS Cherry Point. The site is located off
US Route 70 and Highway 101 in the town of Havelock, NC. GMI has four project areas at
MCAS Cherry Point: Area A (2,470 acre), Area B (1,597 acre), Area C (1,840 acre) and Area D
(1,434 acre), with a total acreage of 7,341 (Figure 1). As of May 29th, 2012, NCDWQ has
identified 6 perennial stream and 3 intermittent stream origins that are subject to the Neuse River
buffer rules in Project Area D (Figures 2 through 12 and the NCPLS Origins Table). USACE has
verified 37 additional WoUS features that are not subject to the Neuse River buffer rules in
Project Area D (Figures 2 through 10 and the NCPLS Origins Table).
Stream Origin Determination Methodology
Origins of intermittent and perennial streams were located using the Methodology for
Identification of Intermittent and Perennial Streams and Their Origins, North Carolina Division
of Water Quality ( NCDWQ 2010). NCDWQ and GMI staff conducted stream origin
determinations in Project Area D on May 29th 2012. All of the GMI identified USACE
jurisdictional features (WoUS) verified by the USACE Washington Field Office were re- visited
by NCDWQ and GML NCDWQ determined stream origins for the Neuse River buffer subject
features, as well as, verified the non - subject status of the additional USACE WoUS features in
Project Area D.
All subject stream origins and non - subject WoUS origins were NCPLS surveyed after
verification by NCDWQ and USACE. The NCPLS Origins Table provides origin
determinations of the Neuse River buffer subject and non - subject features in GMI Cherry Point
Project Area C for planning and permitting purposes and are valid for five years from the date of
NCDWQ signature.

I, John A. Rudolph, certify that these NCDWQ Stream Origin Coordinates were compiled under
my direct supervision from an actual survey made under my direct supervision; that the
regulated area is located upon Federal land within MCAS Cherry Point; that the purpose of this
coordinate sheet is to delineate the origins of streams and does not conform to NCGS 47 -30;
that stream origin flags are per USACE standards dated May 10, 2013 and established with
conventional and GNSS surveying methods; that the GNSS survey methods were performed by a
Topcon Hyper -lite Plus RTK System and Thales Navigation Promark II Static Receivers; all stream
origin locations as flagged by Geo- Marine, Inc. wetland scientists; all verified flag locations were
found to meet or exceed sub -meter accuracy standard with 95% confidence per Geospatial
Positioning Accuracy Standards Part 3, National Standard for Spatial Data Accuracy. (FGDC -STD-
007.3 -1998)
