Please see our proposal for dealing with the SAV survey for the proposed breakwater areas, at the end of our response letter. The applicant would like to be able to move forward with the docking facility as soon as possible, and proposes to conduct the SAV survey for the breakwater areas prior to their construction, adjusting the alignments as DCM may consider necessary to avoid /minimize impacts to SAV, this to be done with a condition to the Permit that agreement on alignments must be obtained prior to being able to construct the breakwater alignments — much as is done with DCM staking bulkhead alignments prior to construction. Not sure what your remaining concerns are over soft bottom impacts. What I took away from our meeting was that this would have to be avoided /minimized by addressing the location of alignments, and finding ways to reduce width of the breakwater bottom structure relative to slope of structure and locating alignment in shallowest water practicable. I felt I addressed this issue in considerable detail in our response letter. The NCDMF still has objections on this project due to the SAV and soft bottom impacts. Once the SAV survey is performed for the breakwater, the NCDMF can determine the final impacts from the project. Do you happen to know when you will be doing the survey? If my schedule permits I may take a trip to the site as well. If you have any questions please let me know. I spoke with Roberto Scheller today, and he indicated that DWQ is ready to issue a permit for the project once he knows that DMF will accept the SAV study previously done for the docking facility side of the project. He asked that I provide something in writing from DMF (he indicated an email would be acceptable) concerning this issue. I' was my understanding from our meeting that the previous SAV study would be acceptable to DMF, provided we withdrew the request for a breakwater to the south of the boatramp, and we provided an additional SAV study for the proposed breakwater alignment, which our response letter documented. If I am correct in this understanding that DMF is agreeable, it would be useful to have a statement to that effect as soon as possible so that DWQ can conclude their work on this project. Otherwise, I will need to provide DWQ a request for an extension, or face a total resubmittal of the project to DWQ. Many thanks for your continued attention to this matter. Printed copies are going into the mail today. I believe that I have captured the discussions that took place at that meeting, putting forward the means by which expressed concerns can be addressed to the mutual satisfaction of commenting agencies and Applicant. This is the first that both Roberto and Kevin have seen our response, so if they feel that I did not adequately address the issues, I will of course be available for further discussions.
