REF: Violation Intent to Assess Civil Penalty Tracking Number : NOV-2021-LV-0358
DEAR LON SNIDER,
I am writing to give you detailed information regarding the proposed penalty for Hilltop
Living Center Permit NC0059536.
During the sampling time in December 2020, R&A Labs was purchased by PACE Labs. My
operator took the sample early in the month on December 3rd . Once he received the
result, he called the lab and disputed the value because the values previous to this value
were in line. The operator felt and still feels the result was in error from the lab. The
new lab PACE did not provide the results in a reasonable timeframe and the operator
was not able to retest for verification within the month.
I am asking that you please reconsider the proposed penalty because of possible lab
error and the new lab's unreasonable result reporting timeframe. I have a new operator
and I have informed him of this issue.
