In regards to the Top of Dam and Start Pump indicators, it appears they are set properly for your operation. The bottom of the top cross bar is the same elevation of the lowest point of the dam (the overflow level). The top of the lower cross bar is the start pump level (the maximum liquid level). This point appears 18" below the low point in the top of the dam as it should and waste should not be allowed to rise above this point. The stop pump level is optional as this waste storage structure is designed as a waste holding pond only with no designed permanent liquid level. The following are explanations in response of what 1 have done to correct the violations. Violation #1: 1 will follow the 5 and 30 day action plan. The waste level is now in compliance with the plan. Violation #2: I will call the regional office within 24 hours of the high free board and prepare and submit within 5 days a Plan of Action for lowering the pond as described in the General Permit. Violation #3: The marker in the lagoon is now visible and 1 will follow the 5 and 30 day plan and to insure lagoon levels remain incompliance. Violation #4: 1 will call the regional office within 24 hours of first knowledge of the high free board and submit a 5 day POA for lowering the lagoon to an acceptable level.
