The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until the following information is received: 1. A part of the proposed entrance to the residential development follows Robey Drive from Gravely Branch Road. There appears to be a pre-existing stream crossing of Moore Lake stream along Robey Drive. Why can't the existing crossing of Moore Lake stream along Robey Drive be used and/or improved to provide access to the eastern side of the parcel? [15A NCAC 02H .0506(b)(1)] 2. Condition 11.11 of 401 General Water Quality Certification 4256 (GC4256), which corresponds to Nationwide Permit 29, requires openings such as culverts or bridges when roadways or other fill projects are constructed across wetlands to maintain the natural hydrology of the system. The access road for the subject project is proposed across wetland WA, potentially affecting the hydrology of the portion of wetland WA proposed to remain un-impacted. How will the referenced condition be met for the proposed roadway fill? [15A NCAC 02H .0506(b)] Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by June 28, 2021. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application and the appropriate fee. Feel free to contact me if you have any questions.
