We received you additional information request and have discussed with the project engineers. The responses to your
questions are below:
1. Access to the property, east of Moore Lake Stream, is extremely limited. The attached photo shows the access
area in question. The tree between the camera and the car is roughly the location where the property line
diverges from Robey Drive. There is a steep slope that almost abuts the streams left bank (facing downstream).
Geotechnical testing was done on the hillside and was found to be mostly solid rock. Creating an access road at
the location in question would require extensive grading into solid rock, if possible, disturbing a significant
amount of steep land. The proposed access road, as shown in the permit application, requires minimal
disturbance to the hillside.
2. Three 15"- diameter culverts have been added to the plan under the road fill prism to allow for hydrologic
connectivity of WA and allow passage of stormwater flows through the floodplain of SA. The location and cross
section detail is attached.

On May 24, 2021, the Division of Water Resources (Division) received your application requesting a 401 Water Quality
Certification from the Division for the subject project. The Division has determined that your application is incomplete
and cannot be processed. The application is on -hold until the following information is received:
1. A part of the proposed entrance to the residential development follows Robey Drive from Gravely Branch Road.
There appears to be a pre-existing stream crossing of Moore Lake stream along Robey Drive. Why can't the
existing crossing of Moore Lake stream along Robey Drive be used and/or improved to provide access to the
eastern side of the parcel? [15A NCAC 02H .0506(b)(1)]
2. Condition 11.11 of 401 General Water Quality Certification 4256 (GC4256), which corresponds to Nationwide
Permit 29, requires openings such as culverts or bridges when roadways or other fill projects are constructed
across wetlands to maintain the natural hydrology of the system. The access road for the subject project is
proposed across wetland WA, potentially affecting the hydrology of the portion of wetland WA proposed to
remain un-impacted. How will the referenced condition be met for the proposed roadway fill? [15A NCAC 02H
.0506(b)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by June 28, 2021. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application and
the appropriate fee.
