The Town of Mooresville is formally requesting a variance to the watershed regulations
on behalf of John Nivens. Enclosed please find a copy of the paperwork submitted by Mr.
Nivens for a development he is proposing in an area located in the Watershed IV
Catawba/Lake Norman Protected Area. Mr. Nivens is requesting a variance to the
watershed regulations by installing curb and gutter for the development(The Town of
Mooresville requires all new developments to have curb and gutter improvements) and he
will be utilizing a density of 2.75 units per acre. It is important to note that Mr. Nivens
will be implementing bioengineered channels and constructed wetlands as well as
providing substantial amounts of undisturbed land area.
The Board of Commissioners of the Town of Mooresville will hold a public hearing to
consider Mr. Nivens request on August 1, 1994. Any comments or suggestions you have
concerning this matter will need to be received prior to this hearing date. Should you

Bradley gave you all the good comments on the request, but just
add one more please .
If it eventually goes to variance we will need to see more
detail on the use of the BMPs that the developer is proposeing.
