REQUEST FOR TOWN BOARD ACTION

Subject: PUBLIC HEARING for consideration of a
Subdivision Ordinance Amendment concerning
amending Article 4: Water Supply Watershed
Regulations.
PUBLIC HEARING to consider a recommendation from the Mooresville
Planning Board for approval of Subdivision Ordinance Amendment concerning
Article 4: Water Supply Watershed Regulations. This includes Article 4:
Definitions of Terms Used in this Ordinance and Section 4.2: Definitions of Specific
Terms and Words.
The Planning Board recommended approval of the request at the
January 14, 1995 Planning Board Meeting.

PROPOSED TEXT CHANGES
MOORESVILLE SUBDIVISION ORDINANCE
OCTOBER 19, 1995
1. Make the following changes to Section 115, Other definitions:
A. Variance, Major
Eliminate existing text and replace with the following:
A variance from the Town's water supply watershed regulations that results in
the relaxation by a factor greater than five (5) percent of any buffer, density, or
built-upon requirement under the high density option; or any variation in the
design maintenance, or operation requirements of a wet detention pond or other
approved storm water management system; or relaxation by a factor greater than
ten (10) percent of any management requirement under the low density option.
B. Variance. Minor
Eliminate existing text and replace with the following:
A variance from the Town's water supply watershed regulations that result in a
relaxation by a factor of up to five (5) percent of any buffer, density, or built-
upon area requirement under the high density option; or that results in the
relaxation of up to ten (10) percent under the low density option.
C. Protected Area

The area adjoining and upstream of the critical area in a WS-IV water
supply in which protection measures are required. The boundaries of the
protected area are defined as within five miles
of the normal pool elevation of the reservoir and drainage to water supply
reservoirs...
D. Built-Upon Area
Add the following text to the Ordinance:

Built-Upon Area
Built-upon area shall include that portion of a development project that is
covered by impervious or partially impervious cover including buildings,
pavement, gravel area (e.g., roads, parking lots, paths) recreation facilities (e.g.,
tennis courts), etc. (NOTE: Wooden slatted decks and the water area of a
swimming pool are considered pervious.
E. Cluster Development
Eliminate existing text and replace with the following:
The grouping of buildings in order to conserve land resources and provide for
innovation in the design of the project including minimizing stormwater runoff
impacts. This term includes nonresidential development as well as single-family
residential subdivision and multi family developments.
F. Development. Existing
Eliminate text in Subsection (3) only as shown (remainder of text shall stay
the same):

approved site specific development plan as authorized by the
General Statutes (G.S. 160A-385.1).
G. Family Estate Subdivision
Add the following text to the Ordinance:
Family Estate Subdivision
Family subdivision means a division of a tract of land to divide land from a
common ancestor among tenants in common, all of whom inherited by intestacy
or by will.
2. Make the following changes to Section 409, Provisions for Subdivisions Located in
a Water Supply Watershed:
Add the following text:
Notwithstanding the above, Water Supply Watershed regulations shall not be applicable
in family estate subdivisions (as defined in Section 115).

3. Make the following changes to Section 409.3(A), Subdivision Standards and
Required Improvements, Density Limitations:
Delete the following text (struck out) and add text (shown in bold and italicized
type):
