Dear Representative Brawley:
The purpose of this letter is to request your assistance in
obtaining a clarification of the North Carolina watershed
protection program as it applies to an eight-acre commercial tract
which I own, located in Mooresville. A site-specific development
plan for this property was approved and vested by the Town of
Mooresville in May 1993, prior to the effective date of the
watershed protection restrictions . A copy of the approved plan is
attached.
A potential purchaser of this property proposes to make changes in
the plan with respect to the arrangement and configuration of some
of the buildings and parking areas; however, the percentage of the
property covered by impervious surface would not increase as a
result of the proposed changes .
Mr. Erskine smith, Planning Director and Zoning Administrator for
the Town of Mooresville, has advised me that such changes to the
plan would void its approval with respect to the the watershed
protection program, and would, in effect , require that we start
from scratch. This would require the submission of a new plan
using the high density option, losing the "grandfathering" which
currently applies to our plan.
My opinion regarding this situation is that so long as the
percentage of impervious area on the property is not being
increased, the intent and purpose of the watershed protection
program is being upheld, and that approval with respect to said
program should remain in effect .
I would be most appreciative if you could furnish me with the name
of someone in the Division of Environmental Management who could
provide me with a clarification of this issue. If I need to supply
you with additional information regarding this property and
situation, please advise me .
