Re: Water Supply Watershed Protection Ordinance; Town of Mooresville; Iredell County
Dear Mr. Smith:
The purpose of this letter is to inform you that the Division of Water Quality has reviewed
the amendments made to the Town of Mooresville's water sup sly watershed protection
regulations.
However,staff of the Division of Water Quality recommend the additional changes noted below.
These changes are not mandatory, but would make the Town's ordinance more consistent with the
1995 revisions to the statewide Rules.
1. Amend Section 14.3(D) to read as follows:
(D) If a nonconforming lot of record is not contiguous to any other lot owned by the same
party, then that lot of record shall not be subject to the development restrictions of this
ordinance if it is developed for single-family residential purposes.
2. Replace the word "sludge" with the word "residual" in Section 14.4.1(A) to read as
follows:
"...Non-discharging landfills and sludge residual application sites are allowed."
Other references to"sludge application sites"within the ordinance should also be modified.
3. Change the wording in Section 14.5.6 to the following:
"6. The area in the vegetated or natural state may shall be conveyed..."
4. Add or amend the following definitions:
a) Discharging Landfill. A landfill which discharges treated leachate and which
requires a National Pollution Discharge Elimination System (NPDES) permit.

Commission in March, 1994, it is still in compliance with the Water Supply Watershed Rules.

b) Nonconforming Lot of Record. A lot described by a plat or a deed that was
recorded prior to the effective date of this ordinance(or its amendments) that does
not meet the minimum lot size or other development requirements of this ordinance.
As previously stated, these recommendations are not mandatory. If you do not choose to
make the suggested amendments,please contact Amy Blizzard of my staff at (919) 733-5083 ext.
583. We will submit your amended ordinance to the Environmental Management Commission for
review at their next regularly scheduled meeting. If you do choose to amend your ordinance,please
submit the amended sections to the Division of Water Quality as soon as they are adopted by your
local board.
