Craig,
I've reviewed the details of the Highway 150 project. This project, as designed, is in
violation of buffer rules for high density development in a WS-IV. Mr. Sanchez is correct in
his interpretation of 15A NCAC 02B .0201 (f) in that the filling of the pond, a perennial
feature, may occur provided a 404 permit from USACE and 401 certification from DWQ is
secured. However, it does not exempt the project from complying with the buffer rules for the
perennial waters upstream and downstream of the filled reach.
Because this is a high density project, 100-foot vegetative buffers are required. What this
means is that there would need to be 100-foot buffers between the retaining walls and the
remaining pond areas upstream and downstream of the project. This would result in a large
decrease in buildable area on the property.
It seems the owners will have to redesign the project to comply or pursue a major variance to
the buffer requirements of the water supply watershed rules.

Craig,
Review of the Mooresville Land Development Process Manual indicates that a "sketch plan
approval box" is to be placed on the plans; do you have an example of what that is to look
like? It is not included in the Mooresville standard details. The manual's sketch plan
requirements also indicate that the proposed trip generation information for the
development be included with the submittal. Our proposed project includes about 7, 000 sf
of commercial/retail space, is a traffic study warranted for this site?
Please advise regarding the approval box and traffic study requirements. I have attached a

Subject: Hwy. 150 Commercial Site, Mooresville
Dear Mr. Nealy:
You have our approval, in accordance with the attached conditions and those listed below, to fill 0.49
acre of open water to develop the site in Iredell County, as described in your application received by the
Division of Water Quality (DWQ) on March 30, 2007. After reviewing your application, we have determined
that this project is covered by Water Quality General Certification Number 3631, which can be viewed on our
web site at http://h2o.enr.state.nc.us/ncwetlands. The General Certification allows you to use Nationwide
Permit Number 39 once it is issued to you by the U.S. Army Corps of Engineers. Please note that you should
get any other federal, state or local permits before proceeding with your project, including those required by
(but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations.
The above noted Certification will expire when the associated 404 permit expires unless otherwise
specified in the General Certification. This approval is only valid for the purpose and design that you described
in your application. If you change your project, you must notify us in writing, and you may be required to send
us a new application for a new certification. If the property is sold, the new owner must be given a copy of the
Certification and approval letter; and is thereby responsible for complying with all conditions.
In addition to the requirements of the certification, you must also comply with the following conditions:
1. The Mooresville Regional Office shall be notified in writing once construction at the approved impact areas
has commenced.
2. The work shall be conducted "in the dry".
3. Storm water discharge structures at this site shall be constructed in a manner such that the potential
receiving streams (of the discharge) will not be impacted due to sediment accumulations, scouring or erosion
of the stream banks.
4. A final, written storm water management plan (including a signed and notarized Operation and
Maintenance Agreement) shall be submitted to the 401 Oversight and Express Permitting Unit (2321
Crabtree Blvd., Suite 250, Raleigh, NC, 27604)within 60 days of the issuance of the 401 Water Quality
Certification. The storm water management plans shall be approved in writing by the central office before
the impacts specified in this Certification occur. You have the option of using the Express Review Program
for expedited approval of these plans. If you propose to use the Express Review Program, remember to
include the appropriate fee with the plan. The storm water management plan must include construction
plans, specifications, storm water BMP worksheets, and supporting calculations. Nat�raolina

The storm water best management practices are required to be appropriate for the surface water
classification and designed to remove at least 85% TSS according to the most recent version of the NC
DENR Storm water Best Management Practices Manual. These facilities must be designed to treat the
runoff from the entire project, unless otherwise explicitly approved by the Division of Water Quality. Also,
before any permanent building is occupied at the subject site, the facilities (as approved by this Office)
shall be constructed and operational, and the storm water management plan (as approved by this Office)
shall be implemented. The structural storm water practices as approved by this Office as well as drainage
patterns must be maintained in perpetuity. No changes to the structural storm water practices shall be
made without written authorization from the Division of Water Quality.
5. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of
Completion" form to the 401/Wetlands Unit of the NC Division of Water Quality.
6. Continuing Compliance. The applicant (Parker Nealy, Jr.) shall conduct all activities in a manner so as not to
contravene any state water quality standard (including any requirements for compliance with section 303(d)
of the Clean Water Act) and any other appropriate requirements of state and federal law. If DWQ determines
that such standards or laws are not being met (including the failure to sustain a designated or achieved use)
or that state or federal law is being violated, or that further conditions are necessary to assure compliance,
DWQ may reevaluate and modify this certification to include conditions appropriate to assure compliance with
such standards and requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the
certification, DWQ shall notify the applicant and the US Army Corps of Engineers, provide public notice in
accordance with 15A NCAC 2H.0503, and provide opportunity for public hearing in accordance with 15A
NCAC 2H.0504. Any new or revised conditions shall be provided to the applicant in writing, shall be provided
to the United States Army Corps of Engineers for reference in any permit issued pursuant to Section 404 of
the Clean Water Act, and shall also become conditions of the 404 Permit for the project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that
conforms to Chapter 150E of the North Carolina General Statutes to the Office of Administrative Hearings, 6714
Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless
you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.

In a previous e-mail (5/25/07) you mentioned that you had concerns whether the pond could
be filled-in, in compliance with the state water supply watershed regulations. I
forwarded your question regarding this issue to the environmental consultant for the
project (Tamp Bandy, Wetland and Natural Resource Consultants, Newton, NC 828-302-3437)
and have included his response below;
It is my understanding that the issuance of the 401 Certification addresses the concerns
and intent of the Water Supply buffers.
The 401 Water Quality Certification from the Division of Water Quality has certified that
the waters may be filled and therefore removed from jurisdiction such that there would be
no perennial waters present. This approval was achieved by meeting both the storm water
treatment BMP requirements (to be approved prior to impacts to the waters) and by meeting
the mitigation requirements to replace the lost uses / functions (accepted by the NC
' Ecosystem Enhancement Program) .
O With respect to the WS Buffers, the intent of the buffers is to protect the water quality
and uses as classified in the WS rules under the Antidegradation Policy. As stated in
Section .0200 - //Classifications and Water Quality Standards Applicable to Surface
Waters and Wetlands of NC (15A NCAC 02B .0201 (f) of the Antidegradation Policy) :
"Activities regulated under Section 404 of the Clean Water Act (33 U.S.C. 1344) which
require a water quality certification as described in Section 401 of the Clean Water Act
� (33 U.S.C. 1341) shall be evaluated according to the procedures outlined in 15A NCAC 2H
�M- .0500. Activities which receive a water quality certification pursuant to these
,m. procedures shall not be considered to remove existing uses. . . "//
Based upon the above, are the watershed issues resolved?
Also, in your previous email, you stated that "the issuance of the permits for the walls
and grading must be done in the context of an overall site plan. The site plan must
include all of the other information such as impervious coverage, storm water mitigation
measures, site plan requirements, driveway access etc." We will submit a plan that
includes a specific site layout with water quality basins sized for the associated
impervious area. However, please be advised that the Owner only intends to perform rough
grading and retaining wall construction initially. The initial construction phase will
not contain any impervious area and the water quality basin(s) will not be constructed
during this phase. The water quality basins will be constructed in the future when
impervious surface is placed on the site. Any revisions to the site plan and/or water
quality basins will be submitted when (or prior to) building plans are submitted.

Utility service connections and driveway connections will also be delayed until building
construction. However, a NCDOT permit application will be submitted with the initial
phase. It is our understanding that sanitary sewer and water utilities are available in
the Hwy 150 (West Plaza Dr) .

The purpose of this correspondence is to request that a Nationwide Permit 39 be issued
for the above referenced project. The impacts requested in this permit application are
limited to less than 2 acre of open waters. These impacts are necessary to provide a
buildable lot for commercial development.
Construction of this project will involve extensive measures to limit the amount of impact
on the surrounding open water areas. Large stones will be placed into the proposed
impacted area (0.49 acres of open water) to allow for heavy equipment to drive into the
pond and begin construction. Sheet pilings will then be driven into the pond bottom along
the limits of impact. The water inside the impact area will be pumped downstream, and the
water coming upstream of the impact area will be pumped around. Once all the water is
drained out, the area will be filled, and a culvert will be installed to provide hydrologic
connectivity of the remaining open water areas on site. This culvert will be sized and
located in such a position that the existing pool elevations of the ponds above and below
the impacted area will be maintained. Retaining walls will be installed on either end of the
impacted area in order to limit the amount of impact.
Mitigation is proposed through purchase into NC EEP at a 0.5:1 ratio, riparian wetland to
open waters. A request for 0.25 acres of riparian wetland restoration has been submitted
to NC EEP. A copy of this In Lieu Fee Request Form is attached for your review, and a
copy of the acceptance letter will be forwarded to your office when one is received.

Describe the existing conditions on the site and general land use in the vicinity of the project
at the time of this application: The upper portions of a pond cover approximately 25% of the
site. Approximately 45% of the site is in open cutover field, while the remainder of the
property (approximately 30%) is forested.
Describe the overall project in detail, including the type of equipment to be used: The project
will involve the removal and redirection of the open water from the site and the
filling/leveling off of the lot. Large stone will be placed in the pond to allow equipment to
drive sheet pilings along the edges of impact. Water inside the area will be pumped

downstream, while the upstream water will be pumped around the area. Once drained, the
area will be filled and a culvert will be installed to maintain the hydrologic connectivity of
the upstream and downstream open water areas. Heavy equipment will be used for this
project.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts. Impacts are necessary to allow
for commercial development of the land. The remaining open waters on the site will be left
undisturbed. Retaining walls will be installed to avoid further impacts to Waters of the US. A
pipe will be installed between the retaining walls in order to provide hydrologic connectivity of
the remaining open waters upstream and downstream of the proposed impacted area.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE — In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.
