A copy of the Compliance Inspection Report is enclosed for your review. Our records indicate that the subject facility is permitted under the NCG020000 NPDES Industrial Stormwater Permit. The receiving waters for this facility are designated as the Ararat River, a Class C waterbody in the Yadkin-PeeDee River Basin. As a result of the inspection, the following deficiencies were noted: 1) Failure to conduct semi-annual qualitative monitoring. [Part IV, Section C] 2) Failure to conduct semi-annual analytical monitoring for stormwater discharges. [Part IV Sections A and B] 3) Failure to develop and implement a Stormwater Pollution Prevention Plan. A SWPPP for this facility is due 120 calendar days of receipt of this notice, and a follow-up inspection will occur 210 calendar days of receipt of this notice. Thank you for your attention to this matter. DEMLR requires that the deficiencies, as noted above and detailed in the enclosed inspection report, be properly resolved. Failure to address these deficiencies could result in the issuance of a Notice of Violation, which could be subject to a civil penalty assessment of up to $25,000 per day for each violation. The inspection revealed that the SWPPP (received via email on May 11, 2021) had not been updated since July 2009. It was further revealed that the SWPPP was reviewed in 2020, but there were no records to indicate that it was reviewed before then. The SWPPP restated sections of the permit and was more of a general overview of what a plan should include, than it was an actual plan specific to the site. The SWPPP was also missing key components as required by Section III of the NCG020000 General Permit. A copy of the COC and the General Permit was included in the SWPPP. Furthermore, the Preventative Maintenance and Good Housekeeping Portions of the SWPPP was included in a separate document This portion was also more of a general overview and not a plan specific to the site. Corrective actions are needed to bring this site in compliance with the permit. The facility SWPPP needs to be revised to include all the items that are stated in Section III of the NCG020000 General Permit. The SWPPP should be a plan specific to this site, and not a restatement of the permit. A copy of the COC and the Permit should be kept on site at all times. Furthermore, Analytical, On -Site Vehicle Maintenance, Qualitative, and Wastewater Discharge Monitoring should be conducted as specified in Part IV, Sections A-D of the NCG020000 General Permit. This site will be reinspected after 210 days of receipt of this report to evaluate the corrective actions taken in response to this inspection. Be advised, failure to comply with the NCG020000 General Permit could result in a Notice of Violation.
