Dear Mr. Trone,
The following includes responses to the additional information request received June 15, 2021, from
the N.C. Division of Water Resources:
Please provide more details regarding avoidance and minimization of impacts to non-404
waters for this project [15A NCAC 02H .1404(b)].
Total avoidance of stream and wetland impacts by this project is not feasible, but the
proposed design avoids and minimizes impacts, where practicable. The Applicant has avoided
and minimized impacts to the greatest extent practicable given the project's purpose and
need. The proposed wetland impacts are the result of the necessary infrastructure and facility
layout, without which, the project's goals would not be realized. A copy of the Overall Site
Phasing Plan is included as an attachment to this response.
Steps to avoid and minimize potential adverse impacts to both the 404 and non-404 waters
were analyzed throughout the project planning and design process including:
A detailed delineation of wetlands, streams and buffers was completed for the project site.
The results of which were utilized throughout the design process to ensure that impacts to
environmentally sensitive areas (i.e wetlands, buffers and streams) were avoided and
minimized to the greatest extent practicable.
Pre -application meetings were held during the project development stages with both State
and Federal agencies. Input and recommendations received during these preliminary
meetings were incorporated into the design in order to further avoid and minimize impacts
to environmentally sensitive areas.

The Site has been designed to maximize the effective use of the lands outside of the FEMA
100-year floodplain, jurisdictional wetlands (including the Buffalo Creek impoundment),
streams and riparian buffers in order to minimize and avoid impacts to these areas to the
greatest extent possible, while still providing space for site programming needs. Of the 22
acres of jurisdictional wetlands on the property, only 0.261 acres will be permanently
impacted from the proposed project. Impacts to the 3,100 linear feet of stream on the
property was limited to 224 linear feet of permanent impact. Finally, impacts to the riparian
buffers are associated only with perpendicular road crossings. No other additional impacts to
riparian buffers are proposed.
Initially the site was designed to have the Wendell Boulevard entrance located mid -property
to help avoid Wetland F. However, further review by NCDOT required that the entrance be
shifted as far to the east as possible to maximize the spacing of the driveway to the existing
signalized intersection to the east. The roadway is also designed based on the minimum Town
of Wendell roadway design requirements forcing the full impact of Wetland F. This does allow
for the crossing at Wetland B to be situated to minimize the impacts to that wetland as well
as avoids all impacts to Stream SB. Please see the attached Overall Site Phasing Plan which
reflects the recommended off -site roadway improvements for the proposed project.
In order to prevent the potential for secondary stream and wetland impacts, all erosion and
sedimentation control practices, including the application of silt fences and erosion control
matting, will be constructed and maintained according to the standards and specifications of
the current North Carolina Erosion and Sediment Control Planning and Design Manual.
2. This Office believes that impacts to non-404 waters can be moved or reconfigured to avoid the
impacts. Please revise the plans to avoid the impacts or provide a detailed explanation of why
this plan for the activity cannot be practically accomplished, reduced or reconfigured to avoid
impacts [15A NCAC 02H .1404(b)].
Per the Town of Wendell and NCDOT requirements, access to the site is proposed via two (2)
new driveways. Site Drive 1 is proposed as a directional crossover along Wendell Boulevard
at the southern edge of the site, approximately 875 feet east of the Rolesville Road
intersection. Site Drive 2 is a proposed full movement driveway along the east side of
Rolesville Road and will be aligned with the existing Sheetz/ Drive / ABC approximately 515
feet north of Wendell Boulevard.
Per NCDOT, the Wendell Boulevard entrance (Site Drive 1) has shifted east as far as possible
to maximize the spacing of the driveway from the signalized intersection at Wendell
Boulevard and Rolesville Road. The access has been designed to the minimum roadway cross
section allowed by the jurisdictional authority for development by the Town of Wendell. The
location of this entrance is mandated based on requirements from the Town of Wendell and
the NCDOT. Please see the attached Overall Site Phasing Plan which reflects the
recommended off -site roadway improvements for the proposed project.

The proposed internal roadways are situated to provide the required amount of parking
spaces for the campus within the northern parking lot as well as providing sufficient internal
campus spacing. The attached Overall Site Phasing Plan shows the full build out for the
proposed project.
The placement of proposed roadways were designed to follow the natural terrain as much as
possible to minimize the impacts from grading to onsite jurisdictional wetlands and streams,
while also maintaining a usable average longitudinal slope through the site. This is required
such that pedestrian walkways can be constructed to meet the current minimum
requirements of the US Department of Justice ADA Standards for Accessible Design.
If culverts are proposed for any impacts to non-404 waters please provide a detailed
engineering plan, profile view, and cross-section of all proposed culverts.
No culverts are proposed in the non-404 waters.
4. Please note that losses of non-404 wetlands that exceed thresholds set out in [15A NCAC 02H
.1405 (a)(3)]. Mitigation ratio for impacts exceeding the threshold for the entire project shall be
1:1. Impacts to non -jurisdictional wetlands shall not be combined with the project impacts to
wetlands that are regulated under Section 404 of the Clean Water Act [15A NCAC 02H .1405].
Additional mitigation for impacts to the non-404 wetlands has been identified. A Statement
of Availability letter is included as an attachment to this submittal.

Re Project: Wake Technical Community College East
This document confirms that Wake Technical Community College (Applicant) for the Wake Technical
Community College East (Project) has expressed an interest to utilize 1.40 Riparian Wetland
Mitigation Credits from the EBX-Neuse sponsored Neu -Con Wetland & Stream Umbrella Mitigation
Bank, specifically wetland credits from the Blackbird Site, in the Neuse HUC 03020201. As the official
Bank Sponsor, EBX-Neuse I, LLC, attests to the fact that mitigation is available for reservation at this
time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
