Dear Mr. Allen,
In response to your Notice of Deficiency letter of April 4, 2019, I submit the following
explanation. First, I would like to apologize for the delay in responding to this NOD. I never saw
the certified mail notice. I don't know if we received it or it was misplaced. I take this issue
seriously and was not ignoring your letter
On March 1, 2019 I was irrigating in the field in front of my farm and unfortunately it was a little
too wet and water ponded in the field. The grass was tall enough that it was not evident to me.
Thankfully none of the ponded water ran into an adjoining ditch. It has been a wet fall and winter
and I was anxious to lower my lagoon level but should have waited another day to irrigate.
Now i more closely monitor field conditions and sail moisture because I do not want this issue to
occur again. I have also contracted with a local farmer to aerate my fields to break the hardpan
which does not allow water to soak in quickly. Mr. Bill Dunlap was very professional and made
some suggestions to avoid problems in the future.
