Dear Mr. Trent Allen,
This letter is in response to the Notice of Violation/Notice of Intent delivered via certified
mail on February 5, 2019. My family and I are owner operators of Bull Creek Farms LLC
No. 09-0173, Permit No. AWS090173 and are deeply troubled by the Notice of
Violation/Notice of Intent. We are heavily involved in the North Carolina pork industry and
would never intentionally do anything to harm people, animals, the environment or the
industry. In the paragraphs below, I will attempt to provide information and details outlining
the events surrounding the alleged offense, documents requested, and actions taken.
Violationl: (Permit No. AWG100000 Section Conditions I1 and 12) Failure to prevent
discharge of waste to surface waters or wetlands. N.C.G.S. 143-215.10C.
December 5, 2019 at 6:00 am I started pumping from F3 lagoon (see attached diagram) on to
tract/field 13A & 14. My entire family was out of town the next day (December 6, 2019) and
the weather forecast called for heavy rain over the weekend. I personally walked the fields
prior to pulling out the irrigation reels and prior to starting the pump. Conditions were fine
for application. I stayed at the farm until 9:00 am and checked each location every hour. My
wife came to the farm at approximately 9:00 am to bottle feed calves, check cows and check
the irrigation system until 12:00 noon. She checked each location every hour and found no
issues. My son arrived at the farm a little before 1:00 pm and somewhere between 12:00
noon and 1:00pm the motor on the irrigation reel on tract/field 14 stopped running. He
pulled the reel back across tract/field 14 and found some slight ponding in the field. He
called me, and I told him to shut the reel and riser off which he had already done prior to
calling me. He shut that reel and riser off but continued pumping on tract/field 13A. He
confirmed that the ponding was only in tract/field 14 and that no water had left the field. He
continued to observe the other tract/field until 2:00 pm and everything was fine. I returned to
the farm at 4:00 pm and found a little more ponding so I shut down the entire system. At this
time, I walked the perimeter of entire field and saw that no water left the field in any
location. I checked the manmade ditches surrounding the field and did not find that any
evidence that surface water entered the ditches. The ponding water was very minor and, in
my opinion, not excessive, but I clearly made incorrect assumption that it would absorb into
the field.
The next day my family and I went out of town for a vacation. I was notified on December
7, 2019 by my technical specialist (Curtis Barwick) that DWR received a complaint about
our farm and Mr. Dunlap was going to the site to investigate. Unfortunately, Mr. Barwick
and I were both out of town and unable to attend the inspection. I would have liked to have
been in attendance to explain the circumstances and provide all requested documentation, but
because I was in another state, I was unable.
In the future if we ever find ponding water in a field, we will immediately shut down all the
irrigation equipment and transfer the ponding water back into the nearest lagoon.
Violation2: (Permit No. AWG100000 Section Conditions III. 13a) Failure to notify
Division of Water Resources of a failure of any component of the animal waste
management system resulting in a discharge to ditches. surface waters or wetlands.
Based on my investigation the evening of December 5, 2019, there was ponding water on
tract/field 14 but I could not find evidence that any water had left the field and/or entered the
nearby ditch. If I had observed any water leaving the field, I would have immediately
contacted Division of Water Resources and started the cleanup process. My family and I are
very focused on being responsible farmers and would never knowingly violate a regulation or
jeopardize the environment. In the future I will stay at the farm and clean up any ponding to
ensure that it does not enter nearby ditches, surface waters or wetlands.

Violation3: (Permit No. AWG100000 Section Conditions IIL 13a) In no case shall land
application rates result in excessive ponding or any runoff during any given application
event.
We were surprised to find even the slightest amount of ponding in this field as it has not had
a ponding issue in the past. In problem solving, we realized that we had just rotated 80
cow/calf pairs out of the fields in question. I am confident that they added to the compaction
of the soils in certain locations making it more difficult for water to absorb. In the future we
will watch all fields very closely to ensure that all equipment is functioning properly, and no
excessive ponding or runoff occurs. In addition, my son has attended the OIC training
classes, and will be taking his examination in March. This will insure that we have an OIC
on site for each irrigation event.
Violation' (Permit No. AWG100000 Section Conditions IIL #5) An analysis of a
representative sample of the animal waste to be applied shall be conducted in accordance
with recommended laboratory sampling procedures as close to the time of application as
practical and at least within sixty (60) days (before or after) of the date of application.
Attached please find a copy of the results of the representative samples taken from all waste
treatment facilities at our farm. The samples were taken on 9/26/18 and 1/7/19 and are within
the 60-day window of our permit.
Violations: Failure of the Operator in Charge (OIC) or person under the supervision of an
OIC to inspect the land application as often as necessary to ensure that the animal waste is
land applied in accordance with the CAWMP.
Attached please find a copy of the farms IRR1 showing the irrigation documentation for the
date in question and the inspection times. As you can see by this document, the fields were
inspected every 60 minutes except one time from 2:00 pm to 4:00pm and it was inspected
within 120 minutes of the previous inspection.
Again, we are deeply troubled that this event occurred and will do everything in our power to
ensure no future violations happen. Below are the steps that are and will be taken to ensure
100% compliance;
• All irrigation equipment will be inspected regularly to insure proper operation and
application. We replaced the drive motor on the reel in question to ensure
functionality.
• During any irrigation event we will inspect all risers, fields and equipment regularly
to guarantee no excessive ponding or run off has occurred.
• In the future if ponding has occurred, we will take immediate action to redirect water
back to the nearest lagoon, eliminating the potential of water entering nearby ditches
or leaving the property.
• In the future if water enters a nearby ditch or leaves the application field, we will
immediately notify the Division of Water Resources and rectify the issue.
• In the event of a future complaint either myself, my son (who be an OIC in the near
future) or my technical specialist will be at the farm for the investigation.
• All required records, documentation, sampling and requirements of our permit will
continue to be maintained and in compliance. These documents are and will be
available immediately upon request.
Again, we deeply regret the recent event and will do everything in our power to ensure that
our farm complies with all regulations.

Nutrient concentrations and
application and preventing
other data on this report are provided so that waste materials can be applied at agronomic rates, thereby
environmental contamination. In reading the Laboratory Results section, remember that materials with <
wastes are dried first. Values in the Estimate of Nutrients Available for First Crop section are based
reflects the fact that only 40-60% of the nitrogen becomes available within one year of application. The remainder
