Briefly describe the proposed permitting action and facility background:
This facility is an industrial (flow <1 MGD) collecting stormwater from a Surface-Water Pollution
Prevention System in proximity to above-ground storage tanks (ASTs). Facilities include surface bulk-
storage of petroleum hydrocarbon fuels in excess of one million gallons, and fuel-truck loading racks.
The stormwater component for this facility is covered under Individual NPDES permit NC0005185 as
Outfall 006.
Significant changes to the facility include the removal of a groundwater remediation system (Outfall 007)
to certificate of coverage (COC) NCG510555 under General Permit NCG510000. No discharge has
occurred to date from Outfall 007 has been containerized and hauled offsite. The permittee is seeking
coverage under the general permit mainly because they wish for their contractor for groundwater
remediation to manage the complete operation and self-monitoring for the system on their behalf.

6. Water Quality-Based Effluent Limitations (WQBELs)
Dilution and Mixing Zones
In accordance with 15A NCAC 2B.0206, the following streamflows are used for dilution considerations
for development of WQBELs: 1Q10 streamflow (acute Aquatic Life); 7Q10 streamflow (chronic Aquatic
Life; non-carcinogen HH); 30Q2 streamflow (aesthetics); annual average flow (carcinogen, HH).
If applicable, describe any other dilution factors considered (e.g., based on CORMIX model results): NA.

Oxygen-Consuming Waste Limitations
Limitations for oxygen-consuming waste (e.g., BOD) are generally based on water quality modeling to
ensure protection of the instream dissolved oxygen (DO) water quality standard. Secondary TBEL limits
(e.g., BOD= 30 mg/l for Municipals) may be appropriate if deemed more stringent based on dilution and
model results.
If permit limits are more stringent than TBELs, describe how limits were developed: NA.
Ammonia and Total Residual Chlorine Limitations
Limitations for ammonia are based on protection of aquatic life utilizing an ammonia chronic criterion of
1.0 mg/l (summer) and 1.8 mg/l (winter). Acute ammonia limits are derived from chronic criteria,
utilizing a multiplication factor of 3 for Municipals and a multiplication factor of 5 for Non-Municipals.
Limitations for Total Residual Chlorine (TRC) are based on the NC water quality standard for protection
of aquatic life (17 ug/l) and capped at 28 ug/l (acute impacts). Due to analytical issues, all TRC values
reported below 50 ug/l are considered compliant with their permit limit.
Describe any proposed changes to ammonia and/or TRC limits for this permit renewal: NA.
Reasonable Potential Analysis (RPA) for Toxicants
If applicable, conduct RPA analysis and complete information below.
The need for toxicant limits is based upon a demonstration of reasonable potential to exceed water quality
standards, a statistical evaluation that is conducted during every permit renewal utilizing the most recent
effluent data for each outfall. The RPA is conducted in accordance with 40 CFR 122.44 (d) (i). The NC
RPA procedure utilizes the following: 1) 95% Confidence Level/95% Probability; 2) assumption of zero
background; 3) use of ½ detection limit for “less than” values; and 4) streamflows used for dilution

consideration based on 15A NCAC 2B.0206. Effective April 6, 2016, NC began implementation of
dissolved metals criteria in the RPA process in accordance with guidance titled NPDES Implementation of
Instream Dissolved Metals Standards, dated June 10, 2016.
A reasonable potential analysis was conducted on effluent toxicant data collected between August 2016
and January 2021 for Outfall 006. Pollutants of concern included toxicants with positive detections and
associated water quality standards/criteria. Based on this analysis, the following permitting actions are
proposed for this permit:
• There was no detection for the following parameters: Benzene, Ethylbenzene, Xylenes Mixture,
and Naphthalene. No changes to monitoring for these parameters are recommended because they
are parameters of concern for bulk-storage of petroleum products.
• There was detection for the following parameters, but there was no reasonable potential to exceed
water quality standards, EPA criteria, nor in-stream target values: Toluene, MTBE, and Phenolic
Compounds (Phenol). The Predicted Max Concentration was < 50% of Allowable Concentration
for these parameters. No changes to monitoring for these parameters are recommended because
they are parameters of concern for bulk-storage of petroleum products.

freshwater/saltwater [Not Applicable] to this Fact Sheet. Include a printout of the RPA Dissolved to Total
Metal Calculator sheet if this is a Municipality with a Pretreatment Program.
Toxicity Testing Limitations
Permit limits and monitoring requirements for Whole Effluent Toxicity (WET) have been established in
accordance with Division guidance (per WET Memo, 8/2/1999). Per WET guidance, all NPDES permits
issued to Major facilities or any facility discharging “complex” wastewater (contains anything other than
domestic waste) will contain appropriate WET limits and monitoring requirements, with several
exceptions. The State has received prior EPA approval to use an Alternative WET Test Procedure in
NPDES permits, using single concentration screening tests, with multiple dilution follow-up upon a test
failure.
Describe proposed toxicity test requirement: No changes for renewal. Acute Toxicity (Fathead Minnow,
24-hour), Annual [see Special Condition A. (2)].
Mercury Statewide TMDL Evaluation
There is a statewide TMDL for mercury approved by EPA in 2012. The TMDL target was to comply with
EPA’s mercury fish tissue criteria (0.3 mg/kg) for human health protection. The TMDL established a
wasteload allocation for point sources of 37 kg/year (81 lb/year), and is applicable to municipals and
industrial facilities with known mercury discharges. Given the small contribution of mercury from point
sources (~2% of total load), the TMDL emphasizes mercury minimization plans (MMPs) for point source
control. Municipal facilities > 2 MGD and discharging quantifiable levels of mercury (>1 ng/l) will
receive an MMP requirement. Industrials are evaluated on a case-by-case basis, depending if mercury is a
pollutant of concern. Effluent limits may also be added if annual average effluent concentrations exceed
the WQBEL value (based on the NC WQS of 12 ng/l) and/or if any individual value exceeds a TBEL
value of 47 ng/l

Other TMDL/Nutrient Management Strategy Considerations
If applicable, describe any other TMDLs/Nutrient Management Strategies and their implementation
within this permit: Lake Wylie has TMDLs for Total Phosphorus and Total Nitrogen. Nutrients are not a
concern for Bulk-Storage Oil Terminals.
Other WQBEL Considerations

8. Antidegradation Review (New/Expanding Discharge):
The objective of an antidegradation review is to ensure that a new or increased pollutant loading will not
degrade water quality. Permitting actions for new or expanding discharges require an antidegradation
review in accordance with 15A NCAC 2B.0201. Each applicant for a new/expanding NPDES permit
must document an effort to consider non-discharge alternatives per 15A NCAC 2H.0105( c)(2). In all
cases, existing instream water uses and the level of water quality necessary to protect the existing use is
maintained and protected.
If applicable, describe the results of the antidegradation review, including the Engineering Alternatives
Analysis (EAA) and any water quality modeling results: NA.

9. Antibacksliding Review:
Sections 402(o)(2) and 303(d)(4) of the CWA and federal regulations at 40 CFR 122.44(l) prohibit
backsliding of effluent limitations in NPDES permits. These provisions require effluent limitations in a
reissued permit to be as stringent as those in the previous permit, with some exceptions where limitations
may be relaxed (e.g., based on new information, increases in production may warrant less stringent TBEL
limits, or WQBELs may be less stringent based on updated RPA or dilution).

10. Monitoring Requirements
Monitoring frequencies for NPDES permitting are established in accordance with the following
regulations and guidance: 1) State Regulation for Surface Water Monitoring, 15A NCAC 2B.0500; 2)
NPDES Guidance, Monitoring Frequency for Toxic Substances (7/15/2010 Memo); 3) NPDES Guidance,
Reduced Monitoring Frequencies for Facilities with Superior Compliance (10/22/2012 Memo); 4) Best
Professional Judgement (BPJ). Per US EPA (Interim Guidance, 1996), monitoring requirements are not
considered effluent limitations under Section 402(o) of the Clean Water Act, and therefore anti-
backsliding prohibitions would not be triggered by reductions in monitoring frequencies.

11. Electronic Reporting Requirements
The US EPA NPDES Electronic Reporting Rule was finalized on December 21, 2015. Effective
December 21, 2016, NPDES regulated facilities are required to submit Discharge Monitoring Reports
(DMRs) electronically. Effective December 21, 2020, NPDES regulated facilities will be required to
submit additional NPDES reports electronically. This permit contains the requirements for electronic
reporting, consistent with Federal requirements.

The draft permit includes the following significant changes from the existing permit:
1. Outfall 007 for the groundwater system has been removed and will be covered under General
NCG510000. The issuance and effective date for certificate of coverage (COC) NCG510555
will coincide with the permit issuance and effective date for the renewal of individual permit
NC0005185.
2. The facility classification Grade I Physical Chemical Water Pollution Control System
(WPCS) was added to the effluent page.
3. Concurrent sampling is no longer required for annual Acute Toxicity.

Diked area (secondary containment for aboveground storage tanks (ASTs) with
hydrocarbon fuel capacity greater than one million gallons)
Manually operated discharge valves (normally closed), a point source to
discharge storm water and city water used for washing and/or hydrostatic
testing
Ethanol off-loading skid—secondary containment with a drain and automated
valve (point-source discharge—activated in the event of product loss)
Additionally, an air sparge/soil vapor extraction (AS/SVE) system is currently operating to
remediate shallow soil and groundwater from historic petroleum releases at the terminal. The
remediation effort is regulated by the North Carolina Department of Environment and Natural
Resources (NCDENR).
The SVE system uses blowers to extract soil vapor and some liquids from below the ground
surface. The liquids (consisting of groundwater and soil vapor moisture condensate) will
contain dissolved petroleum compounds, which are typically present in gasoline and diesel.
The current system consists of high vacuum blowers to remove vapor and liquid from
extraction wells, a knockout drum to separate liquids from vapor, and an aboveground storage
tank for temporary storage of the recovered groundwater. Additional equipment that has been
installed to treat the groundwater prior to disposal to the NPDES discharge point includes an
oil/water separator, an air stripper (off-line), and 2 carbon vessels. Maximum flow through the
system is anticipated to be approximately 1,700 gallons per day, which includes instantaneous
batch discharges of approximately 20 gpm to designated Outfall 007. This outfall has not been
activated yet.

Comment: NPDES facilities appeared to be properly operated and well maintained. The secondary
containment dikes and valves, oil/water separator, etc. are inspected daily and the product
recovery in the oil/water separator is checked weekly (at a minimum). The recovered
petroleum product (oil/water separator) and treated groundwater (groundwater remediation
storage tank) are removed and disposed at the Heritage -Crystal Clean facility located in
Concord, N.C. The facility is equipped with a dialer type alarm system for high level
conditions in selected storage tanks. These alarms are tested monthly. The contracted
company (WSP) that provides operation & maintenance to the on -site groundwater
remediation system is notified of any alarm conditions on this treatment system.

Surface Waters table (orange tab in this workbook):
2 -Search the NC 02B Standards (green tab), EPA NRWQC (yellow tab), and NC In-Stream Target Values (blue tab) tables for the parameter(s) of concern.
2.1 - Search for chemicals by Chemical Abstracts Service (CAS) number. If you do not know the CAS number for the chemical of concern, a simple
google search should provide it.

2.3 - Search for non-chemical parameters (pH, temperature, etc.) by name as they do not have CAS numbers.
2.2 - Chemicals can be searched for by name, but be advised that all known synonyms are not included in these tables. Searching by chemical name
may miss important information.
4 - The standards, criteria, and in-stream target values in these tables do not substitute for any written regulations, nor are they themselves regulations.
2.4 - Search all tables for each chemical or non-chemical parameter as different water quality standards, EPA recommended criteria, or NC in-
stream target values may apply for different designated uses.
3.1 - The most sensitive use must be protected. Refer to the designated uses table when deciding which standard, criteria, or in-stream target
values to apply.
3.2 - North Carolina Standards are established in rule (15A NCAC 02B) and take precedence over EPA national criteria. EPA national criteria have
undergone thorough scientific and national stakeholder evaluation, but have not been through the NC rule making process. EPA national criteria
take precedence over NC in-stream target values. NC in-stream target values are determined based on available toxicological data for chemicals per
language in Title 15A the North Carolin Administrative Code (15A NCAC 02B .0202 and .0208). Classifications & Standards staff should be contacted
for guidance on the use of these values.

Magellan has reviewed the draft permit and have these comments:
• We are in agreement to the changes listed on the front page.
• For Footnote 3, concerning Turbidity, are there accessible public records of background turbidity, or is
Magellan responsible for getting samples from the receiving stream?
• The two parameters on DMRs dated 7/27/2017 and 7/23/2019 have been amended, submitted
electronically and a copy attached to this e-mail.
o July 2017 monitoring period — Phenol parameter was listed as a mg/I measurement "<0.01". The
parameter was changed to reflect the permit requirement as ug/I "<10.0".
o July 2019 monitoring period — MTBE had a double entry on two different dates. The correct
parameter "<5.0" entry was on the correct sample date and the double entry of "0.1031" was
deleted.

I appreciate the opportunity to review the subject draft NPDES permit and have included my response below in bold to
satisfy the new paperless standards.
I concur with issuance of the above permit as I have no appreciable expertise in implementation of the Clean Water Act
requirements and have minimal understanding of the information provided. As a result, I have no basis for opposing the
permit.
Please also note that the nearest downstream raw water intake for a public water system is associated with the City of
Belmont and is located approximately 10.5 miles downstream.
If you have any questions or need any additional information, please let me know.
