Subject: Second Request for Additional Information
Stormwater Permit No. SW6201004
Blackhawk Landing
Hoke County
Dear Mr. Lowder:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on October 6, 2020. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
Prior Comment 6 — "Please include the total surface water area (Section IV, 6). There
appears io be a blue line stream (Beaver Creek) that runs through the project area. The
area between the banks of this stream is considered to be surface water area. " The
surface water area for this project should be only the on -site portions of the of the stream
that are located between the banks. Since the dam is no longer in place, the pond surface
area cannot be used (10+ acres of surface water area seems too large for the site).
2. Prior Comment 8 — "For a high density project, off -site drainage areas need to either
be accounted for at their full build -out potential (100% BUA) or a legal agreement needs
to be reached between the two property owners (Section IV, 10). " Without a legal
agreement in place between property owners limiting the amount of off -site BUA within
the drainage area, the off -site area must be accounted for at its full build -out potential per
15A NCAC 02H .1003(3)(b). The full build -out potential for this off -site area is 100%
BUA, not 70% BUA.
3. Prior Comment 10 — "Please be more specific on how the amount and location of off -
site BUA was determined (Section IV, 11). Typically, this information is determined
through a site survey or some other official means. " You may need to change this item in
accordance with the above comment.

4. Prior Comment 17 — "Please delineate and show the surface area (in either square feet
or acres) of all on -site surface waters in the main set of plans (Section VI, 8h). This
information should match Section IV, 6 of the Application. " Please show the extents and
surface area (in hundredths of an acre) of the on -site surface waters. This is important for
the verification of Section IV, 6 of the Application and for determining the location and
extent of the required vegetated buffer.
5. Prior Comment 19 — "Please identify and dimension all BUA (not associated with
individual lots) on the main set of plans (Section VI, 8j). The information entered into the
Application and Supplemental-EZ Form should be verifiable on the plans. " Please clearly
show this information on the plans. We do not have (nor can we view) the CAD files for
this project so we are unable to accurately tabulate the total amount of proposed BUA
based on what is provided. Please either add callouts showing the amount of BUA by
type (Example: "500 sf sidewalk") or add a table similar to the one in Section IV, 10 of
the Application or the Supplement-EZ Form showing a BUA breakdown for the site.
6. Prior Comment 20 — "Please delineate the drainage area to the SCM in the main set of
plans (Section VI, 8o). " Please do this as it is a requirement. The provided drainage area
sheet (C-15) does not show the proposed SCM.
7. Prior Comment 21— "Please show the required vegetated setback on the main set of
plans (Section VI, 8p). " Please do this as it is a requirement. The vegetated setback from
surface waters should be clearly shown on the plans and measured landward from the
edge of the surface water.
8. Prior Comment 22 — "The signature in Section IX is not needed since the Applicant is
the Property Owner. With your permission, I will cross out the provided signature with
red pen on the original. Please edit the PDF of the Application to reflect this change. "
Please let me know if the proposed alteration to the original, signed, hard copy is
acceptable. Please also edit the PDF version of the signed Application so that Section IX
is not signed.
9. Please correct the following issues with the Supplement-EZ Form:
a. Cover Page:
i. Line 4 — Please include the on -site surface water area.
ii. Lines 7 & 8 — These items are required.
b. Drainage Areas Page:
i. Entire Site Column:
1. Lines 17 — 19 — These items are not needed for the entire site
column.
ii. Drainage Area 1 Column:
1. Line 18 — This value should match the design volume from the
calculations, 59,903 cf.
2. Line 19 — The design volume is calculated using either the Simple
Method or the Discrete NRCS Method (Please refer to Part B of
the Manual for more information).
c. Wet Pond Page:
i. Line 2 - This value should match the design volume from the calculations,
59,903 cf.
10. Please provide calculations showing that the outlets are sized correctly to protect against
erosion (General MDC 4).
11. Please show the SCM access and maintenance easements in the plans (General MDCs 8
& 9).
12. Plan sheet C-16 appears to show a drainage ditch between lots 43 - 46 that does not
appear to drain to the proposed SCM. Please clarify since this runoff should be able to be
directed to the proposed SCM.
13. Please provide a response to comments letter indicating how the above comments have
been addressed.
14. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents.

While it is not required, it is recommended that the off -site drainage from upstream properties be
diverted around the SCM since the Applicant cannot maintain control over the development of
property that they do not own. If the Applicant elects to account for off -site drainage, either the
entire off -site drainage area must be accounted for at its full buildout potential per 15A NCAC
02H .1003(3)(b) or there must be a recorded legal agreement in place between the Applicant and
the Owner of the upstream property in which the Owner of the upstream property agrees to
record a deed restriction limiting the minimum/maximum amount of BUA on the upstream
property that will be treated in the Applicant's SCM, the locations and sizes of access and
drainage easements, how construction and/or ongoing maintenance costs will be handled,
maintenance responsibility, a list of legal recourses available to each party should one party fail
to hold up their end of the agreement, and any other related legal issues.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to March 24, 2021, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. Please reference the State
assigned project number SW6201004 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
