Subject:SW5210402 - Siler City Municipal Airport - Obstruction Clearing
Good Afternoon,
The Division of Energy, Mineral, and Land Resources (DEMLR), received a complete Stormwater Management Permit
Application for the subject project on April 19, 2021. Staff review of the plans and specifications has determined that
the project, as currently proposed, is exempt from State Post-Construction Stormwater requirements since the
proposed activity meets the definition of redevelopment which is exempt under 15A NCAC 02H .1001(1)(f).
Any future development or changes to the proposed development, including, but not limited to, the relocation of built-
upon area and the construction of additional built-upon area, will require approval or a Stormwater Post-Construction
Permit Application and permit issuance from the DEMLR prior to any construction. Construction of additional
development or changes to the proposed development prior to receipt of the required approval or failure to maintain
compliance with the exemption conditions, are violations of Title 15A NCAC 2H.1000, and may result in the initiation of
appropriate enforcement action.
Please keep in mind that this determination does not affect your legal obligation to obtain other permits and approvals,
which may be required by Federal, State, or local government agencies, rule or law.
The submitted items and a copy of the attached letter will be kept on file at the Raleigh Regional Office. If you have any
questions, or need additional information concerning this matter, please contact me at jim.farkas@ncdenr.gov.
Thank you,
Jim Farkas
