Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* Existing conditions onsite consists primarily of undisturbed forested land with an unauthorized driveway crossing, and a disturbed stream and wetland system. There is an existing gravel driveway that connects from Royal Sunset Drive to the proposed residential structure location. Specifically, there is one (1) wetland feature (Wetland 1) and two (2) intermittent stream features (A & B) located on the property. 'Wetland 1' and stream'A' are located on the far eastern portion of the property while stream'B' is located near the western part of the property. General land use in the vicinity of the project is mainly forested land along with residential development to the south. Royal Sunset Drive bounds the property to the West. 4b. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: S&EC completed a wetland delineation within the previously identified disturbed areas so that the disturbed wetlands and streams could be identified and quantified. Impact 1 is a permanent stream impact for an existing driveway crossing. This eAsting crossing was constructed before the property owner purchased the property and is necessary to provide access to the property. Impact 2 is proposed permanent stream impacts for a driveway crossing. This crossing is necessary to provide access to the uplands to construct the proposed residential structure for the property owner. Riprap will be utilized at the outlet of the crossing to minimize velocities. The culvert(s) for this crossing have been installed and fill has been placed above culvert(s). Impact area 3 is proposed permanent wetland impact for a proposed lawn, and temporary stream impacts for stream restoration. The wetland area has been disturbed and is proposed to be graded to a gradual slope and then will be stabilized with erosion control matting and permanent seeding. Wetland mitigation is proposed at a 2:1 ratio to offset the permanent loss of wetlands for this area. The stream has been disturbed in this area and a stream restoration is being proposed. Stream restoration consists of recreating a channel through the disturbed wetland area, laying the stream banks back at a 2:1 slope, adding a non -woven geote)dile and placing riprap on the stream banks only for stabilization. The stream bed will be natural bed material. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Measures will include; silt fencing will be utilized, a temporary construction entrance, rock filter dam at inlet of proposed culverts, erosion control matting and permanent seeding to stabilize the cut/fill slopes. 2. All four (4) were contacted and none of the private banks had riparian wetland credits available. Therefore the NCDMS was utilized, please see NCDMS Acceptance letter. 6. A Notice of Violation was issued by the NCDWR on December 16, 2020 (NOV-2020-PC-0532), and a notice identifying unauthorized activity was issued by the USACE on December 18, 2020 (SAW-2020-02182). We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The 502 Royal Sunset Drive project is a single home residential development. Additionally, the project is located within Chatham County, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Jordan Watershed Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flow' requirements and may require Best Management Practices that control nitrogen if diffuse flow cannot be achieved; 2) the Water Supply, Watershed Protection Program which limits development densities as well as requires protective riparian buffers. Please note that this decision does not assure that participation in the DMS in -lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. (See Photographs 4-5) Item IL Stream Standards -Conditions of Best Usage — (Culverts/Road Crossings) Title 15A North Carolina Administrative Code 02B .0211 (2) requires that "The waters shall be suitable for aquatic life propagation and maintenance of biological integrity, wildlife, secondary recreation, and agriculture; sources of water pollution which preclude any of these uses on either a short-term or long-term basis shall be considered to be violating a water quality standard." • Approximately 40 linear feet of Stream A was impacted from land clearing and grading for Road Crossing 91. (See Photograph 6) • Approximately 30 linear feet of Stream B was impacted from land clearing and grading for Road Crossing 92. (See Photograph 7) Item III. Wetland Standards Title 15A North Carolina Administrative Code 02B .0231(c) requires that: Liquids, fill, or other solids or dissolved gases may not be present in amounts which may cause adverse impacts on existing wetland uses;" DWR staff observed approximately 0.17 acres of Wetland 1 was impacted from land clearing and grading. Failure to Secure a 401 Certification Title 15A North Carolina Administrative Code 02H .0501 requires certifications pursuant to Section 401 of the Clean Water Act whenever construction or operation of facilities will result in a discharge into navigable waters, including wetlands, as described in 33 CFR Part 323. This documentation should describe and quantify the impacts to those jurisdictional features and should include plans to avoid further stream and wetland impacts on the site. 4. Sediment impacts to Stream A onsite and downstream of the site must be removed. You should provide the amount (depth) of material that has been deposited in the floodplain, stream, and any wetlands. This information should be depicted on a map you provide. It is recommended that you use hand labor (buckets, shovels, and wheelbarrows) to remove deposited sediment from the stream channel. The sediment should be removed from the channel, taken to high ground away from the stream channel, and stabilized with thick vegetative cover. 5. Explain how you plan to restore the pattern, profile, and dimension of the impacted stream channel. The streambed must be restored to the original profile and the stream banks must be stabilized. 6. Rip rap needs to be removed from Stream A at Road Crossing 91 in a manner that minimizes disturbance of the stream bed and bank. 7. Rip rap needs to be removed from Stream B at Road Crossing 92 in a manner that minimizes disturbance of the stream bed and bank. Wetland Restoration Plan should address the following: 1. All fill placed in Wetland 1 must be removed. Detail how the earthen fill material placed in wetlands will be removed and how excavated/filled wetlands will be restored. This information must be clearly depicted on a map that you provide as a part of this response. 2. Satisfactory wetland restoration requires the replanting of at least 2 native hardwood wetland species and the maintenance of a stem density/survivorship of at least 320 trees per acre at the end of 3 years. The purpose of the on -site and office meeting was to address the unauthorized fill you have undertaken within jurisdictional waters on the subject property. While on -site, the Corps observed the unauthorized construction of two culverted driveway crossings totaling approximately 60 linear feet, along two intermittent stream channels as well as mechanized clearing and grading of approximately 0.17 acre of wetlands and 115 linear feet of intermittent stream channel. My staff's inspection revealed that you are responsible for the unauthorized discharge of fill material as described above, subject to our regulatory jurisdiction. These activities, undertaken it waters of the United States without prior approval from this office in the form of a Department of the Army (DA) permit, constitutes a violation of Section 301(a) of the Clean Water Act (33 USC 1311). Any additional unauthorized activities in waters of the United States should cease and desist immediately. The Corps requests that you coordinate with Mr. Lastinger to provide either a stream and wetland restoration plan to our office for review or to pursue DA after -the fact permitting within 30 days of the date of this letter. Please be reminded that issuance of DA permits require that an applicant demonstrate that they have avoided jurisdictional impacts by maximizing upland areas for the proposed Printed on ® Recycled Paper -2- development to the maximum extent practicable, minimizing the extent of the jurisdictional impacts, and lastly providing compensatory mitigation for those unavoidable impacts. The Corps will work with you on these time sensitive requirements.
