E. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
S&EC completed a wetland delineation within the previously identified disturbed areas so that the disturbed wetlands and streams could be identified
and quantified. Impact 1 is a permanent stream impact for an existing driveway crossing. This eAsting crossing was constructed before the property
owner purchased the property and is necessary to provide access to the property. Impact 2 is proposed permanent stream impacts for a driveway
crossing. This crossing is necessary to provide access to the uplands to construct the proposed residential structure for the property owner. Riprap
will be utilized at the outlet of the crossing to minimize velocities. The culvert(s) for this crossing have been installed and fill has been placed above
culvert(s). Impact area 3 is proposed permanent wetland impact for a proposed lawn, and temporary stream impacts for stream restoration. The
wetland area has been disturbed and is proposed to be graded to a gradual slope and then will be stabilized with erosion control matting and
permanent seeding. Wetland mitigation is proposed at a 2:1 ratio to offset the permanent loss of wetlands for this area. The stream has been
disturbed in this area and a stream restoration is being proposed. Stream restoration consists of recreating a channel through the disturbed wetland
area, laying the stream banks back at a 2:1 slope, adding a non -woven geote)dile and placing riprap on the stream banks only for stabilization. The
stream bed will be natural bed material.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Measures will include; silt fencing will be utilized, a temporary construction entrance, rock filter dam at inlet of proposed culverts, erosion control
matting and permanent seeding to stabilize the cut/fill slopes.
2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State

4h. Comments
S&EC reviewed the NCDWR Approved Mitigation Banks in NC list, there were four (4) banks listed within the 03030002 HUC that had riparian wetland
credits available. All four (4) were contacted and none of the private banks had riparian wetland credits available. Therefore the NCDMS was utilized,
please see NCDMS Acceptance letter.
6. Buffer mitigation (State Regulated Riparian Buffer Rules) - required by DWR
6a. Will the project result in an impact within a protected riparian buffer that requires buffer mitigation? If yes, you must fill out this entire form - please contact DWR for more
information.

F. Stormwater Management and Diffuse Flow Plan (required by DWR)
1. Diffuse Flow Plan
1a. Does the project include or is it adjacent to protected riparian buffers identified within one of the NC Riparian Buffer Protection Rules?
r Yes
r No
If no, explain why:
This project is located in the Cape Fear River Basin, there are no stream features shown on the USGS topographic map or the NRCS Soil Survey, therefore there are no protected
buffers onsite.
2. Stormwater Management Plan
2a. Is this a NCDOT project subject to compliance with NCDOT's Individual NPDES permit NCS000250?*

G. Supplementary Information
1. Environmental Documentation
1a. Does the project involve an expenditure of public (federal/state/local) funds or the use of public (federal/state) land?*
r Yes IT No
2. Violations (DWR Requirement)
2a. Is the site in violation of DWR Water Quality Certification Rules (15A NCAC 2H .0500), Isolated Wetland Rules (15A NCAC 2H .1300), or DWR Surface Water or Wetland Standards or
Riparian Buffer Rules (15A NCAC 2B .0200)? *
r Yes r No
2b Provide an explanation of the violation(s):
James Lastinger with the USACE, Chris Smith with NCDWR, Drew Blake and Justin Hasenfus with Chatham County all visited the site on December 9,
2020 and observed unauthorized activities onsite. A Notice of Violation was issued by the NCDWR on December 16, 2020 (NOV-2020-PC-0532), and
a notice identifying unauthorized activity was issued by the USACE on December 18, 2020 (SAW-2020-02182). Additionally Chatham County issued a
Notice of Violation.
3. Cumulative Impacts (DWR Requirement)
3a. Will this project result in additional development, which could impact nearby downstream water quality?*
r Yes
r• No
3b. If you answered "no," provide a short narrative description.
We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document
prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause
cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural
and silvicultural operations. The 502 Royal Sunset Drive project is a single home residential development. Additionally, the project is located within
Chatham County, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream
waters: 1) the Jordan Watershed Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area
in addition to "diffuse flow' requirements and may require Best Management Practices that control nitrogen if diffuse flow cannot be achieved; 2) the
Water Supply, Watershed Protection Program which limits development densities as well as requires protective riparian buffers. We anticipate that the
DWR will advise us if any additional information is needed.
4. Sewage Disposal (DWR Requirement)
4a. Is sewage disposal required by DWR for this project?*
C' Yes r No C' WA
5. Endangered Species and Designated Critical Habitat (Corps Requirement)
5a. Will this project occur in or near an area with federally protected species or habitat?*

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing
to accept payment for compensatory mitigation for impacts associated with the above referenced project
as indicated in the table below. Please note that this decision does not assure that participation in the
DMS in -lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for
project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if
payment to the DMS will be approved. You must also comply with all other state, federal or local
government permits, regulations or authorizations associated with the proposed activity including G.S. §
143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance
will expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives
a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and
payment must be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid
by an applicant is calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of

Dear Mr. Rodgers,
On December 9, 2020 Chris Smith from the Raleigh Regional Office (RRO) of the Division of
Water Resources (DWR), James Lastinger from the U.S. Army Corp. of Engineers, Drew Blake
and Justin Hasenfus from the Chatham County Watershed Protection Department conducted a
site inspection at the above referenced site. The purpose of the site visit was to investigate a
complaint and observe any impacts to the streams and wetlands onsite.
Accordingly, the following observations and violations were noted during the Division of Water
Resources inspection and subsequent file review:
(See Attachment 1 for feature designations — aerial imagery and graphics are approximate
representations only):
Item I. Stream Standards -Other Waste (In -Stream Sediment)
Title 15A North Carolina Administrative Code 02B .0211 (12) requires that "Oils; deleterious
substances; colored or other wastes: only such amounts as shall not render the waters injurious to
public health, secondary recreation or to aquatic life and wildlife or adversely affect the
palatability of fish, aesthetic quality or impair the waters for any designated uses;"
• The stream labeled as "Stream A" is an unnamed tributary in the Kit Creek watershed.
• Kit Creek, part of the Lake Jordan watershed, is classified as Class WS-IV, NSW waters.

• Due to the land disturbing activities on the parcel sediment has been deposited and
continues to flow into Stream A. (Photograph 1)
• DWR staff observed approximately 115 linear feet of Stream A has been impacted by
sediment deposition. Area surrounding Stream A was too unstable to assess depth of
sediment deposition. (See Photograph 1)
• Rip rap has been placed into Stream A on both sides of Road Crossing 91. (See
Photographs 2-3)
• The stream labeled as "Stream B" is an unnamed tributary in the Kit Creek watershed.
• Kit Creek, part of the Lake Jordan watershed, is classified as Class WS-IV, NSW waters.
• Rip rap has been placed into Stream B on both sides of Road Crossing 92. (See
Photographs 4-5)
Item IL Stream Standards -Conditions of Best Usage — (Culverts/Road Crossings)
Title 15A North Carolina Administrative Code 02B .0211 (2) requires that "The waters shall be
suitable for aquatic life propagation and maintenance of biological integrity, wildlife, secondary
recreation, and agriculture; sources of water pollution which preclude any of these uses on either
a short-term or long-term basis shall be considered to be violating a water quality standard."
• Approximately 40 linear feet of Stream A was impacted from land clearing and grading
for Road Crossing 91. (See Photograph 6)
• Approximately 30 linear feet of Stream B was impacted from land clearing and grading
for Road Crossing 92. (See Photograph 7)
Item III. Wetland Standards
Title 15A North Carolina Administrative Code 02B .0231(c) requires that: Liquids, fill, or other
solids or dissolved gases may not be present in amounts which may cause adverse impacts on
existing wetland uses;"
DWR staff observed approximately 0.17 acres of Wetland 1 was impacted from land
clearing and grading. (See Photograph 1).
Item IV. Failure to Secure a 401 Certification
Title 15A North Carolina Administrative Code 02H .0501 requires certifications pursuant to
Section 401 of the Clean Water Act whenever construction or operation of facilities will result in
a discharge into navigable waters, including wetlands, as described in 33 CFR Part 323. Title
15A NCAC 02H .0502 states any person desiring issuance of the State certification or coverage
under a general certification required by Section 401 of the Federal Water Pollution Control Act
shall file with the Director of the North Carolina Division of Water Quality.

Requested Response:
You are requested to address the below items in writing within 30 days of receipt of this letter.
Please submit a Restoration Plan(s) to this office for review and approval. You are encouraged to
secure a consultant to assist you with your plan development, permit, certification, and
authorization necessary to achieve compliance. This plan must address the following
locations/areas: Stream A, Stream B, and Wetland 1 as approximately located on Attachment 1.
Stream Restoration Plan should address the following:
1. Please explain when construction (excavation, clearing, grading) began at the site.
2. Please explain why these impacts occurred without prior authorization.
3. Please provide documentation (including a detailed site map/survey) depicting all
jurisdictional water features (e.g. streams, wetlands, buffers) on the site. This
documentation should describe and quantify the impacts to those jurisdictional features
and should include plans to avoid further stream and wetland impacts on the site.
4. Sediment impacts to Stream A onsite and downstream of the site must be removed.
You should provide the amount (depth) of material that has been deposited in the
floodplain, stream, and any wetlands. This information should be depicted on a map you
provide. It is recommended that you use hand labor (buckets, shovels, and
wheelbarrows) to remove deposited sediment from the stream channel. The sediment
should be removed from the channel, taken to high ground away from the stream channel,
and stabilized with thick vegetative cover.
5. Explain how you plan to restore the pattern, profile, and dimension of the impacted
stream channel. The streambed must be restored to the original profile and the stream
banks must be stabilized.
6. Rip rap needs to be removed from Stream A at Road Crossing 91 in a manner that
minimizes disturbance of the stream bed and bank.
7. Rip rap needs to be removed from Stream B at Road Crossing 92 in a manner that
minimizes disturbance of the stream bed and bank.
Wetland Restoration Plan should address the following:
1. All fill placed in Wetland 1 must be removed. Detail how the earthen fill material placed
in wetlands will be removed and how excavated/filled wetlands will be restored. This
information must be clearly depicted on a map that you provide as a part of this response.
2. Satisfactory wetland restoration requires the replanting of at least 2 native hardwood
wetland species and the maintenance of a stem density/survivorship of at least 320 trees
per acre at the end of 3 years. In addition, an herbaceous wetland seed mix must be
included in your plan for all wetlands that have been disturbed.

Erosion control:
Please address the erosion control measures that will be used for temporary stabilization/
sediment control while this work is under way. Please provide a schedule with dates by
which this work will be completed. As a part of your restoration plan, it is required that
you include a permanent stabilization plan for the disturbed areas.
Finally, please explain how you propose to prevent these problems from recurring on future
proj ects.
401 Water Quality Certification:
1. If you wish for any impacts to remain in place, you must contact the U.S. Army Corps of
Engineers (USACE) for information on the type(s) of permit required. Application to
DWR for a 401 Water Quality Certification will also be required. Please note that
sediment impacts to streams are not permittable impacts.
2. To apply for a 404 Permit and 401 Certification, you must complete the Application Form
(Pre -Construction Notification Form). Application forms and instructions are available
online: https://deg.nc.gov/about/divisions/water-resources/water-quality-permitting/401-
buffer-permitting-branch/appli cati on.
Schedule:
Please include in your response a detailed schedule with dates indicating when the
restoration will be accomplished. This schedule should include a two-year monitoring
plan to ensure that the impacted areas are restored. If you plan to seek a permit for the
permittable impacts, please state when an application will be submitted.
Please submit required materials to:

Dear Mr. Rodgers:
Reference is made to our site inspection of December 9, 2020, where Mr. James
Lastinger with the Raleigh Field Office of the U.S. Army Corps of Engineers (Corps) met
with you, your contractor, Mr. Jeremy Fisher with Artisan Woodcraft, Mr. Drew Blake
and Mr. Justin Hasenfus with Chatham County, and Mr. Chris Smith with the North
Carolina Department of Environmental Quality (NCDEQ) on your property located at
502 Royal Sunset Drive, in Durham, Chatham County, North Carolina (Parcel Index
Number 0081929). The purpose of the on -site and office meeting was to address the
unauthorized fill you have undertaken within jurisdictional waters on the subject
property.
While on -site, the Corps observed the unauthorized construction of two culverted
driveway crossings totaling approximately 60 linear feet, along two intermittent stream
channels as well as mechanized clearing and grading of approximately 0.17 acre of
wetlands and 115 linear feet of intermittent stream channel. My staff's inspection
revealed that you are responsible for the unauthorized discharge of fill material as
described above, subject to our regulatory jurisdiction. These activities, undertaken it
waters of the United States without prior approval from this office in the form of a
Department of the Army (DA) permit, constitutes a violation of Section 301(a) of the
Clean Water Act (33 USC 1311).
Any additional unauthorized activities in waters of the United States should cease
and desist immediately. The Corps requests that you coordinate with Mr. Lastinger to
provide either a stream and wetland restoration plan to our office for review or to pursue
DA after -the fact permitting within 30 days of the date of this letter. Please be reminded
that issuance of DA permits require that an applicant demonstrate that they have
avoided jurisdictional impacts by maximizing upland areas for the proposed

development to the maximum extent practicable, minimizing the extent of the
jurisdictional impacts, and lastly providing compensatory mitigation for those
unavoidable impacts. The Corps will work with you on these time sensitive
requirements.
Failure to comply with this request may result in referral of this matter to the United
States Attorney with a recommendation for appropriate action.
Thank you for your time and cooperation in resolving this matter of importance. If
you have any questions, please contact Mr. James Lastinger at the Raleigh Regulatory
Field Office by email at James. C.Lastinger(o)usace.army. m
