If in the future you wish to discharge wastewater to the State's surface waters, you must first apply for and receive a new NPDES permit. As we just discussed by telephone, NCDOT hasn't used the groundwater treatment system at the Pittsboro Site in the many years we have been performing in situ bioremediation. We maintained the NPDES permit in case we needed to reactivate the system in the future. At this point, restarting the system would likely require substantial modification and a new NPDES permit. Therefore, rescind or make the permit inactive as appropriate for your book keeping. NCDOT will not be paying an annual fee. Thanks, Jason F. No permit renewal application was received by the Division prior to expiration. Any discharge of wastewater from this facility is ILLEGAL without a valid permit. The renewal application was due no later than 11/1/2020. The deadline is derived from Federal and State requirements to request renewal 180 days before expiration of the current permit; the requirements are listed in 33 USC 1251, 40 CFR 122.21 (b), and 15 NCAC 2H.0105 (e). Since no renewal application was received, the Division is required to make permit NC0087629 Inactive. If no response is received by 5/31/2021, the permit will be made Inactive. You have ten days to respond to this Notice. The renewal application forms are attached; complete EPA Form 1, EPA Form 2E, and Tables A, B, and C of EPA Form 2C.
