This office has reviewed the subject erosion and sedimentation control plan. We find the plan to
be acceptable with modifications and hereby issue this letter of Approval with Modifications. The
Modifications Required for Approval are listed on the attached page. This plan approval shall
expire three (3) years following the date of approval, if no land -disturbing activity has been
undertaken, as is required by Title 15A NCAC 4B .0129.
As of April 1, 2019, all new construction activities are required to complete and submit an
electronic Notice of Intent (eNOI) form requesting a Certificate of Coverage (COC) under the
NCGO10000 Construction General Permit. After the form is reviewed and found to be complete,
you will receive a link with payment instructions for the $100 annual permit fee. After the fee is
received, you will receive the COC via email. You MUST obtain the COC prior to commencement
of any land disturbing activity. The eNOI form may be accessed at deq.nc.gov/NCGOI. Please

new responsible party is required to apply for his/her own COC.
Title 15A NCAC 4B .0118(a) and the NCGO1 permit require that the following documentation
be kept on file at the job site:
1. The approved E&SC plan as well as any approved deviation.
2. The NCGO1 permit and the COC, once it is received.
3. Records of inspections made during the previous 12 months.
Also, this letter gives the notice required by G.S. 113A-61.l(a) of our right of periodic inspection
to ensure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Program is performance -oriented, requiring
protection of existing natural resources and adjoining properties. If, following the commencement
of this project, it is determined that the erosion and sedimentation control plan is inadequate to
meet the requirements of the Sedimentation Pollution Control Act of 1973 (North Carolina General
Statute 113A-51 through 66), this office may require revisions to the plan and implementation of
the revisions to ensure compliance with the Act.
Acceptance and approval of this plan is conditioned upon your compliance with Federal and State
water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may
also apply to this land -disturbing activity. This approval does not supersede any other permit or
approval.
Please note that this approval is based in part on the accuracy of the information provided in the
Financial Responsibility Form, which you provided. This permit allows for a land -disturbance, as
called for on the application plan, not to exceed the approved acres. Exceeding the acreage will
be a violation of this permit and would require a revised plan and additional application fee. You
are requested to file an amended form if there is any change in the information included on the
form. In addition, it would be helpful if you notify this office of the proposed starting date for this
project. Please notify us if you plan to have a preconstruction conference.

MODIFICATIONS REQUIRED FOR APPROVAL
Project Name: HWY 55

1. Add the following statement to the construction sequence: "Erosion and Sediment
Control (E&SC) permit and a Certificate of Coverage (COC) must be obtained before
any land disturbing activities occur." The COC can be obtained by filling out the
electronic Notice of Intent (e-NOI) form at deq.nc.gov/NCGOL Please note, the e-NOI
form may only be filled out once the plans have been approved. A copy of the E&SC
permit, the COC, and a hard copy of the plan must be kept on site, preferably in a permits
box, and accessible during inspection.
2. Add a requirement to the construction sequence to contact the DEMLR Raleigh
Regional Office at least 48 hours prior to commencing the land -disturbing activity. The
contact number is (919) 791-4200. (15A NCAC 04B .106(b))
3. Add the following statement to the construction sequence: "Per the NPDES Permit,
ground stabilization will be applied within 14 calendar days from last land disturbing
activity. For steep slopes, that area must be stabilized within 7 calendar days." (15A
NCAC 04B .0106, NCGO1 Part II Section E (1))
4. Add the following statement to the construction sequence: "Permanent groundcover
shall be established in 90 calendar days. However, NPDES groundcover requirements
take precedence." (GS 113A-57(2),15A NCAC 0413.0107, NCGO1 Part II Section E(2)
5. Add the following statement to the construction sequence, "Per NPDES requirements,
a rain gauge, self -inspections records, permit, Certificate of Coverage, and S&E plan
are required to be maintained on site and accessible during inspection. It is
recommended that these items be placed in a permits box at the beginning or entrance
of project." (NCGO1 Part III Sections A and B, 15A NCAC 04B .0131)
6. Add the following statement to the construction sequence: "Self -inspections for erosion
and sedimentation control measures are to be performed at least once every seven
calendar days and within 24 hours of every rain event of greater than 1 inch. Any
needed repairs shall be made immediately to maintain measures as designed. All ESC
measures shall be maintained as specified in the construction details on this plan. A
rain gauge shall be installed at the project site for monitoring."

7. Self -inspection forms were updated on 07/01/2020. Please ensure new version of forms
is used. (GS 113A-54.1 (e), 15A NCAC 0413.0131, NCGO1 Part III Sections A and B)
8. Add the following statement to the construction sequence, "When the project is complete,
the permittee shall contact DEMLR to close out the E&SC Plan." After DEMLR informs
the permittee of the project close out, via inspection report, the permittee shall visit
deq.nc.gov/NCGO1 to submit an electronic Notice of Termination (e-NOT). A $100
annual general permit fee will be charged until the e-NOT has been filled out.
9. The NCG01 Ground Stabilization and Materials Handling Plan Sheet and NCG01
Inspection, Recordkeeping, and Reporting Plan Sheet must be added to the plans. A pdf
and an AutoCAD version are located at deq.nc.gov/NCGOL
10. Provide copies of access/encroachment agreements from NCDOT and other public or
private party entities. (GS 113A-54.I(a))
11. Provide two copies of the plan set (one full-size and one half-size (or 11"x17" )), showing
the modifications required for approval. To facilitate DEMLR review, bubble, highlight,
or otherwise identify the changes to your resubmittal. Provide one copy of additional
items (such as design calculations). Provide a cover letter referencing the project name,
project ID, and purpose for submittal. (G.S. 113A-57(4))
