However, due to Neuse River Riparian Buffer Rules (enacted after the development and recording of this subdivision) and the constraints imposed by the Rules, this lot cannot be built upon without approval of a Minor Variance which is required to construct impervious surfaces within Zone 2 of the Buffer. Enclosed herewith for your review are the following documents: 1) Variance Request Form for Minor Variances -signed by applicant; w/USGS Quad Map as Required 2) Stormwater Management Plan - 2 Copies on Half-Size Plansheets (includes summary of Applicant Mitigation Plan) 3) Drainage Calculations for Stormwater Management Devices -1 Copy 4) Grass Swale ~ Level Spreader Worksheets - 1 copy each, initialed by myself as agent for applicant 5) Grass Swale & Level Spreader Operation/Maintenance Forms -1 copy each, signed by applicant and notarized 6) Pictures Showing Area of Level Spreader 8~ Buffer On-Site Please note that this is a new submittal from a previous submittal that expired due to additional information requested; however the Owner/Applicant name has changed. We had worked closely with Ms. Annette Lucas on the initial submittal. I trust that this submittal includes all of the information you will now need for approval; including a new design for the level spreader (according to the new design standards published on NCDWQ's website). Our initial submittal did not require the new level spreader standard; however, we believed we would likely be required to design it according to the new standard and have now done so in this submittal. As before, the "approach" to the Stormwater Management Plan is intended to capture runoff from proposed impervious surfaces in Zone 2 of the buffer and direct it bads outside of both zones, making it diffuse for full buffer treatment prior to entering the stream. Additionally, a grass swale has been used as the conveyance device which will offer additional treatment prior to runoff entering the level spreader. GRASS SWALE OPERATION AND MAINTENANCE AGREEMENT The grass swale is defined as an open runoff conveyance device, similar to a ditch, but with flat slopes and side-slopes and soils that are suitable for infiltration. The device is designed for Iow velocities and may utilize impedance devices to promote infiltration. Maintenance activities shall be performed as follows: 1. After construction and until vegetation has been established, grass swale(s) shall be inspected after every rainfall. Thereafter, grass swale(s) shall be inspected at least every month and more frequently during the fall season and after heavy rainfall events: a. At least once annually, remove excess sediment, especially from the upstream edge, to maintain original contours and grading; b. At least once annually, repair any erosion and regrade the swale(s) to ensure that the runoff flows evenly in a thin sheet through the swale(s); c. At least once annually, inspect vegetation and revegetate the swale(s) to maintain a dense growth of vegetation; d.
