This Pre - construction Notification (PCN) is being provided to the North Carolina
Division of Water Quality ( NCDWQ) pursuant to the stream, wetland and riparian buffer
impacts, portions of which were inadvertently incurred prior to notification. A copy is
also being provided to the U.S. Army Corps of Engineers ( USACE) pursuant to
Nationwide Permit (NWP) No. 12 (Utility Line Activities) to account for the stream and
wetland impacts, which were originally intended as temporary. However, PNG later
determined that the aforementioned stream and wetland crossings should remain in place
to provide access to otherwise inaccessible high ground areas, and as such, written
approval from the USACE is now required.
The completed PCN and Agent Authorization Form are included in Appendix I.
GENERAL PROJECT INFORMATION AND BACKGROUND
PNG is in the process of ROW reclamation activities in the Greensboro - Burlington area.
The ROW within which the work is being conducted originates on the south side of N.C.
Highway 150 in the community of Oak Ridge, Guilford County, and extends generally
east - southeast for approximately 40 miles, terminating at a station of the west side of
N.C. Highway 54, south of Burlington in Alamance County. The general project location
is depicted on the Site Vicinity Map (Figure 1), and in greater detail on the appropriate
USGS topographic maps (Figures 2A -7A) and 2010 Aerial Photographs (Figures 3B -7B).
The existing ROW was acquired by PNG in 1954, and is 50 feet wide. Over the years,
the width of the ROW that PNG has regularly- maintained through mowing and above-
ground vegetation removal has steadily decreased, such that only 30 to 40 feet of the 50-
foot ROW was discernible in places. To adequately perform their routine maintenance
and inspection of the pipeline, PNG determined that the entire width of the ROW should
be maintained in high ground areas. The reclamation work entails above - ground removal
of woody vegetation within portions of the 50 -foot ROW that have grown up over the
years. Some areas only require side - trimming or mowing brush. The maintained width of
the ROW will be reduced from 50 feet to 30 feet where it crosses the riparian buffer and
the associated waterbodies.
When the work commenced in fall 2012, PNG was unaware that the reclamation
activities, specifically those related to riparian buffer encroachments, may be subject to
pre - construction notification requirements. PNG instructed S &ME contact the
appropriate USACE and NCDWQ personnel, inform them of the project, and determine
whether or not permits would be required for the work. Prior to agency notification,
PNG estimated that approximately ten miles of the roughly 40 -mile ROW had been
reclaimed in this manner. Since that time, the reclamation work has continued, but has
been limited to high ground portions of the ROW. Stream crossings and obvious wetland
areas have been avoided. Other than those areas noted by this PCN, the work had been
conducted so as not to create a discharge (no additional pipes or fill material placed at
stream crossings), although timber construction mats have been used at wetland crossings
to provide access for equipment. The mowing equipment was able to work around the
remaining stream crossings by finding alternative access routes.

When informed of the project on November 14, 2012, the USACE (Mr. Andy Williams)
indicated that so long as the work was not creating a discharge to wetlands or stream, pre -
construction authorization under a Nationwide Permit (NWP) should not be required.
Further, mitigation for wetland conversion (so long as there are no associated fills) is not
required by NCDWQ, and should not be required by the USACE, as the work does not
require a PCN.
The Jordan lake buffer rules state that existing and ongoing uses, such as utility line
ROWS, are exempt. However, only portions of the riparian buffer occupied by the
footprint of the existing use (maintained portions of the ROW) are exempt, and activities
necessary to maintain the use are only allowed provided that the site remains similarly
vegetated. On December 5, 2012, NCDWQ (Ms. Sue Homewood) informed S &ME and
PNG that if there has been no maintenance within the existing ROW within the last 10
years, buffer rules associated with the watershed would apply to affected streams.
PROJECT PURPOSE AND NEED
PNG considers establishment and regular maintenance of the existing ROW system an
important part of their responsibility to provide safe and reliable energy to the
communities they serve. To that end, maintaining at least 50 feet of easement in most
areas is required to support:
• Leakage surveys from ground mobile units or aerial technology.
• Aerial patrolling for possible encroachment activity near the pipeline.
• Aid in identification of possible repairs and maintenance.
• Promotion of damage prevention in that the easement can be more easily identified by
the public.
• Minimization of potential canopy encroachment, which creates visibility concerns.
• Minimum turn - around requirements for mechanized mowing and side - trimming
equipment.
PNG has agreed to reduce the width of the permanently- maintained ROW from 50 feet to
30 feet through buffered areas. This will minimize the permanent disturbance footprint,
and still provide PNG with a minimum ROW width deemed necessary to support the
needs identified above.
EXISTING ENVIRONMENT
The project area is located in the Piedmont physiographic province in the Cape Fear
River Basin (03030002) and Haw Sub - basin. Land use in the vicinity of the project
corridor consists primarily of a mix of woodland, open, maintained land and scattered

residential and urbanized light commercial areas. The route also passes through more
urbanized portions of Greensboro and Burlington.
Although vegetation within the existing ROW varied, general species observed included
blackberry (Rubus sp.), wineberry (R. phoenicolasius), sericea lespedeza (Lespedeza
cuneata), winged sumac (Rhus copallina), poison ivy (Toxicodendron radicans),
dandelion (Taraxacum officinale), Queen Anne's lace (Daucus carota), big bluestem
(Andropogon gerardii), dogfennel (Eupatorium capillifolium), broomsedge (Andropogon
virginicus), goldenrod (Solidago sp.), muscadine grape (Vitis rotundifolia), Deptford pink
(Dianthus armeria ssp. armeria) and various grasses (Festuca spp.). Woody saplings
observed within less - frequently maintained portions of the ROW included sweetgum
(Liquidambar styracifZua), tulip tree (Liriodendron tulipifera), black cherry (Prunus
serotina), red maple (Acer rubrum) and sugar maple (A. saccharum).
Wooded areas adjoining the existing easement were typically vegetated with species such
as shortleaf pine (Pious echinata), loblolly pine (P. tadea), American beech (Fagus
grandifolia), sweetgum, shagbark hickory (Carya ovata), red maple, ironwood (Carpinus
carohniana), various oaks (Quercus spp.), Virginia creeper (Parthenocissus
quinquefolia), ebony spleenwort (Asplenium platyneuron) and Christmas fern
(Polystichum acrostichoides).
A number of other land use areas were observed along the project corridor, but occupy an
insignificant portion relative to that identified above. Such portions of the project
corridor include landscaped or maintained lawns, roadway ROWS or other developed
areas.
Photos of the typical project corridor conditions are included in Appendix II.
RIPARIAN BUFFER IMAPCTS
To determine which streams within the ROW are subject to the buffer rules, S &ME
conducted field reviews of the project corridor over a period ranging from January 21,
2013 through February 6, 2013. Features that appeared on the most recent version of the
appropriate Natural Resources Conservation Service Soil Survey or 1:24,000 scale (7.5
minute) quadrangle topographic maps were identified with global positioning system
(GPS) equipment. Where the specific origination point of a regulated stream was in
question, or the sources identified above appeared inaccurate, S &ME performed an on-
site determination utilizing using the standardized methodology developed by NCDWQ.
This assessment involved use of the NCDWQ Stream Assessment Form (Version is 4.11,
effective September 1, 2010). Results of the field assessment were provided to Regional
Land Surveyors (RLS) for surveying and for generation of impact drawings.
For purposes of calculating buffer impacts, portions of PNG's ROW that had not been
mowed or otherwise maintained for a period of longer than 10 years, as approximated by
observing existing vegetation growth, were no longer exempted as an "existing use." In
portions of the buffer where single trees were present but the area was otherwise void of

woody vegetation, impacts were calculated by approximating the area occupied by the
crown of the tree during its full canopy period.
Based on our field assessment and the subsequent mapping efforts, the project will
permanently impact 14,430 square feet of Zone 1 riparian buffer and 16,361 square feet
of Zone 2. These impacts are broken out by crossing on the Riparian Buffer Impact
Table (Appendix III), and are depicted on the attached drawings (Appendix IV).
WETLAND AND STREAM IMPACTS
To identify and quantify stream and wetlands impacts that resulted from placement of the
culverts and associated fill material, S &ME conducted a jurisdictional delineation of the
affected areas on March 4, 2013. S &ME followed the procedures set forth in the 1987
US Army Corps of Engineers Wetlands Delineation Manual (Eastern Mountains and
Piedmont Regional Supplement Guide). Field conditions were documented using
USACE Routine Wetland Determination Data Forms, as appropriate. The field review
also included identification of tributaries (streams or ditches) within the project corridor.
Drainage features identified during the field review were assessed to determine the
jurisdictional status of the tributary. Drainage features were classified as either non -
jurisdictional or jurisdictional. S &ME used the NCDWQ Stream Classification Form, as
previously described, to document characteristics of identified drainage features on the
day of the assessment. Limits of the jurisdictional features were demarcated by S &ME
and subsequently identified and mapped by Regional Land Surveyors (RLS).
Wetland areas A and B, although denoted separately on the attached drawings, are
separate portions of the same wetland feature, and exhibited similar characteristics with
respect to existing vegetation, soils and hydrologic indicators. Accordingly, one set of
Wetland Determination Data Sheets reflects typical conditions associated with both
wetlands, and is included in Appendix V. The wetland areas are classified as Headwater
Forest wetland types in accordance with N.C. Wetland Assessment Method (NCWAM).
Affected portions of both wetlands were located within PNG's existing ROW, and as
such, contain no overstory vegetation.
Because equipment mats were not employed, Wetlands A and B were impacted by heavy
equipment moving through the area to remove brush and felled vegetation. Wetland B
was also impacted by placement of a pipe within a drainage feature. The drainage feature
within Wetland B did not exhibit a continuous bed and bank or other morphological
features to a degree sufficient for classification as a stream. The work resulted in 0.15
acre (ac) of impact to Wetland A and 0.32 ac of impact to Wetland B.
Three streams were impacted by the activities prior to submission of this PCN. Pipes
were placed in Streams 22 and 23 in order to access high - ground portions of the ROW.
Approximately 50 linear feet (If) of Stream 22 and 791f of Stream 23 were impacted.
Additionally, a separate PNG contractor replaced old rip -rap material that had lined the
banks of Stream 23, resulting in 661f of temporary impact. PNG proposes to replace the
existing pipes located within Streams 22 and 23 with shorter pipes, cumulatively
resulting in 421f of permanent impact. PNG proposes to leave the rip -rap that was placed

in Stream 24, and identify its placement as a temporary impact, given that the stream was
rip- rapped prior to the work PNG recently conducted there.
ADDITIONAL REGULATORY CONSIDERATIONS
Because the project has resulted in impacts to jurisdictional features located in the
vicinity of Frieden Church Road, consideration of conditions related to "after- the - fact"
authorization under NWP No. 12 must be taken into account.
Protected Species
To comply with General Condition Nos. 18 (Protected Species) and 19 (Migratory Birds
and Bald and Golden Eagles), S &ME conducted a review of existing records obtained
from federal and state sources. The U.S. Fish & Wildlife Service ( USFWS) list of
federally protected species was consulted for a listing of protected species documented
within Guilford County, North Carolina. This review identified only one federally -
protected species (a plant); small whorled pogonia (Isotria medeoloides).
Small whorled pogonia is a member of the orchid family. According to the USFWS
species description, it usually has a single grayish -green stem that grows about 10 inches
tall when in flower and about 14 inches when bearing fruit. The leaves are arranged in a
whorl near the top of the stem and beneath the flower. The leaves are grayish - green,
somewhat oblong and 1 to 3.5 inches long. The greenish - yellow flowers are about 0.5 to
1 inch long and appear in May or June. The fruit, an upright ellipsoid capsule, appears
later in the year. This species grows in older hardwood stands of beech, birch, maple,
oak, and hickory that have an open understory. Sometimes it grows in stands of
softwoods such as hemlock. It prefers acidic soils with a thick layer of dead leaves, often
on slopes near small streams.
Although potentially - suitable habitat for small whorled pogonia exists in the vicinity,
work associated with the culvert placements occurred within an existing ROW where gas
and overhead electric utilities are co- located. Habitat in this area is not suitable for small
whorled pogonia, and no plants resembling small whorled pogonia were observed in the
adjacent wooded area during an April 4, 2013 site visit by S &ME.
Review of the North Carolina Natural Heritage Program (NCNHP) Geographic
Information Systems (GIS) files of Element Occurrence (EO) and Natural Heritage Areas
available from NC OneMap identified no records of protected species within a two -mile
radius of the area subject to the wetland and stream impacts identified in this PCN.
Historic Properties
To comply with General Condition No. 20 (Historic Properties), S &ME conducted a
review of the Historic Preservation Office GIS Web Service, which indicated that the
closed site listed on the National Register of Historic Places is identified as the Boone
House (GF0377), located approximately 2,000 feet south of the existing ROW on Frieden
Church Road. There were no other properties currently listed or determined eligible for
listing in the National Register of Historic Places within a one mile radius of the project.

Although unlikely, in the event previously unknown historic, cultural or archeological
remains and artifacts are encountered while performing the work, the USACE will be
notified, and to the maximum extent practicable, reclamation activities that may affect the
remains and artifacts will be avoided until the required coordination has been completed.
Avoidance and Minimization
Through agency coordination, the project has implemented avoidance and minimization
procedures. Impacts will be minimized by reducing the width of the permanent
maintenance corridor to 30 feet through buffered areas. The project will also incorporate
the following best management practices (BMPs):
• Woody vegetation within the buffers shall be cleared by hand. No land grubbing or
grading will be allowed.
• Vegetative root systems within the buffer shall be left intact to maintain the integrity
of the soil. Stumps shall remain.
• No fertilizer shall be used other than a one -time application to re- establish vegetation.
• Construction activities shall minimize the removal of woody vegetation, the extent of
the disturbed area, and the time in which areas remain in a disturbed state.
• Active measures shall be taken following the reclamation and during routine
maintenance to promote diffuse flow of stormwater through the buffer.
With respect to preventing future impacts, PNG contractors have been provided with
maps identifying the streams subject to the protected riparian buffers. At such locations,
"no work" boundaries extending 50 feet from the top -of -bank of each subject stream are
clearly demarcated in the field. As a result, PNG anticipates that no additional vegetation
removal will occur in these areas until the appropriate buffer authorization has been
received.
The contractors have also been provided with written Environmental Guidelines detailing
methods by which vegetation removal activities should be conducted in order to avoid
disturbance within protected riparian buffers. As described previously, S &ME has
delineated and demarcated all wetland areas within which the reclamation work will
occur. The delineation will serve to:
Establish boundaries within which all vegetation must be removed by hand above
ground level — no grubbing, stumping or other land disturbance is allowed without
prior authorization from the USACE and NCDWQ.
Demarcate areas within which timber mats or similar measures must be employed
to accommodate heavy equipment and prevent extensive rutting and soil
disturbance.

Establish boundaries within which application of rye grain or a native wetland
seed mix is required. PNG understands that application of fescue within wetland
areas is prohibited.
Demarcate areas where streams should be bridged or crossed in such a manner
that prevents bank impacts.
Implementation of these measures should serve to prevent similar inadvertent impacts
associated with similar reclamation projects PNG is planning to undertake throughout the
state.
RESTORATION OF PREVIOUSLY AFFECTED AREAS
Details of PNG's plans to restore the streams and wetlands located west of Frieden
Church Road that were affected by placement of pipes are detailed in the Restoration
Plan in Appendix VL At these locations, the existing pipes will be removed and replaced
with shorter, 20 -foot pipes. Downstream of the new pipes, the stream channels will be
restored to their original grade and contour, the banks seeded with a native seed mix and
lined with erosion control fabric. Use of hard - armoring will be avoided. In the adjacent
wetland areas, excess fill material fill will be removed and the underlying area retuned to
pre- disturbance contours such that only a 20 -foot wide access road remains.
PNG also plans to maintain 30 feet of their 50 -foot wide ROW through the riparian
buffer. In those areas where the entire 50 feet was reclaimed prior to agency notification,
PNG will restore 20 feet of the ROW by replanting native woody vegetation. The
proposed composition of the plantings is detailed in the aforementioned Restoration Plan
(Appendix VI).
MITIGATION
Mitigation for impacts to Zone 1 of the riparian buffer is required for: 1) non -
perpendicular crossings; 2) greater than 401f but equal to or less than 150 If of riparian
buffer with a maintenance corridor greater than 10 feet in width, or 3) greater than 150 If
of riparian buffer. In instances where mitigation is required, the amount is determined by
multiplying the area (square feet) of impact to Zone 1 by 3. Mitigation for Zone 2
impacts is not required, as Zone 2 is to remain grassed ROW.
The project is proposed to result in permanent impacts to 14,430 square feet of Zone 1
riparian buffer. Of these permanent impacts, mitigation is required for 9,426 square feet
(see Riparian Buffer Impact Table, Appendix III). Accordingly, PNG is required to
purchase 28,278 riparian buffer mitigation credits (9,426 sf x 3). PNG proposes to
purchase the necessary credit from the North Carolina Ecosystem Enhancement Program
(NCEEP). A copy of an acceptance letter from NCEEP, based on a preliminary estimate
of buffer impacts provided in anticipation of this PCN, is included in Appendix VI.

The project area is limited to PNG's existing 50 -foot wode ROW, a majority of which is mainatined. Land use in the
vicinity of the project corridor consists primarily of a mix of woodland, open, maintained land and scattered residential and
light commercial areas. The route also passes through more urbanized portions of Greensboro and Burlington.

Explain the purpose of the proposed project:
The purpose of the project is to restore PNG's existing ROW to a maintained state. The existing ROW was acquired by
PNG in 1954, and is 50 feet wide. Over the years, the width of the ROW that PNG has regularly- maintained through
mowing and above - ground vegetation removal has steadily decreased, such that only 30 -40 feet of the 50 -foot ROW was
discernible in places. To adequately perform their routine maintenance and inspection of the pipeline, PNG determined
that the entire width of the ROW should be maintained in high ground areas.

The reclamation work entails above - ground removal of woody vegetation within portions of the 50 -foot ROW that have
grown up over the years. Some areas only require side - trimming or mowing brush. The maintained width of the ROW will
be reduced from 50 feet to 30 feet where it crosses the riparian buffer and the associated waterbodies. Industry
standard mowing, clearing and side - trimming equipment will be used.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Construction equipment operating within wetlands and buffers will be limited to that necessary for mowing and restoration
activities. Wetland vegetation within the remainder of the project will be cut at ground level, leaving existing root systems in
place to promote re- growth. Impacts will be minimized by reducing the width of the permanent maintenance corridor to 30 feet
through buffered areas.
PNG contractors have been provided with maps identifying the streams subject to the protected riparian buffers. At such
locations, "no work" boundaries extending 50 feet from the top -of -bank of each subject stream are clearly demarcated in the
field. As a result, PNG anticipates that no additional vegetation removal will occur in these areas until the appropriate buffer
authorization has been received.
The contractors have also been provided with written Environmental Guidelines detailing methods by which vegetation
removal activities should be conducted in order to avoid disturbance within protected riparian buffers. As described
previously, S &ME has delineated and demarcated all wetland areas within which the reclamation work will occur. The
delineation will serve to: 1) Establish boundaries within which all vegetation must be removed by hand above ground level —
no grubbing, stumping or other land disturbance is allowed without prior authorization from the USACE and NCDWQ. 2)
Demarcate areas within which timber mats or similar measures must be employed to accommodate heavy equipment and
prevent extensive rutting and soil disturbance. 3) Establish boundaries within which application of rye grain or a native wetland
seed mix is required. PNG understands that application of fescue within wetland areas is prohibited. 4) Demarcate areas
where streams should be bridged or crossed in such a manner that prevents bank impacts.
Implementation of these measures should serve to prevent similar inadvertent impacts associated with similar reclamation
projects PNG is planning to undertake throughout the state.

The project will also incorporate the following best management practices (BMPs): 1) Woody vegetation within the buffers
shall be cleared by hand. No land grubbing or grading will be allowed. 2) Vegetative root systems within the buffer shall be
left intact to maintain the integrity of the soil. Stumps shall remain. 3) No fertilizer shall be used other than a one -time
application to re- establish vegetation. 4) Construction activities shall minimize the removal of woody vegetation, the extent of
the disturbed area, and the time in which areas remain in a disturbed state. 5) Active measures shall be taken following the
reclamation and during routine maintenance to promote diffuse flow of stormwater through the buffer.

To comply with General Condition Nos. 18 (Protected Species) and 19 (Migratory Birds and Bald and Golden Eagles),
S &ME conducted a review of existing records obtained from federal and state sources. The U.S. Fish & Wildlife Service
( USFWS) list of federally protected species was consulted for a listing of protected species documented within Guilford
County, North Carolina. This review identified only one federally - protected plant species, small whorled pogonia (Isotria
medeoloides).
Small whorled pogonia is a member of the orchid family. According to the USFWS species description, it usually has a
single grayish -green stem that grows about 10 inches tall when in flower and about 14 inches when bearing fruit. The
leaves are arranged in a whorl near the top of the stem and beneath the flower. The leaves are grayish - green, somewhat
oblong and 1 to 3.5 inches long. The greenish - yellow flowers are about 0.5 to 1 inch long and appear in May or June. The
fruit, an upright ellipsoid capsule, appears later in the year. This species grows in older hardwood stands of beech, birch,
maple, oak, and hickory that have an open understory. Sometimes it grows in stands of softwoods such as hemlock. It
prefers acidic soils with a thick layer of dead leaves, often on slopes near small streams.
Although potentially - suitable habitat for small whorled pogonia exists in the vicinity, work associated with the culvert
placements occurred within an existing ROW where gas and overhead electric utilities are co- located. Habitat in this area
is not suitable for small whorled pogonia, and no plants resembling small whorled pogonia were observed in the adjacent
wooded area during an April 4, 2013 site visit by S &ME.
Review of the North Carolina Natural Heritage Program (NCNHP) Geographic Information Systems (GIS) files of Element
Occurrence (EO) and Natural Heritage Areas available from NC OneMap identified no records of protected species within
a two -mile radius of the area subject to the wetland and stream impacts identified in this PCN.

Service, which indicated that the closed site listed on the National Register of Historic Places is identified as the Boone
House (GF0377), located approximately 2,000 feet south of the existing ROW on Frieden Church Road. There were no
other properties currently listed or determined eligible for listing in the National Register of Historic Places within a one
mile radius of the project.
Although unlikely, in the event previously unknown historic, cultural or archeological remains and artifacts are
encountered while performing the work, the USACE will be notified, and to the maximum extent practicable, reclamation
activities that may affect the remains and artifacts will be avoided until the required coordination has been completed.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre- construction notification" (PCN), or requests verification for a non - reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicant's acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be" waters of the United States on the
subject project site, and identifies all aquatic features on the site that could be
affected by the proposed activity, based on the following information:

RESTORATION PLAN
PNG Greensboro Reclamation Project
Guilford and Alamance Counties, North Carolina
BACKGROUND
The following restoration plan shall be implemented in order to: 1) restore wetland and
jurisdictional stream channels within the existing Piedmont Natural Gas (PNG) right -of-
way (ROW) that were temporarily disturbed during construction of an access route, and
2) re- vegetate portions of the existing ROW that are located within streamside areas
subject to riparian buffer rules.
A primary focus of the restoration efforts will occur at an impacted area located west of
Freiden Church Road near McLeansville, North Carolina. At this location, PNG placed
culverts and associated fill material within two jurisdictional stream channels in order to
provide vehicular access to an otherwise isolated high ground portion of their ROW. The
streams are identified as Streams 22 and 23, and each is adjoined by a riparian wetland
area, identified as Wetlands A and B, respectively. Because equipment mats were not
employed when the work was performed, Wetlands A and B were impacted by heavy
equipment moving through the area to install the pipes and to remove brush and felled
vegetation. Wetland B was also impacted by placement of a pipe within a drainage
feature. The drainage feature within Wetland B did not exhibit a continuous bed and bank
or other morphological features to a degree sufficient for classification as a stream.
The culverts placed within the jurisdictional areas consisted of 8 -inch, corrugated plastic
pipes that spanned the width of the 50 -foot ROW.
Following review of the area by U.S. Army Corps of Engineers (USACE) and the N.C.
Division of Water Quality (NCDWQ) personnel on March 12, 2013, it was determined
that the existing pipes should be removed and replaced with pipes of a smaller length.
Agency personnel also determined that the diameter of the new pipes should be sufficient
to accommodate normal flow and circulation patterns associated with the streams and
wetland area.
RESTORATION ACTIVITIES
Stream 22 and Wetland A
Restoration activities associated with Stream 22 will entail removal of the existing, 8 -inch
diameter pipe that spans approximately 15 if of the ROW and replacement with a 18 -inch
diameter pipe of the same length. The remaining length of the stream within the existing
ROW had not been piped, but had been impacted by sedimentation and equipment traffic.
The length of channel located downstream of the new pipe will be restored to its
approximate original grade and contour, seeded and stabilized with matting. Use of hard -
armoring will be avoided.
Stream 23 and Wetland B
The existing 79 -foot long, 8 -inch diameter pipe located within Stream 23 will be replaced
with two parallel 27 -foot long, 8 -inch diameter pipes. Use of the two 18 -inch diameter
pipes will accommodate the same flow as that of a 36 -inch pipe, but will reduce the

crossings vertical profile and the amount of overlaying fill material required to construct
the adjacent approaches. Downstream of the new pipes, the 50 feet of stream channel
previously impacted by placement of the original pipe will be restored to its natural grade
and contour, the banks seeded with a native seed mix and lined with erosion control fabric.
Similarly, the existing 47 -foot long, 8 -inch diameter pipe that was placed within Wetland
B will be replaced with two parallel 17 -foot long 18 -inch diameter pipes. Approximately
30 feet of a drainage feature (not classified as a stream channel) located within Wetland B
downstream of the new pipe will be restored to its approximate original grade and
contour, seeded and stabilized with matting. Use of hard - armoring will again be avoided.
Fill material placed in connection with construction of the crossings will be limited 15 feet
in width, and to that necessary to cover the pipes and tie the crossing the existing grade.
Excess fill material fill will be removed and the underlying area retuned to pre- disturbance
contours. Within wetlands and buffered areas, the pre- reclamation wood line (which was
surveyed prior to reclamation activities) will be re- established by planting native woody
vegetation. The remainder of the wetland area will be seeded with a native wetland seed
mix (Table 1).
Buffer Restoration
Project -wide, PNG plans to maintain 30 feet of their 50 -foot wide ROW through the
riparian buffer. In those areas where the entire 50 feet was reclaimed prior to agency
notification, PNG will restore approximately 20 feet of the ROW, or the limits of the pre -
reclamation wood line, by replanting the affected areas with native woody vegetation.
The composition of species to be planted is identified in Tables 3 and 4. Disturbed areas
will also be seeded with the seed mix specified in Table 2.
POST - CONSTRUCTION MONITORING
Quarterly monitoring of Streams 22 and 23 and Wetlands A and B shall be performed for
a period of two years following restoration of these areas. The monitoring will consist of
photographic documentation of restored areas and a qualitative assessment of streambank
stability and the growth/hardiness of planted vegetation. We anticipate that reports will be
provided to NCDWQ and the USACE at a frequency to be determined by special
conditions of the permit and /or water quality Certification.

To provide quicker cover, 50 percent of mix should consist of perennial rye (Lolium perenne)

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated
with the proposed activity including SL 2009 -337: An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S.L. 2011 -343.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit /401 Certification /CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In-
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you in your request to use the NCEEP, the impacts that may require compensatory mitigation are
summarized in the following table. The amount of mitigation required and assigned to NCEEP for this impact is detennined by
permitting agencies and may exceed the impact amounts shown below.
