Dear Mr. Weinhold:
On March 12, 2007, Chad Coburn of the North Carolina Division of Water Quality (DWQ) met with Mr.
Bob Gaudier and the landscaper regarding Neuse River Riparian Buffer issues related to the prior NOV
dated February 2, 2007 (NOV-2007-WQ-0002). The violations addressed in this NOV have been
resolved and the site is now in compliance with the buffer rules.
On July 7, 2005, a Minor Variance was approved by the DWQ for impacts to Neuse River Riparian
Buffers in River Estates subdivision. These impacts included several of the townhouse structures and/or
decks, totaling approximately 1382 square feet (ft2) of Zone 2 of the protected buffers. The Minor
Variance included conditions that must be met in order to comply with the Neuse River riparian Buffer
Rules. As the party responsible for maintaining the grounds around the buildings, the homeowners
association will need to inspect the buffer areas on a regular basis, and ensure that vegetative cover is
maintained and no further erosion occurs. All residents who live in units along the Riparian Buffer
should be informed of the buffer rules and the restrictions associated with activities within the buffer.
