DANIEL SMITH Director NORTH CAROLINA Environmental Quality June 21, 2021 Shawn Wilkerson Wildlands Holdings III, LLC (via electronic mail: swilkerson@wildlandseng.com ) Re: Moccasin Creek Mitigation Banking Instrument (MBI) Moccasin Creek Bank Parcel Credit Release ā€” Task 2 Dear Mr. Wilkerson: DWR Project #: 2019-0239v2 Johnston County On March 29, 2021, the Division of Water Resources (DWR) received documentation from Wildlands Holdings III, LLC (Wildlands) that the Moccasin Creek site had been planted and constructed in its entirety and monitoring plots had been installed. On April 22, 2021, Katie Merritt with DWR, with assistance from staff with Wildlands, inspected the site and confirmed that the subject site had been fully planted, all monitoring plots had been installed, and conservation easement posts and notification placards identifying the conservation easement boundary were installed. During the site visit, Ms. Merritt observed that conservation easement posts marking the inner 15' boundary along Moccasin Creek and UT1 were present, but there were no easement placards attached. Ms. Merritt also noted to Wildlands, that additional signs marking the conservation easement boundary within the two perpendicular utility crossings would be needed. Additionally, no seeding by Wildlands had been implemented, which is a requirement per the approved Bank Parcel Development Plan. On May 27, 2021, DWR received written documentation from Wildlands that all posts now have notification placards, both utility crossings were adequately marked with additional signs and taping, and that a seed mix had been applied on May 17, 2021. On October 19, 2020, DWR received a performance bond (#107309673) issued to Wildlands from Travelers Casualty and Surety Company of America, in the amount of $150,000, to cover performance obligations for the construction of the subject site. The term of this bond will remain in effect until DWR has provided a written approval of the As -Built Report. Please note that nutrient offset credits generated at this site must be used for impacts in HUC 03020201 of the Neuse River Basin excluding the Falls Lake Watershed pursuant to 15A NCAC 02B .0703, which became effective on April 1, 2020.
