i hope you have today (friday) off... and i hope you are actually not
working also... and i hope the earliest you see this is monday!!!
anyway, never heard back from you on my ideas for Shiloh Crossing
(below)... or my conflicts for the proposed meeting date... if that will
work i think we figured out that project...
but, of course, since then we have another one with the same issue (see
attached)... [i think you are familiar with this one for an issue with
the buffers... anyway, i go on...] This one includes a partial retrofit
of an existing pond... Again, the issue is the same as with Shiloh
Crossing... i.e. we proposed ponds followed by a level spreader
discharging to a forested filter strip designed per the DWQ Level („}~ ~~14 ~~
Spreader Design Guidance (which i gather is not acceptable now) as ~ ',~ ~ ///
opposed to designed to the Stormwater Manual... ~[ ~~, S-tr'.
Anyway... GC 3402 states: J
"Alternative designs may be requested by the applicant and will be
reviewed on a case-by case
basis by the Division of Water Quality." (- _~
As such, in this case, i would propose that ponds designed to the DWQ ~f v v
Level Spreader Design Guidance be considered as effective as ponds ~ ~~
followed by forested filter strips that are designed to the Stormwater
BMP Manual... ~~~ ~~ P/'v
i am sorry i cannot meet on the 16th... maybe we can take care of both

btw - totally off subject... we just got another dog (yes, we are nuts
and stupid!)... she looks to be a cattle dog like dingo. she is
supposedly about 2 years old... she was "rescued" from an animal control
facility in SC from what i gather... hopefully, dingo will help train
her...

Dear Mr. Cook:
On November 3, 2006, the Division of Water Quality (DWQ) received your application dated
November 3, 2006, to impact 0.152 acres of wetland, 290 linear feet of intermittent stream, and
2,154 square feet of Zone 2 protected Neuse River basin riparian buffer to construct the proposed
residential development. The DWQ has determined that your application was incomplete and/or
provided inaccurate information as discussed below. The DWQ will require additional
information in order to process your application to impact protected wetlands and/or streams on
the subject property. Therefore, unless we receive five copies of the additional information
requested below, we will have to move toward denial of your application as required by 15A
NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional
information. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
1. Please resubmit your plans on full plan sheets
2. Please be aware that the existing stormwater basin and proposed wet detention basins and
level spreader BMPs will need to be redesigned as constructed wetlands, or wet ponds
followed by a forested filter strips and level spreaders per GC 3402.
3. Please provide detail for the stormwater management practices referenced above as
required by GC3402.

4. Please provide a signed and notarized Operations and Maintenance Agreement and all
necessary worksheets for the stormwater management practices referenced above as
required by GC3402.
Please respond within three weeks of the date of this letter by sending this information to me in
writing and Eric Kulz of the DWQ Raleigh Regional Office. If we do not hear from you within
three weeks, we will assume that you no longer want to pursue this project and we will consider
the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian

On or about September 1, 2006, the Stormwater Management Plan required by Water Quality Certification
#3553 (DWQ #05-1711) was submitted to your office.
We are updating project status for the Airport Authority.
What is the status of review/approval of the Plan?
Also, please advise as to the fee required to move the Plan into the Express Review process, as well as
the relative time frame for review (express vs standard processing).
