DANIEL SMITH Director NORTH CAROLINA Environmental Quality June 21, 2021 Shawn Wilkerson Wildlands Holdings V, LLC (via electronic mail: swilkerson@wildlandseng.com ) Re: Catfish Pond II Mitigation Banking Instrument (MBI) Catfish Pond II Bank Parcel Credit Release — Task 2 Dear Mr. Wilkerson: DWR Project #: 2018-0196v2 Durham County On May 27, 2021, the Division of Water Resources (DWR) received documentation from Wildlands Holdings V, LLC (Wildlands) that the Catfish Pond II site had been planted and constructed in its entirety and monitoring plots had been installed. Additionally, documentation was also provided confirming that stream mitigation activities including riparian plantings and installation of all monitoring plots for the Catfish Pond Full -Delivery Mitigation Site for the Division of Mitigation Services (DMS ID# 100039) had been fully completed by June 2020. On June 17, 2021, Katie Merritt with DWR, with assistance from staff with Wildlands, inspected the site and confirmed that the subject site had been fully planted, all monitoring plots had been installed, cattle exclusion fencing had been installed throughout the project identifying the boundary of the conservation easement, and placards identifying the conservation easement area were observed. On October 13, 2020, DWR received a performance bond (#107256024) issued to Wildlands from Travelers Casualty and Surety Company of America, in the amount of $150,000, to cover performance obligations for the construction of the subject site. The term of this bond will remain in effect until DWR has provided a written approval of the As -Built Report. In accordance with the MBI, signed on September 14, 2020, the following Project Milestones have been met and the corresponding credits shall be released: Task/Milestones Credit 2) Mitigation Site Earthwork, Planting and Installation of Monitoring Devices Completed for both the Catfish Pond Full -Delivery Site and the Bank Parcel 20% By copy of this correspondence, DWR confirms that you have satisfied the above requirements for the above -referenced tract and therefore, 20% of the Neuse buffer Restoration credits (0.20 x 357,781 ft2 = 71,556.200 ft2) and 20% of the Neuse buffer Enhancement via Cattle Exclusion credits (0.20 x 52,068.746 ft2 =10,413.749) are now available to sell. Lastly, 20% of the Nitrogen nutrient offset credits (0.20 x 45,476.713 lb-N = 9,095.343 lb-N) and 20% of the Phosphorus nutrient offset credits (0.20 x 2,929.052 lb-P = 585.810 lb-P) are now available to sell. Additionally, the riparian buffer credits must be used for authorized impacts in the Neuse River Basin according to guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015.
