On behalf of the NC Division of Water Quality (DWQ), we respectfully request that you consider
the following comments within your review of the 404 Individual Permit request for the above
referenced property:
Alternate Site 2: Porter's Neck Crossing has already been issued 404/401 authorization
to impact 3.9 acres of wetlands to construct a similar commercial /retail development.
We request the US Army Corps of Engineers ask the applicant to provide documentation
of the deed restriction, which prevents the sale of groceries on the property, and if
efforts can be made to remove this restriction.
2. Please provide more details regarding avoidance and minimization of wetland impacts
for this project. This Office believes that the lot labeled on the plans as Outlot #1 can be
moved or reconfigured to avoid /minimize the impacts to the high value wetland. Please
revise the plans to avoid /minimize the impacts or provide a detailed explanation of why
this plan for the activity cannot be practically accomplished, reduced or reconfigured to
better minimize disturbance to the high value wetland.
3. Please explain how wetland hydrology will be maintained within the 1.57 -acre high -
value wetland that is proposed as a preservation area.
