This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). In order to comply with the conditions of NCG140000 to which you are now subject, you are required to do the following: ➢ Implement a SWPP within 12 months of issuance. ➢ Download and print a copy of the NCG140000 Permit from the General Permits page on the NPDES Industrial Stormwater Program web site, which can be reached by typing °deq.nc.gov/SW-industrial" into your browser and hitting enter. ➢ When you receive an invoice for your annual permit fee each year, pay it promptly. Electronic payment is convenient and quick, you can access the ePayment web site at: https: //deg.nc.gov/about/divisions /water-resources/water-resources-p,er,mits,/wa- epayments. ➢ Enroll in electronic Data Monitoring Reports (eDMR) when instructed to do so by the DEMLR Stormwater Program. You will be contacted in 2021 to begin the eDMR steps. You can read about eDMR at https: L/deq.nc.gov/about/divisions/energy,-mineral-land- resources/stormwater/ereporting-rule. ➢ Keep information about your facility name, ownership, legally responsible person, address, and stormwater outfalls up to date. The General Permit imposes a more stringent TSS limit and a flow limit of 50 percent of the 7Q10 base flow for all discharges to HQW-classified waters The 7Q10 base flow for Huges Mill Creek at this location is estimated to be < 0.00014 cfs; therefore, wastewater discharge to Sharron Creek should be limited to 453 gallons per day (gpd) or less. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only wastewater would be discharged from this facility. If separate point -source discharges of stormwater occur (i,e., stormwater not combined with process wastewater), you will be required to adhere to the conditions in this permit for stormwater discharges. This project is located in one of North Carolina's 20 coastal counties. Coastal stormwater management rules (15A NCAC 2H .1000) may require an additional State Stormwater Permit (different from the NPDES mining activities discharge permit). Please contact Brian Lambe in the Wilmington Regional Office at 910-796-9800 to determine if you will be required to submit an application for a State Stormwater permit. Additionally, please see guidance on our website [https: //deq.nc.gov/about/divisions/energy- mineral-land-resources/energy-mineral-land-rules/stormwater-programfpost-construction) for mines located in Phase II Post -Construction areas. This guidance clarifies the applicability of Session Law 2006-246 to mines located in Phase II Post -Construction areas. You may be required to apply for a separate Post -Construction stormwater permit from the State or local government. Please take notice that this certificate of coverage is not transferable except upon approval of the Division of Energy, Mineral and Land Resources (Division). The Division may require modification or revocation and reissuance of the certificate of coverage. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Resources, the Coastal Area Management Act, or any other federal or local government permit that may be required.
