Good day Bobby,
As a follow-up to our phone conversation, please see the email chain below regarding the proposed pipe crossing at Verranzo
Court in Section VI of Stone’s Landing in the Onslow Bay subdivision near Jacksonville. I have attached the conditions of the GC
4256 that applies to the USACE NW 29 for culverts in streams and wetlands. The II. General Conditions, specific condition #11
listed below applies to this feature which is a delineated wetland and an ephemeral stream. The culvert crossing will need to be
re-design to comply with the conditions of the DWR general certification listed below. Based on the need to redesign this culvert
to comply with the conditions listed, the DWR 401 application is on-hold until the additional information requested is received.
11. Culverts shall be designed and installed in such a manner that the original stream profiles are not altered and allow for aquatic
life movement during low flows. The dimension, pattern, and profile of the stream above and below a pipe or culvert shall not be
modified by widening the stream channel or by reducing the depth of the stream in connection with the construction activity. The
width, height, and gradient of a proposed culvert shall be such as to pass the average historical low flow and spring flow without
adversely altering flow velocity. If the width of the culvert is wider than the stream channel, the culvert shall include multiple
boxes/pipes, baffles, benches and/or sills to maintain the natural width of the stream channel. If multiple culverts/pipes/barrels
are used, low flows shall be accommodated in one culvert/pipe and additional culverts/pipes shall be installed such that they
receive only flows above bankfull.
Placement of culverts and other structures in streams shall be below the elevation of the streambed by one foot for all culverts
with a diameter greater than 48 inches, and 20% of the culvert diameter for culverts having a diameter less than or equal to 48
inches, to allow low flow passage of water and aquatic life. If the culvert outlet is submerged within a pool or scour hole and
designed to provide for aquatic passage, then culvert burial into the streambed is not required.
For structures less than 72” in diameter/width, and topographic constraints indicate culvert slopes of greater than 2.5% culvert
burial is not required, provided that all alternative options for flattening the slope have been investigated and aquatic life
movement/connectivity has been provided when possible (e.g. rock ladders, cross-vanes, sills, baffles etc.). Notification, including
supporting documentation to include a location map of the culvert, culvert profile drawings, and slope calculations, shall be
provided to DWR 30 calendar days prior to the installation of the culvert.
When bedrock is present in culvert locations, culvert burial is not required, provided that there is sufficient documentation of the
presence of bedrock. Notification, including supporting documentation such as a location map of the culvert, geotechnical reports,
photographs, etc. shall be provided to DWR a minimum of 30 calendar days prior to the installation of the culvert. If bedrock is
discovered during construction, then DWR shall be notified by phone or email within 24 hours of discovery.
Installation of culverts in wetlands shall ensure continuity of water movement and be designed to adequately accommodate high
water or flood conditions. When roadways, causeways, or other fill projects are constructed across FEMA-designated floodways or
wetlands, openings such as culverts or bridges shall be provided to maintain the natural hydrology of the system as well as prevent
constriction of the floodway that may result in destabilization of streams or wetlands.
The establishment of native woody vegetation and other soft stream bank stabilization techniques shall be used where practicable
instead of rip-rap or other bank hardening methods.

Justification: Surface water quality standards require that conditions of waters be suitable for all best uses provided for in state rule,
and that activities must not cause water pollution that precludes any best use on a short-term or long-term basis. Ensuring that in-
stream structures are installed properly will ensure that surface water quality standards are met and conditions of waters are
suitable for all best uses.

Hi Holley,
We do not yet have Stone’s Landing Section VI. Thomas Engineering tried to submit Stone’s Landing Section IV through the Fast
Track ATC program but were not able to accept it yet due to overlap in project areas. (The Fast Track ATC program is one where
we do not conduct a review of the design and they promise they know what they are doing.) So if we are talking about the same
section, this design in what I understood to be a low density development is somewhat concerning. Are they proposing curb and
gutter in this area?
I included the requirements of a low density project (if that is what they intended to submit as) found in 15A NCAC 02H.1003(2)
below. I also included Rhonda and Connor with Erosion Control so they are aware of your concern.
The sub-items specific to the situation likely are (b) and (c):
15A NCAC 02H.1003
(2) DESIGN REQUIREMENTS FOR LOW DENSITY PROJECTS. Low density projects shall meet the following minimum design criteria:
(a) DENSITY THRESHOLDS. Low density projects shall not exceed the low density development thresholds set forth in the
stormwater programs to which they are subject pursuant to Rules .1017, .1019, and .1021 of this Section. For projects
subject to the requirements for Non-Coastal High Quality Waters and Outstanding Resource Waters, dwelling unit per acre
may be used instead of density to establish low density status for single-family detached residential development as set
forth in Rule .1021 in this Section;
(b) DISPERSED FLOW. Projects shall be designed to maximize dispersed flow through vegetated areas and minimize
channelization of flow;
(c) VEGETATED CONVEYANCES. Stormwater that cannot be released as dispersed flow shall be transported by vegetated
conveyances. A minimal amount of non-vegetated conveyances for erosion protection or piping for driveways or culverts
under a road shall be allowed by the permitting authority when it cannot be avoided. Vegetated conveyances shall meet the
following requirements:
(i) Side slopes shall be no steeper than 3:1 (horizontal to vertical) unless it is demonstrated to the permitting
authority that the soils and vegetation will remain stable in perpetuity based on engineering calculations and on-
site soil investigation; and
(ii) The conveyance shall be designed so that it does not erode during the peak flow from the 10-year storm as
demonstrated by engineering calculations.
(d) CURB OUTLET SYSTEMS. Low density projects may use curb and gutter with outlets to convey stormwater to grassed
swales or vegetated areas. Requirements for these curb outlet systems shall be as follows:
(i) The curb outlets shall be designed such that the swale or vegetated area can carry the peak flow from the 10-year
storm at a non-erosive velocity;
(ii) The longitudinal slope of the swale or vegetated area shall not exceed five percent, except where not practical due
to physical constraints. In these cases, devices to slow the rate of runoff and encourage infiltration to reduce
pollutant delivery shall be provided;
(iii) The swale's cross-section shall be trapezoidal with a minimum bottom width of two feet;
(iv) The side slopes of the swale or vegetated area shall be no steeper than 3:1 (horizontal to vertical);
(v) The minimum length of the swale or vegetated area shall be 100 feet; and
(vi) Low density projects may use treatment swales designed pursuant to Rule .1061 of this Section in lieu of the
requirements specified in Sub-items (i) through (v) of this Item.

Do you have a moment to chat about this or to share the rule citation for coastal stormwater that would prevent this design?
Based on the comments below, the NCDOT will support our recommendations. I want to be sure I have appropriately cited the
reasons for putting the project on hold and requiring the re-design. I did not see Stone’s Landing Section VI in BIMS so I am not
sure if this most recent section has been submitted for sormwater review and assigned a reviewer. Thanks in advance.

Doug,
I have reviewed this crossing and my comment is that the pipe will need to be laid inline with the channel approaching and leaving
the roadway. See image below. I will defer to the regulatory agencies for all requirements in order for the developer to receive
permit approval. If updates are required, then these changes will need to be reviewed by our unit before NCDOT plan approval. Let
me know if you need anything further.
