Cc: Dennison, Laurie; High, Veronica (Veronica.High @raleighnc.gov) Subject: RE: Raleigh projects (UNCLASSIFIED) John- My apologies for the confusion. Yes, we did talk about submitting the same info, but you do need to use the current form as you're applying for coverage under the current NW permits and corresponding GC. If the Corps has directed you to use the previous application form, please let me know as the intent is for you to submit the same application to both agencies! High @raleighnc.gov) Subject: RE: Raleigh projects (UNCLASSIFIED) Karen - My understanding on the City of Raleigh Northshore Lake application is that Laurie returned the application package for the referenced project. We had coordinated with you previously on the application /fee requirements and had /eft the package as similar to the 2008 submittal as possible for ease of processing on your end. The Corps had asked us to make a few changes (splitting the impacts up into smaller pieces), and due to changes on the ground and funding the City decided to drop the Brentwood Lake portion off the application, so we did make some edits to the previous PCN that was submitted. I had discussed some of this with Jennifer briefly when I dropped off the application on Friday. We left it on the previous version of the PCN to make the review easier in your office (in case you wanted to compare it back to the 2008 package), but if you need me to transcribe it onto the version 1.311.4 PCN for you, I can do that. If you guys could just let me know ASAP what you're requesting for the Northshore application regarding the PCN, that would be very helpful. We intend to get it back to you immediately as soon as the City receives it in the mail. - John J. Just to be clear (so I can inform my client appropriately), we would be re- submitting for the 401 Certification under the new GC's, but the 2008 Buffer Authorization would be valid until 2016 due to the Tolling Bill, correct? - JJ - - - -- Original Message---- - From: Higgins, Karen [ mai lto:karen.higgins @ncdenr.gov] Sent: Thursday, November 29, 2012 4:31 PM To: Jamison, John R. Subject: RE: Raleigh projects (UNCLASSIFIED) John- Laurie is correct in that a fee will be required. Because the 404 expired, the 401 expired and you'll be applying for coverage under the new GCs. We will need the full application package as required in our rules and the fee as required by statute. Sorry about that, there's really nothing we can do. Thanks - Karen Karen Higgins Supervisor, Wetlands, Buffers, Stormwater - Compliance & Permitting Unit NCDENR - Division of Water Quality 1650 Mail Service Center, Raleigh, NC 27699 -1650 To: Higgins, Karen Subject: FW: Raleigh projects (UNCLASSIFIED) Karen - Can you confirm Laurie's requirement for a full application fee on this 401 re- issuance? It is a City of Raleigh project on which they have twice paid an application fee previously (first time for a 401 Individual, second time for a 401 GC). I don't know if you guys can make any exceptions to requiring a permit fee or not, but this would certainly be a case where it could be warranted. We will simply be re- submitting the same application /information you guys have already reviewed. Thanks Karen! We are likely going to just re- submit the exact same paperwork to the Corps (that's what they requested). For re- issuing the 401, do we need to re- submit and pay another application fee, or can you guys re -issue the 401 without re- application? The old 401 is attached. As far as the 401 goes, it will be re- issued with the new 404, when you reapply you include copies to DWQ for the 401 and riparian buffer authorization (if there is one) Martin Richmond NC Division of Water Quality Raleigh Regional Office 3800 Barrett Drive, Raleigh NC 27609 (919) 791 -4250 Email correspondence to and from this address is subject to the North Carolina Public Records Law and may be disclosed to third parties unless the content is exempt by statute orother regulation. - - - -- Original Message---- - From: Jamison, John R. Sent: Friday, November 09, 2012 3:56 PM To: Witherspoon, Lauren Subject: FW: Raleigh projects (UNCLASSIFIED) Lauren - We had permitted this project with you guys using 3 Nationwides back in 2008 (at the direction of Jamie Shern), but this thing is just now getting ready to go to construction. DWQ issued us a 401 (see attached), but the Corps never issued the NWP's. Being that the 2007 NWP's have now expired (and we're not yet in construction), plus the fact that these 401 GC's utilized the 2007 NWP's, I'm assuming you would want us to re- submit under the new NWP's and GC's. Is that correct? Will you be the one to deal with this? Thanks! - John J. - - - -- Original Message---- - From: Jamison, John R. The Action ID's are 200421569 and 200420766. It was to be permitted under Nationwides 3, 13 and 33, and we submitted application to the Corps in August 2008 (to replace a 404 Individual application that was made in 2005 and never issued). As far as we are aware, the Corps never responded so the permits became statutorily valid after 45 days. With the project just now nearing construction and the 2012 Nationwides now superseding the 2007 Nationwides we submitted under, we would like to determine how you would like to see this project permitted. Feel free to call me, as it might be easier to discuss over the phone. Thank you!
