SUBJECT: Consistency Certification Submission Status for Proposed Impacts to 2.227 Acres of
Wetlands, 0.028 Acres of Isolated Wetlands, and 23 Linear Feet of Stream to
Facilitate the Construction of the Cypress Creek Subdivision, Bolivia, Brunswick
County (DCM#20060140)
Dear Ms. Williams
We received the consistency certification of Land Management Croup,. Inc. on behalf of the
Brunswick Development Company, Inc. (Applicant) on October 30, 2006 for the proposed
impacts to 2.227 acres of wetlands, 0.028 acres of isolated wetlands, and 23 linear feet of stream
to facilitate the construction of the Cypress Creek Subdivision. The proposed project site is
principally located northeast of the intersection of Gilbert Road (SR 1501) and Seahorse in
Bolivia, Brunswick County, North Carolina.
The submission was filed complete as of October 30, 2006. Pursuant to the requirements of
15 CFR 930.60, the purpose of this letter is to inform Brunswick Development Company, Inc;
Land Management Group, Inc; and the U.S. Army Corps of Engineers (Corps) that the State of
North Carolina has initiated commencement of its Federal consistency review. Please be aware
that as we continue to review this submission that we may develop questions on the proposed
project that will require that Land Management Croup, Inc. respond through the submission of
additional information.
The public review period for this project will be initiated on November 2, 2006. The public
notice will be printed on November 9, 2006 in the "Brunswick Beacon". Furthermore, the,
project has been distributed to State agencies that would have a regulatory interest in the
proposed activity for review and comment. The public review period will close on November
24, 2006. We intend to make a decision regarding whether the proposed activity would be
consistent with the State's coastal program soon after. Based on the requirements of 15 CFR
930.62, DCM has until Apri130, 2007 to either concur or object to the consistency certification.

Please note that the Division of Coastal Management does not typically issue a consistency
concurrence decision until the Applicant has obtained all other required State permits and/or
permissions. According to the submission letter, the Applicant is in the process of obtaining the
other required State approvals such as the Section 401 Water Quality Certification, an erosion
and sediment control plan, a storm water management plan, and an acceptance of any proposed
mitigation by the State's Ecosystem Enhancement Program (EEP). Before DCM makes a
decision on the consistency certification all these approval, as required, must be obtained. Please
forward copies of those approvals as they are received to DCM. Thank you for your
consideration of the North Carolina Coastal Management Program.
