STATE OF NORTH CAROLINA DEPARTMENT OF TRANSPORTATION ROY COOPER JAMES H.TROGDON,III GOVERNOR SECRETARY October 26, 2018 ,-DocuSigned by: Memorandum To: 14C.045166 File J l0/26/Z018 '-8B673FBE42E5415... '-- From: Dave McHenry, NCDOT Division 14 Environmental Officer Subject: Natural Resource Review In Henderson County, Carolina northern flying squirrel (Glaucomys sabrinus coloratus), gray bat (Myotis grisescens), northern long-eared bat (NLEB, Myotis septentrionalis), Appalachian elktoe mussel (Alasmidonta raveneliana), swamp pink (Helonias bullata), small whorled pogonia (lsotria medeoloides), bunched arrowhead (Sagittaria fasciculata), mountain sweet pitcher plant (Sarracenia jonesii), and white irisette (Sisyrinchium dichotomum) are threatened or endangered species that have current records or that are suspected to still be present. Pending final design, the project may impact a small wetland area near Crab Creek. This project does not include replacement of the bridges on this road over Crab Creek and Shoal Creek, the only streams in the project area. The project will primarily impact actively used hay fields and pasture and a wooded-scrub area near Crab Creek Road for minor widening. Per attached NHP screening, there are no records for listed species within 1 mile of the project area. Though they are found in the Little River downstream of the project area, the project will have no effect on Appalachian Elktoe mussel since there will be no stream impacts, stringent sediment and erosion controls will be used, and because the occupied habitat is over 2 stream miles from the project area. The project may impact wetlands, but there will be no effect on mountain sweet pitcher plants, bunched arrowhead, or swamp pink because the subject wetland area is highly disturbed and these plants were not evident when the project area was surveyed on July 2, 2018. High elevation habitats for CNFS do not exist in the project area. Irisette is primarily restricted to the eastern extremes of Henderson County well distant from the project area. There are no caves, bridges, or mines evident near the site that could serve as roosts for gray bats. The project area is in an area that USFWS considers in the range of NLEB, but it is not in a "red HUC" for NLEB and over 0.25 mile from the nearest "red HUC". Tree clearing will be necessary with this project. The project will be compliant with the 4(d) rule for NLEB. {NV. Map units are composed of one or more map unit components or soil types, each of which is rated as hydric soil or not hydric. Map units that are made up dominantly of hydric soils may have small areas of minor nonhydric components in the higher positions on the landform, and map units that are made up dominantly of nonhydric soils may have small areas of minor hydric components in the lower positions on the landform. Each map unit is rated based on its respective components and the percentage of each component within the map unit. The thematic map is color coded based on the composition of hydric components. The five color classes are separated as 100 percent hydric components, 66 to 99 percent hydric components, 33 to 65 percent hydric components, 1 to 32 percent hydric components, and less than one percent hydric components. In Web Soil Survey, the Summary by Map Unit table that is displayed below the map pane contains a column named 'Rating'. In this column the percentage of each map unit that is classified as hydric is displayed. Hydric soils are defined by the National Technical Committee for Hydric Soils (NTCHS) as soils that formed under conditions of saturation, flooding, or ponding long enough during the growing season to develop anaerobic conditions in the upper part (Federal Register, 1994). Under natural conditions, these soils are either saturated or inundated long enough during the growing season to support the growth and reproduction of hydrophytic vegetation. The NTCHS definition identifies general soil properties that are associated with wetness. In order to determine whether a specific soil is a hydric soil or nonhydric soil, however, more specific information, such as information about the depth and duration of the water table, is needed. Thus, criteria that identify those estimated soil properties unique to hydric soils have been established (Federal Register, 2002). These criteria are used to identify map unit components that normally are associated with wetlands. The criteria used are selected estimated soil properties that are described in "Soil Taxonomy" (Soil Survey Staff, 1999) and "Keys to Soil Taxonomy" (Soil Survey Staff, 2006) and in the "Soil Survey Manual" (Soil Survey Division Staff, 1993). If soils are wet enough for a long enough period of time to be considered hydric, they should exhibit certain properties that can be easily observed in the field. These visible properties are indicators of hydric soils. The indicators used to make onsite determinations of hydric soils are specified in "Field Indicators of Hydric Soils in the United States" (Hurt and Vasilas, 2006). References: Federal Register. Hamilton NCNHDE-6635 August 6, 2018 David McHenry NCDOT, Division 14 253 Webster Road Sylva, NC 28779 RE: Shoal Falls Road Dear David McHenry: The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide information about natural heritage resources for the project referenced above. A query of the NCNHP database indicates that there are records for rare species, important natural communities, natural areas, and/or conservation/managed areas within the proposed project boundary. These results are presented in the attached `Documented Occurrences' tables and map. The attached `Potential Occurrences' table summarizes rare species and natural communities that have been documented within a one-mile radius of the property boundary. The proximity of these records suggests that these natural heritage elements may potentially be present in the project area if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one-mile radius of the project area, if any, are also included in this report. If a Federally-listed species is documented within the project area or indicated within a one-mile radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS)for guidance. Contact information for USFWS offices in North Carolina is found here: https://www.fws.gov/offices/Directory/ListOffices.cfm?statecode=37. Please note that natural heritage element data are maintained for the purposes of conservation planning, project review, and scientific research, and are not intended for use as the primary criteria for regulatory decisions. Information provided by the NCNHP database may not be published without prior written notification to the NCNHP, and the NCNHP must be credited as an information source in these publications. Maps of NCNHP data may not be redistributed without permission. Also please note that the NC Natural Heritage Program may follow this letter with additional correspondence if a Dedicated Nature Preserve, Registered Heritage Area, Clean Water Management Trust Fund easement, or an occurrence of a Federally-listed species is documented near the project area. If you have questions regarding the information provided in this letter or need additional assistance, please contact Rodney A. Butler at rodney.butler@ncdcr.gov or 919-707-8603.
