The City has received a Notice of Violation and Intent to Assess Civil Penalty from the Division of Water Resources, NCDEQ, dated June
4, 2021. Based on that NOV, the City requests that the Division consider this response letter in regards to the violation that occurred in
April of 2021.
As reported, the City was noncompliant with its Fecal Coliform limit the short week of April 1-2. 2021. With the Easter Holiday (Good
Friday) we only had the one sample of April 1, 2021.
When we look at the entire week (March 28-April 2, 2021), we were coming off a recent bypass of our filters. TSS was exceeded that
week along with weekly Fecal Coliform limit.
After reviewing the data and talking with lab personnel, we believe the fecal exceedances were related to residual solids in the channel.
Lab personnel pull their fecal grab sample from the weirs directly fed from that channel. The following two weeks after the weekly fecal
violations show fecal levels back into levels prior to the bypass.
City staff monitors the UV system daily with the bulbs being "wiped" each morning. It was noted in the operator log book on April 5 and
6, 2021 that there seemed to be some lights out in that channel. Staff pulled both Bank A and B (Banks house the UV lighting system)
from that channel and found some lights shattered. Both UV banks in that channel were pulled and thoroughly examined. All UV lights
were replaced on Apiil 21, 2021.
It is believed that residual solids in the chamber were the primary reason for the fecal exceedances. Fecal Coliform data leading up to the
March 28, 2021 filter bypass were well within limits... its only after do we see the fecal numbers exceed our permitted limit.
The City will continue to work aggressively in keeping these types of issues from developing as we move forward in maintaining our
NPDES permit compliance and protecting our environment.
