Dear Mr. Edmonds:
This correspondence is with reference to the request you submitted to modify State Permit No. 9-20, which was
originally issued to LTR Properties, LLC on January 23, 2020 for the expansion of the floating dock and installation
of 2 new boatiifts at 1903 N. Lumina Avenue. State Permit No. 9-20 is due to expire on December 31, 2023.
The action proposed in your submittal consists of changes to the dimensions of floating docks F4 and F5 and the
removal of F6. The permitted dimensions of F4 are 4' by 34' and the proposed new dimensions would be 6' by
35'. The permitted dimensions of F5 are 4' by 40' and the proposed new dimensions would be 6' by 31.67', The
outer mooring piles on the west side would remain in the originally permitted position (see enclosed drawing dated
61412021).
Upon review of the information provided, the Division of Coastal Management has determined that the proposed
action continues to be consistent with existing State rules and regulations and is in keeping with the original
purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of State
Permit #9-20, as described in your request dated May 28, 2021 and drawing dated June 4, 2021. By copy of this
letter we are notifying the US Army Corps of Engineers and the Division of Water Resources of our action. Please
note this refinement does not alleviate the need to obtain any other local, state or federal permits.

Thanks for the reply and information. From what I've read, this should fall under the Minor Modification, as we are not
making an major adjustments to the overall plan as well as not increasing or decreasing the CAMA SF.
We have reviewed internally and are ready to move forward with the attached plan as our Minor Modification
request. Therefore, prior to having the neighbors sign -off for a 3rd time now, can you please review and confirm we are
ready to move forward with this plan and minor modification.

Hi Mr. Edmonds,
I haven't had a chance to dig into the changes proposed yet to ensure it would be a minor modification vs. a major
modification — See 15A NCAC 71 .0405 for the details.
If it is a minor mod. we need notifications from the adjacent property owners alerting them to the changes proposed, a
check for $100, and a written request forthe modification with the drawings. Are email request with the drawings you
already sent would suffice for that piece.
I'll take a closer look either tomorrow or Tuesday and let you know if 1 think you need to go the major mod, route.

Please see the attached updated plans per our conversation last week. If you can let me know what the process would
be for approving this modification, that would be great. We are still confirming internally this is 100% the route we want
to go.
50 ror now, I wanted to get this to you and confirm approval steps, timing, etc so we can understand the minor
modification process entirely and when we would be able to begin construction should we move forward on the
attached.
