Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The project site encompasses approximately 1.66 acres located to the south of Poole Drive, west of Aversboro Road in Garner, Wake County, North Carolina. The project site is currently undeveloped with successional forest approximately 10 to 15 years in age located across the majority of the site, with older mixed hardwood forests located along the western site boundary. A delineation of the site was completed by Timmons Group on March 23, 2021, which identified one main stream segment along the northwestern site boundary and continuing off -site within 50-ft of the western boundary. A smaller stream segment flows east to west from an off -site culvert into the stream feature in the northwestern corner of the site. No wetland features were identified within the site. The proposed project will avoid impacts to the aforementioned stream features and result in minor impacts to stream buffers within the southwestern portion of the site. 3b. The proposed project requires installation of SCMs to treat the drainage area in compliance with the Town of Garners state -approved stormwater program. As a result, one bioretention pond, located in the southwestern corner of the site, is proposed with a drainage conveyance and riprap dissipater pad to treat stormwater from the project drainage area and allow for diffuse flow into Zone 1 of the riparian buffer. The proposed drainage conveyance will also provide a bypass of existing stormwater drainage from off -site areas upslope of the site. Stormwater conveyed through the bypass from off -site areas will not be treated by the proposed SCM. The proposed impact will result in 684-sq.ft. of permanent Zone 2 and 51-sq.ft. of permanent Zone 1 buffer impacts. Impacts to Zone 2 are Allowable, while impacts to Zone 1 are allowable with mitigation since the impact will require vegetation removal for riprap pad installation. No additional impacts to Waters of the US are proposed. The proposed project is a single and complete phase with appropriate land use control measures in place for specific areas which require them. Traditional equipment will be used consisting of front-end loaders, bulldozers, paving equipment, graders, and earth movers. D. Impact Justification and Mitigation 1. Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project.* Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning, including the utilization of the wetland delineation to adjust the layout to avoid and minimize impacts. Avoidance and minimization measures were also accomplished during the design phase of the project. The proposed impacts are required in order for the project's goals to be realized. The proposed bioretention pond and new stormwater conveyance are required by the Town of Garner's state -approved stormwater management plan to treat stormwater from the drainage area before being discharged to nutrient sensitive waters. Additional impacts to riparian buffers were avoided by bypassing stormwater flow from upstream properties through the site to the proposed stormwater conveyance, reducing the necessary number of conveyances through the riparian buffer. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.* Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013) and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, diversion ditches, temporary coffer dams, tree protection, and clearing only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owner's representative. Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken to prevent oil, tar, trash, debris, and other pollutants from entering the adjacent jurisdictional features. Any excess excavated materials not utilized as back fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore, stockpiling of excavated material within jurisdictional Waters of the US will be strictly prohibited as part of the construction of this project. All project construction activities initiated within jurisdictional Waters of the US will be carried to completion in an expeditious manner to minimize the period of disturbance within the jurisdictional streams. Disturbed portions of Zone 1 and Zone 2 will be seeded and stabilized immediately following disturbance. 2. Buffer Mitigation 2a.
