Re: Reply to the Division of Water Quality's "Request For More Information" for the
Glenn View Station 401 application, Durham County, NC
Dear Mr. McMillan:
The purpose of this letter is to respond to your July 3, 20061etter requesting further
information. The original questions/requests are copied below as they appear on the
07/03/061etter and are then followed by our response to each.
Additionallnformation Requested:
1. "A signed and notarized Operations and Maintenance Agreement for the
proposed Stormwater wetland will need to be submitted with the final
Stormwater plan. "
As indicated in our application dated June 22, 2006, an adequately sized area has been set
aside for an extended detention wetland, however, final design has not been completed at
this time. The preliminary Stormwater management plan was included with our
application. We are requesting that a conditiona1401 be issued that would require the
submittal and approval of a sormwater management plan, including signed and notarized
Operations and Maintenance agreements, before any proposed impacts take place.
2. "The road crossings labeled as `Impact #7' and `Impact #8' do not appear to
be necessary. Please eliminate the road crossings or provide additional
information as to why they are necessary for this project. "
In our PCN application, we recognized the fact that these proposed crossings would serve
no purpose (connectivity etc.) and that DWQ's "no practical alternatives review" would
most likely require that the applicant completely avoid this impact. This proposed road
that is shown being constructed across two UT's to Cates Creek is being requested by
Durham County Planning Department and the applicant would prefer to not construct
these proposed impacts as they are not required for the functioning of the project. The

applicant does not intend to develop the property on the northwestern side of these UT's
to Cates Creek. The Durham County Planning Department has stated that they will not
require the crossings if NC DWQ or the USACE deny them, therefore, we are requesting
that these crossings be denied.
